REPORT OF THE REGULAR MEETING OF GORHAM TOWN COUNCIL
May 4, 2004  

        The meeting opened with the Pledge of Allegiance to the flag.

Roll Call:  Present:  Chairman Loveitt; Councilors Hamblen, Phinney, Willett, Robinson, Justice and Dugas; David Cole, Town Manager and Brenda Caldwell, Town Clerk

Moved by Councilor Dugas, seconded by Councilor Willett and VOTED to approve the Minutes of the Minutes of the April 6, 2004 Regular Meeting, the April 6, 2004 Special Meeting, the April 12, 2004 Regular Meeting and the April 26, 2004 Special Meeting as printed and distributed.  7 yeas.

There were no public communications.

Councilor Phinney gave a report on the last Ordinance Committee meeting.  The Committee met with a citizen and they prioritized the projects facing them.

Councilor Robinson reported on the annual meeting of the Gorham Business and Civic Exchange which he attended.  He reported on a letter received from the Gorham Historical Society expressing their unanimous support for saving the entire Shaw School and stated that he was a member of the Society and did not agree with that vote.  He also asked the Town Manager to gather information from the School Department regarding non-contracted employees’ salaries and percentage raises, as well as saying words of appreciation to David Sherry who is leaving the employment of the Gorham School Department.

Chairman Loveitt reported that the RWS Board a met several times lately.  He also reported that the public hearing on the budget will be Tuesday, May 11th and urged any groups who wish to make a presentation should be prepared to state where the money should come from.

        The Town Manager reported that the tax cap referendum will go to the voters at the November, 2004 election and suggested that the Council start thinking about that.  He also announced that he has presented a 15-year service pin to Terry Deering of Public Works and a 20-year service pin to Michelle Tiffany of Baxter Memorial Library.

        Councilor Phinney reminded everyone that the MMA tax proposal will be on the June 8th referendum ballot.

Item #6962.  Moved by Councilor Phinney, seconded by Councilor Hamblen and ORDERED that the Town Council refer a proposal to amend Chapter II, Section V, (E) (4) (b) Acceptance of Town Ways of the Land Use and Development Code to the Ordinance Committee for their recommendation.  7 yeas.

Item #6963.  Moved by Councilor Phinney, seconded by Councilor Hamblen and ORDERED  that the Town Council refer a proposal from Diane Brackett and Eric Harrison for the development of an Outdoor Lighting Ordinance to the Ordinance Committee for their recommendation.  7 yeas.

Item #6964.  Moved by Councilor Phinney, seconded by Councilor Justice and ORDERED that the Town Council issue a permit to the Maine Department of Transportation for the South Windham Bridge Project (PIN10171).  7 yeas.
Item #6965.  This item was ruled by the Chairman as inappropriately on the agenda as it was acted on at a recent meeting.

Item #6966.  Moved by Councilor Phinney, seconded by Councilor Willett and ORDERED that the Town Council, pursuant to an April 10, 2004 request from the Trustees of the Charles C. Shaw Scholarship Fund, accept the funds, in trust, in accordance with the following conditions:

1.  The principle amount of the trust fund,  which shall not be invaded, shall be $5,000.

        2.  Interest from the Trust Fund shall be used to provide scholarships to:

a.  A worthy student pursuing an educational experience beyond high school, requiring at least two (2) years of post high school education;

b.  The criteria shall be based on a combination of most need and scholarship effort, but not necessarily to a student of the highest academic standing;

c.  The minimum scholarship offered shall be $100 and no scholarship will be provided if the minimum funding amount is not available.  7 yeas.

Item #6967.  Moved by Councilor Phinney, seconded by Councilor Robinson ORDERED that the Town Council appropriate $20,000 from the Skating Rink Reserve Fund to pave the outdoor skating rink.  7 yeas.

Item #6968.  Moved by Councilor Robinson, seconded by Councilor Hamblen and ORDERED the Town Council appoint the following as Wardens and Ward Clerks for their respective wards for the June 8, 2004 State Primary Election:

Item #6969.  Moved by Councilor Phinney, seconded by Councilor Robinson and ORDERED the Town Council vote that the polls be open for the June 8, 2004 State Primary Election between the hours of 7:00 a.m. and 8:00 p.m.  7 yeas.

Item #6970.  Moved by Councilor Phinney, seconded by Councilor Robinson and the Registrar of Voters be in session between the hours of 8:30 a.m. and 6:30 p.m. on Thursday, June 3, 2004 and between the hours of 7:30 a.m. and 4:30 p.m. on Friday, June 4, 2004.  7 yeas.

Item #6971.  Moved by Councilor Robinson, seconded by Councilor Phinney and ORDERED that the Town Council authorize the renewal of a Malt Liquor License in the name of Mark Fogg, d/b/a The Grill Room at Gorham Country Club.  7 yeas.

        The Chairman declared a short recess for a budget workshop.

Moved by Councilor Dugas, seconded by Councilor Justice and VOTED to adjourn.  Time of adjournment - 8:40 p.m.
