REPORT OF THE SPECIAL MEETING OF GORHAM TOWN COUNCIL

September 23, 2004

       The meeting opened with the Pledge of Allegiance to the flag.

Roll Call of Council:  Present:   Chairman Loveitt; Councilors Hamblen, Robinson, Phinney, Dugas, and Willett; the Town Manager and the Town Clerk
                                Absent:  Councilor Justice

The meeting recessed for a public hearing on the citizen Initiated referendum under Section 903 of the Charter of the Town of Gorham:

PETITION

We, the undersigned registered voters of the Town of Gorham, in accordance with the provisions of Section 903  of the Council-Manager Charter of the Town of Gorham, Maine, hereby petition for the enactment of the following Ordinance:

Ordinance Amending the Zoning Map of the Town of Gorham

The official zoning map of the Town of Gorham shall be amended by rezoning Map 4, lots 6.004, 9, 6.001, 5, 6.005, 6.006, part of 1006 and part of 6; Map 6, lots 27, 31, 30, 29, 28, and 35; and Map 3, lots 22 and 22.002 from Suburban Residential and Rural to Roadside Commercial as per the attached map a more detailed version of which is on file in the Town Clerk's office.

        Nine citizens spoke at the public hearing - six opposed to the rezoning in South Gorham, four in favor of the rezoning.  The hearing closed at 8:10 p.m.

       Item #1018.  Prior to discussion and action on this item Councilor Phinney revealed that three of the election workers to be appointed are his relatives.  The Council decided that there would be no conflict if Councilor Phinney participates.

        The order, as read aloud by the Clerk was moved by Councilor Dugas and seconded by Councilor Willett.

       Moved by Councilor Robinson, seconded by Councilor Phinney and VOTED to amend the proposed order by removing the Town Council and Planning Board recommendations.  4 yeas.  2 nays (Loveitt and Willett).

        The order, as amended, was then VOTED resulting in the following

       ORDERED that the Town council vote to conduct a referendum election in Accordance with Section 903 of the Council-Manager Charter of the Town of Gorham on the referendum question set forth below, said referendum to be held in the following places on the second day of November, 2004 between the hours of 7:00 a.m. and 8:00 p.m. on said day:    

District 1 - Little Falls School
District 2 - Masonic Building, Cressey Road
District 3 - Gorham Middle School
Central District - Gorham Municipal Center

Referendum Question #1

Should the citizen-initiated petition, submitted pursuant to Section 903 of the~Gorham Town Charter, that the official zoning map of the Town of Gorham be amended by rezoning~certain designated lots in South Gorham from~the Suburban Residential and Rural~Zoning District to~the Roadside Commercial~Zoning District, as~shown on the following map, and as more~particularly shown on a more detailed~zoning map on file in the Town Clerk’s office, be approved?

BE IT FURTHER ORDERED that the Town Council vote to appoint the following persons as Wardens and Ward Clerks for the designated voting districts for the referendum election and if any of the following should fail to serve the Town Council hereby gives the Town Clerk the authority to appoint substitutes:

BE IT FURTHER ORDERED that the Town Council vote that the Registrar of Voters be in session between the hours of 8:30 a.m. and 6:30 p.m. on Thursday, October 28 and between the hours of 7:30 a.m. and 4:30 p.m. on Friday, October 29, 2004; and

BE IT FURTHER ORDERED that the Town Clerk be authorized to process absentee ballots at the Gorham Municipal Center at 9:00 a.m., 11:00 a.m., 1:00 p.m., 3:00 p.m., 5:00 p.m. and 8:00 p.m.  6 yeas.

Item #7019.  Moved by Councilor Willett, seconded by Councilor Dugas and VOTED that, pursuant to Title 1, M.R.S.A., Section 405 (6) (A) the Town Council go into executive session to discuss a personnel matter.  6 yeas.

Moved by Councilor Robinson, seconded by Councilor Dugas and VOTED to adjourn.  Time of adjournment - 8:55 p.m.
