REPORT OF THE SPECIAL MEETING OF GORHAM TOWN COUNCIL

April 24, 2001

        The meeting opened with the Pledge of Allegiance to the Flag.

Roll Call of Council:  Present:   Chairman Loveitt; Councilors Alden, Justice, Phinney, Chicoine, Willett  and Robinson; the Town Manager and the Town Clerk

Chairman Loveitt reported that he had attended a meeting in Brunswick with University officials and  Maine State Theater representatives regarding an interest in pursuing a performing arts theater in Gorham.  He also reported on a planning session that Peter Creighton, Cumberland County Manager will be hold on April 26th with Evan Rickert of the State Planning Department.

The Town Manager reported that MeDOT will be holding a public meeting on April 26th on the Libby Avenue project.

Item #6468.  Moved by Councilor Justice, seconded by Councilor Phinney and VOTED

        WHEREAS, the Town of Gorham has an ordinance that regulates Mineral Exploration, Excavation and Gravel Pits, and

WHEREAS, in reviewing the ordinance and information from the Maine Department of Environmental Protection and the recommendation from the Planning Board, the Town Council believes that the ordinance can be adjusted to provide for the long-term economic well-being of the community and also protect the welfare of residents of Gorham,

NOW, THEREFORE, BE IT ORDAINED by the Town Council of Gorham, Maine in Town Council assembled that the following ordinance be and hereby is adopted:

        Ordinance Amending Chapter II, Section I (C) of the Land Use and Development Code
        
1) Amend Chapter II, Section I.c. Mineral Exploration, Excavation and Gravel Pits, Subsection 5 (a) Operational Requirements for New and Existing Pits of the Land Use and Development Code as per the attached.  5 yeas.  2 nays (Loveitt and Willett)

        Prior to the above vote a motion to amend the proposed order the add that the applicant shall be responsible for the cost of testing by an independent tester as required by the Code Enforcement Officer failed of passage.  2 yeas.  5 nays (Hamblen, Robinson, Phinney, Loveitt, and Willett).

        Prior to discussion on the next Item Councilor Willett asked to be excused from discussion and voting as her husband works for Gawron Architects.  Moved by Councilor Justice, seconded by Councilor Chicoine and VOTED to excuse Councilor Willett from discussion and voting on the next item.  6 yeas.  1 abstention (Willett).

Item #6469. Move by Councilor Phinney, seconded by Councilor Chicoine and ORDERED that the Town Council accept a proposal from Gawron Architects to conduct a feasibility study of Shaw School, and

BE IT FURTHER ORDERED that the Town Council vote to appropriate $18,700 from the Contingency Account for the study.  6 yeas.  1 abstention (Willett).

The Chairman declared a recess to conduct a budget workshop with the School Department.  The meeting reconvened at 9:00 p.m.

Item #6470.  Moved by Councilor Phinney, seconded by Councilor Hamblen and ORDERED that, pursuant to Section 504 of the Town Charter, the Town Council call a public hearing for 7:00 p.m. on May 8, 2001 at the Gorham High School auditorium to accept comment on the proposed 2001-2002 Fiscal Year Municipal Budget.  7 yeas.

Moved by Councilor Phinney, seconded by  Councilor Justice and VOTED to take up an item not on the agenda.  7 yeas.

Moved by Councilor Phinney, seconded by Councilor Justice to go into Executive Session pursuant to Title 1, M.R.S.A., Section 405 (6) (c) for the purpose of discussion about the acquisition of property.  7 yeas.


Moved by Councilor Phinney, seconded by Councilor Hamblen and VOTED  to adjourn.  7 yeas.
