REPORT OF THE REGULAR MEETING OF GORHAM TOWN COUNCIL

December 4, 2001

        The meeting was opened with the Pledge of Allegiance to the Flag.

Roll Call:  Present:  Chairman Phinney:  Councilors Hamblen, Robinson, Loveitt,  Justice, Willett, and Dugas; the Town Manager and the Town Clerk.
                             
 Moved by Councilor Justice, seconded by Councilor Dugas and VOTED to approve the Minutes of the November 13, 2001 Regular meeting.  7 yeas.

There was no public communications

Councilor Loveitt reported on a meeting at the Scarborough Town Office regarding the traffic problem in South Gorham which he attended with the Town Manager and the Public Works Director.  There will be a second meeting in January.

Chairman Phinney stated that he would like to set the date of December 18th for a workshop on goal setting.

The Town Manager reported that he has presented a 5-year service pin to Gina Roberts of the Public Works Department and that last Friday he attended a meeting in Augusta on tax reform.

        The Secretary of State, Dan Gwadowsky appeared before the Council to explain and demonstrate the new Rapid Renewal Program which will enable citizens to register their vehicles over the internet.  Gorham is the twenty-second municipality to enter the program.

Item #6566.  Moved by Councilor Loveitt, seconded by Councilor Hamblen and ORDERED that the Town Council accept Sanford Drive as a public way in the Town of Gorham, and

BE IT FURTHER ORDERED that Sanford Drive be classified as an Industrial Street.  7 yeas.

        The meeting recessed for a public hearing on a proposed amendment to the Streets and Sidewalks Public Safety Ordinance to amend Schedule C in regard to Brackett Street.  There was no public comment and the hearing closed at 7:34 p.m.

Item #6570. Moved by Councilor Loveitt, seconded by Councilor Willett and VOTED

WHEREAS, Brackett Street is still listed on Schedule C of the Streets and Sidewalks Public Safety Ordinance, and

WHEREAS, the name of Brackett Street was changed to Huston Road several years ago, and

WHEREAS, the Town Council wishes to have the ordinance accurately reflect the current name,

NOW, THEREFORE, BE IT ORDAINED by the Town Council of Gorham, Maine in Town Council assembled that the following ordinance be and hereby is adopted:

        Ordinance Amending the Streets and Sidewalks Public Safety Ordinance to Amend Schedule C

1)  Amend Schedule C of the Streets and Sidewalks Public Safety Ordinance by deleting the name “Brackett Street” and replacing it with the following:

        “Huston Road – from Route 237 to Route 202”

The meeting recessed for a public hearing on renewal of the following Automobile Graveyard and/or Junkyard permits for 2002:

Item #6571.  Moved by Councilor Loveitt, seconded by Councilor Robinson and ORDERED that the Town Council authorize the renewal of the following Automobile and/or Junkyard Permits for 2002:

Item #6572.  A motion by Councilor Hamblen, seconded by Councilor Loveitt that the Town Council refer a request from Audrey Gerry, to extend the hunting area that is restricted to shotgun-only to the South Gorham area, to the Ordinance Committee for the Committee’s recommendation FAILED OF PASSAGE.  2 yeas.  5 nays (Robinson, Loveitt, Phinney, Justice and Dugas).

Item #6573.  Moved by Councilor Dugas, seconded by Councilor Justice and ORDERED that the Town council refer a request from the Gorham Business and Civic Exchange to assist in the purchase of “Welcome to Gorham” banners, to the Finance Committee for their recommendation.  7 yeas.

Item #6574.  Moved by Councilor Justice, seconded by Councilor Dugas and ORDERED that the Town Council refer a request from the Hillside Cemetery Association for a supplemental appropriation, a renew of cemetery lot pricing and maintenance responsibility to the Finance Committee for their recommendation.  7 yeas.

Item #6575.  Moved by Councilor Loveitt, seconded by Councilor Robinson and ORDERED that the Town Council accept a sidewalk easement from Hannaford Brothers as presented.  7 yeas.

Item #6576.  The Town manager introduced a proposal to initiate a curbside household trash and recyclable collection program through a pay-per-bag system.  There was no Council action.

Item #6577.  A motion by Councilor Dugas, seconded by Councilor Hamblen that the Town Council refer a request from Sebago Technics to eliminate the limitation on the length of private ways and the number of lots served by private ways to the Ordinance Committee FAILED OF PASSAGE.  3 yeas.  4 nays (Willett, Justice, Phinney and Robinson).

Item #6578.The order, as read aloud by the Clerk was moved by Councilor Hamblen and seconded by Councilor Dugas.

Moved by Councilor Willett, seconded by Councilor Hamblen to amend the proposed order by changing the date to February 5, 2002 and deleting the words “Phinney Street Extension” and inserting in their place the words “the westerly half of the range road as shown in the Titcomb Boundary Survey dated May 16, 2001”.  5 yeas.  2 nays (Loveitt and Willett)

Moved by Councilor Hamblen, seconded by Councilor Dugas to postpone action to the January meeting to set a public hearing for February 5, 2002 at 7:00 p.m. for the purpose of considering a condemnation order to acquire the westerly half of the range road as shown on the Titcomb Boundary Survey dated May 16, 2001, from the intersection of Phinney Street and Phinney Street Extension, thence northerly to the end of the constructed road.  ACTION POSTPONED  5 yeas.  2 nays (Robinson and Loveitt).

Previous to the above vote a motion by Councilor Dugas to move the question FAILED FOR LACK OF SECOND.

Item #6579.   Moved by Councilor Dugas, seconded by Councilor Hamblen and ORDERED that the Town Council accept an easement for a Fire Pond and Dry Hydrant in Apple Knoll Subdivision as presented.  7 yeas.

Item #6580.  Moved by Councilor Willett, seconded by Councilor Robinson and ORDERED that the Town Council authorize the Town Treasurer, for the calendar year 2002, for and in behalf of the Town of Gorham, to execute release deeds in the Town’s interest in tax-acquired property to delinquent taxpayers or those claiming by, through or under him, upon receipt of payment of all outstanding taxes, interest and costs.  7 yeas.

Item #6581.  Moved by Councilor Willett, seconded by Councilor Robinson and ORDERED that the Town Council authorize blanket approval to Windham-Gorham Rod and Gun Club, the Special Olympics of Maine and the North Scarborough Fire Department for Beano and games of chance for 2001, and

BE IT FURTHER ORDERED that a letter be sent to the Chief of the State Police so notifying him of the Council action.  7 yeas.

Moved by Councilor Justice,  seconded by Councilor Dugas and VOTED to adjourn.  7 yeas.  Time of adjournment  - 9:50 p.m.
