BOARD OF APPEALS
MEETING MINUTES
OCTOBER 20, 2005

The Gorham Board of Appeals held its regular meeting October 20, 2005 at the Gorham High School auditorium.

Present; Board members: David McCullough, Cressey Mollison, Lauren Carrier and Thomas Fickett.  Code Enforcement Officer Clint Cushman and Town Attorney, Bill Dale.
Absent; Board members Audrey Gerry, Joe Gwozdz and Clinton Pearson.  Deputy Town Clerk, Jennifer Elliott.
David McCullough was acting Chairman for the meeting.
Moved, Seconded and VOTED to approve the September 15, 2005 meeting minutes as printed and distributed.  4 Yeas.

Appeal# 05-194.  The appeal of Wayne Drown requesting 3,782 square foot lot area variance to construct a second home on a lot he owns at 11 Harding Bridge Road (Map 68, Lot 2.001), which is in the rural district.  Assessing records indicate the lot area to be 126,324 square feet, but a survey to divide the lot finds the lot to be 116,218 square feet in area.  60,000 square feet of lot area is required for each home.
Wayne Drown appeared and spoke on his own behalf.  He stated that this land has been in his family and he wants to sell a lot to his daughter, and the Town said he had enough land, so they went and got a loan to build and had it surveyed only to find the survey came up with different numbers.  
Bill Dale had a question about the shortage in length.
Wayne Drown explained that the Water District has an easement through part of his property, on the northerly edge.
There were no public comments and the hearing was closed.
The Board discussed old property markers and the criteria of the appeal.
Moved, Seconded and VOTED to approve the appeal.  4 yeas.

The Findings of Fact as read aloud by Bill Dale were Moved, Seconded and VOTED.  4 yeas.
Moved, Seconded and VOTED to adjourn.  4 yeas.
