BOARD OF APPEALS
OCTOBER 16, 2003
MEETING MINUTES


The Gorham Board of Zoning Appeals regular meeting was held in the Gorham High school Auditorium October16, 2003 at 7:00 pm.

Present; Chairman Mark Stelmack, Board Members; Audrey Gerry, Joe Gwozdz, David McCullough, Clinton Pearson and Stephen Scontras.  Code Enforcement Officer; Clint Cushman and Deputy Town Clerk; Jennifer Elliott.
Absent; James Pellerin.

Moved, Seconded and VOTED to accept the August 21, 2003 meeting minutes as printed and distributed.  6 Yeas.

Appeal #03-164.  The appeal of Pamela & Carleton Thurston Jr. requesting a permit to enlarge a non-conforming structure, namely to construct a 3 season room on a portion of an existing deck and over this room would be a new bedroom, on property they own at 314 Gray Road (Map 49, lot 53) which is in the Suburban Residential/ Manufactured Housing District.  
Carleton Thurston Jr. spoke on his own behalf and explained that they wanted to add a 3rd bedroom over a three-season room that would be built over an existing deck.  The septic had been tested and would accommodate a third bedroom.  This addition would not encroach any further into any setbacks.
There was no public comment and the hearing was closed.
The Board discussed and reviewed the special exception standards criteria.
Moved, Seconded and VOTED to grant the appeal as it met all the criteria.  6 Yeas.
The findings of fact as read aloud by the Code Enforcement Officer were Moved, Seconded and VOTED. 6 Yeas.

Appeal 303-165.  The appeal of Colin Dougher requesting an 11 foot variance to construct a 16 foot by 20 foot addition to an existing 20 foot by 20 foot garage on property he owns at 377 Mosher Road (Map 31, lot 5.005), which is in the Suburban Residential/Shoreland Zoning District.
Colin Dougher spoke on his own behalf and explained that the existing garage is too small for his needs.  The only option, because of the property lines and the slope of the land is to build this new garage.  The neighbors do not object to the new garage.  He explained that the previous owner had moved the existing garage to its present location.  The applicant reviewed the property drawing that he had submitted with his appeal with the Board members.  
There was no public comment and the hearing was closed.
The board reviewed and discussed the variance criteria.  They discussed that a 16 foot by 20 foot garage is a reasonable size garage and that the shape of the property is the over riding circumstance in this appeal.  
Moved, Seconded and VOTED to grant the appeal as it meets all the criteria. 5 Yeas.  1 Nay ( Scontras)
The findings of fact as read aloud by the Code Enforcement Officer were Moved, Seconded and VOTED.  6 Yeas.

Appeal# 03-166.  The appeal of Arthur and Tina Brant requesting a 3 foot side yard variance to construct a 24 foot by 22 foot residential garage on property they own at 11 Laurel Pines Drive (Map 25, lot 4.006) which is the Urban Residential District.
Arthur Brant spoke on his own behalf and explained that they wanted a single story garage attached to the house.  They could not go any narrower.
There was no public comment and the hearing was closed.
The Board discussed the 20% variance for single-family setback criteria.
Moved, Seconded and VOTED to grant the appeal as it met all the criteria. 6 Yeas.
The findings of fact were Moved, Seconded and VOTED. 6 Yeas.

Moved, Seconded and VOTED to adjourn.  6 Yeas.
