ZONING BOARD OF APPEALS



        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, April 25, 2016 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Code of the Town of Glenville.

        Application of Peter Ashline for a Conditional Use Permit that will allow for the construction of a new 1,420 s/f restaurant with indoor seating and associated site improvements at 612 Saratoga Road.  The property is located at the intersection of Hetcheltown Rd and Saratoga Rd, identified on tax map 16.5-3010.1 and is in the General Business Zoning.
        270-19,D: Restaurants are permitted in the General Business Zone upon site plan review and approval and issuance of  conditional use permits.  The PZC has granted preliminary site plan approval for this project and recommends to the ZBA granting of the conditional use permit at its 4/11/16 meeting.

        Application of Peter Ashline for three Area Variances associated with the construction of a new 1,420 s/f restaurant with indoor seating and associated site improvements at 612 Saratoga Road.  The property is located at the intersection of Hetcheltown Rd and Saratoga Rd, identified on tax map 16.5-3010.1 and is in the General Business Zoning.
        270-9, C: No permitted accessory use or building shall be located in any front yard.  The proposal is for the dumpster to be located in the front yard of Hetcheltown Road.  Therefore, the applicant is seeking total relief from this section of the ordinance.

        270-73, C, (3):  All parking lots/areas associated with a nonresidential use will be located no closer than 25 feet to any street right of way.  The proposal is for the parking area to be located 21’ from the right of way of Hetcheltown Road.  Therefore, the applicant is seeking a 4’ variance.

270-73, C, (4):  A parking lot serving a nonresidential or multi-family use may not be located any closer than 40 feet to the property line of a single or two-family dwelling.  The proposal is for the parking lot to be located 38 feet from the southern lot line of a single family dwelling.  Therefore, the applicant is seeking a 2 foot variance.


        Continuation:  Application of Todd Bush for a Conditional Use Permit for an expansion of the outdoor seating/patio area, group facilities, new bars, expanded parking, and outdoor entertainment.  The property is identified as the Pig n’ Whistle at 654 Saratoga Road. This expansion/use has already occurred.
