ZONING BOARD OF APPEALS
Please take notice that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, December 21, 2015 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Meridian Container Co., LLC, 92 Saratoga Road, Glenville, NY 12302 for a Non-Residential Area Variance to allow for the establishment of a contractor's office. The existing building and parking lot/driveway will be utilized without change. Use of the property is changing from residential to commercial. The property is zoned Professional Residential and is identified on tax map: 22.18-2-43.
270-7, M: Transitional Yard setback between residentially used property and commercially developed property shall be 30' of green space free from structures, parking, roadways, etc.
1) Parking area is 15' from the northern side lot line. Therefore a 15' side lot line variance is requested.
2) Driveway is 0' at its closest point from the southern lot line. Therefore, a variance of 30' (at the closest point) is requested.
Tabled Application:
Fred Becker, Backyard Sheds: on behalf of Fred Ogle for property at 658 Saratoga Road, Glenville, NY 12302 for Area Variances to allow for the establishment of a retail sales lot for storage sheds. The property is zoned Community Business and is identified on tax map 10.17-7-12.
270-Attachment 1: Minimum front setback of building shall be 40'
22' is proposed, therefore an 18' front setback is requested.
270-7, M: Transitional Yard setback between residentially used property and commercially developed property shall be 30' of green space free from structures, parking, roadways, etc.
Shed storage is proposed at 10' along both side lot lines. Therefore a variance of 20' is requested. Additionally, pavement is proposed 5' along the west side and 4' along the east side. Therefore a variance of 5' on the west and 6' on the east sides are requested.
270-73, C, (3): Parking setback shall be a minimum of 25' from front lot line.
The applicant is proposing 0' setback. Therefore a 25' front parking variance is requested.
270-73, C, (4): Green space to ROW. A minimum of 25' green space shall be provided.
The applicant is proposing 0' of green space to the ROW. Therefore a 25' green space to ROW is requested.
270-73, C (5): Location of parking area in CB Zoning must be to one side of the building.
5 parking spaces plus 1 space for H/C loading zone are proposed in front of the building. Therefore, the applicant is seeking a variance for 6 spaces in front of the building.
