TOWN OF GLENVILLE
ZONING BOARD OF APPEALS

        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, July 27, 2015 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

Application of Keith Orr, 11 Ralmar Drive, Glenville, NY 12302 for an Area Variance that will allow for a 5' high fence in the front yard to remain in place.  The property is located in a Suburban Residential Zoning District and is identified on tax map 16.13-3-2.
        In accordance with the Codes of the Town of Glenville 270-52, B, 2 - Fences will not exceed 4' in height in the front yard.  Therefore the applicant is seeking a height variance of 1' for approximately 30 l/f of fence in the front yard.

        Application of Joshua & Tammy Iacobucci, 22 Stableford Pl, Mechanicville, NY  12118 for a Conditional Use Permit that will allow for the construction of a new duplex dwelling at Lot 3 Maple Ave Ext of the G. Garrett Subdivision.  The property is located in a Suburban Residential Zoning District and is identified on tax map "unknown". (tax map for entire parcel prior to subdivision was 23.9-4-1.11)
        In accordance with the Codes of the Town of Glenville 270-15,D: two family dwellings are permitted by Conditional Use Permit.

        Application of Michael Cellini, 2575 Johnson Road, Glenville, NY 12302 for a Conditional Use Permit that will allow for the establishment of Mountain Ridge Adventure, a seasonal zip line adventure course.  The property is located in a Rural Residential/Agricultural Zoning District and is identified on tax map 7.-1-11.
        In accordance with the Codes of the Town of Glenville 270-14,E: recreation facilities are permitted by Conditional Use Permit.

        Application of Bhavik Jariwala, Oakwood Hospitality, 906 State Rt. 9, Queensbury, NY  12804 for a Conditional Use Permit Application to construct a new five-story hotel with shared parking and utilities between three properties currently known as 2 & 4 Freemans Bridge Road owned by Pat Popolizio, 1101 Rugby Rd., Schenectady, NY 12308.   The properties are proposed to be reconfigured into three new lots however they are currently identified on tax maps 30.19-1-22, 30.19-1-23 & 30.00-1-33.
        In accordance with the Codes of the Town of Glenville 260-23, C: lodging facilities are permitted by Conditional Use Permit.

        Application of Bhavik Jariwala, Oakwood Hospitality, 906 State Rt. 9, Queensbury, NY  12804 for 17 Area Variances associated with three parcels of property to be developed as a hotel, restaurant, banquet facility with office space, and a marina building with retail.  Associated parking and utilities are also part of this plan.  The property is currently known as 2 & 4 Freemans Bridge Road owned by Pat Popolizio, 1101 Rugby Rd., Schenectady, NY 12308.   The properties are proposed to be reconfigured into three new non-conforming lots which require variances.   They are currently identified on tax maps 30.19-1-22, 30.19-1-23 & 30.00-1-33.    
        In accordance with the Codes of the Town of Glenville the following variances are being requested by the applicant:  Note:  the variances are listed by the newly proposed lots, not as they exist now.

Lot 1: (restaurant)
Variance #1:     270, Attachment 1: minimum lot size - 2 acres.  Proposed - 1.01 acres.  Variance request is .99 acres.
Variance #2:  270, Attachment 2: minimum parking spaces required - 72.  Proposed - 41. Variance request is 31 parking spaces
Variance #3:  270-23, B:  minimum required parking space dimensions - 9.5' x 18'.  Proposed - 9.0' x 18'.  Variance required is .5' for the 41 spaces proposed.
Variance #4:  270-141,B,1:  minimum landscape required for lot - 35%.  Proposed - 7.5%.  Variance required is 27.5%.
Variance #5:  270-141,C,2:  minimum required internal landscape islands - 4.  Proposed - 3.  Variance required is 1

Lot 2: (new hotel)
Variance #6:  270, Attachment 1: minimum lot frontage - 200'.  Proposed - 36.77'.  Variance requested is 163.23'.
Variance #7:  270, Attachment 1: minimum side yard setback - 20'.  Proposed - 7.4'.  Variance requested it 12.6'
Variance #8:  270, Attachment 1: maximum site coverage - 20%.  Proposed 21.3%.  Variance requested is 1.3%.
Variance #9:  270-23,B: minimum required parking space dimensions - 9.5' x 18'.  Proposed - 9.0' x 18'.  Variance required is .5' for the all spaces proposed.
Variance #10:  270-23,E: maximum building height - 35'.  Proposed - 68'.  Variance requested is 33'.
Variance 11:  270-141,B,1:  minimum landscape required for lot - 35%.  Proposed - 26.6%.  Variance requested - 8.4%
Variance #12:  270-141,C,2: minimum internal landscape islands - 9.  Proposed 4.  Variance requested is 5.

Lot 3: (marina w/retail, banquet facility and office)
Variance #13:  270, Attachment 1:  minimum lot frontage - 200'.  Proposed - 85.58'.  Variance requested is 114.42'.
Variance #14:   270, Attachment 1:  minimum side yard setback - 20'.  Proposed - 16.4 and 16.9.  Variances requested are 3.6' and 3.1'.
Variance  #15:  270-73,C,3: minimum setback for parking - 10'.  Proposed - 5'.  Variance requested is 5'.
Variance #16:  270-141,B,1: minimum landscape required for lot - 35%.  Proposed - 26.6%.  Variance requested is .4%.
Variance #17:  270-141,C,2: minimum internal landscape islands - 10.   Proposed - 3.  Variance requested is 7.
