ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, April 28, 2014 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of Donna Carlow, 1141 St. Jude Drive, Rotterdam, NY 12302 for an Area Variance that will allow for the construction of a new single family dwelling located no closer than 41 feet to the western side lot line. Said property is located at 7 Snake Hill Road, Glenville, NY 12302, is in the Rural Residential/Agricultural Zoning District and is identified on tax map. 14.-3-41.112.
In accordance with the Codes of the Town of Glenville 270-Attachment 1, the minimum side setback in the RRA Zoning District for a new single family dwelling is 50 feet. The applicant is seeking a variance of 9 feet.
Application of Todd & Wendy Benjamin, 1014 Cherokee Road, Glenville, NY 12302 for an Area Variance that will allow the construction of a new single family dwelling on a lot at 812 So. Holmes Street, Glenville, NY 12302 that already has a dwelling located on it. The applicants are requesting that the "old" dwelling remain for a period of 90 days upon issuance of a Certificate of Occupancy on the new dwelling. After which the "old" dwelling will be removed from the site. Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.11-5-15.1.
In accordance with the Codes of the Town of Glenville 270-6: Number of dwellings on lot. Not more than one detached single-family or two-family dwelling shall be located on a lot.
Application of Shady Lane Realty, Inc., for Two Sign Variances at 113-115 Saratoga Road, Glenville, NY 12302. This project involves replacing an existing pylon sign and replacing it with a new ground sign. It also includes a variance request to increase the allowable signage on the site. Said property is located in a Community Business Zoning District and is identified on tax map 22.18-1-5.
In accordance with the Codes of the Town of Glenville the following variances are being sought.
1) 270-70(B)(1): The maximum height for a ground sign shall be 8 feet. The applicant proposes a ground sign 16 feet in height. Therefore, they are seeking a variance of 8 feet in height.
2) 270-69(E)(2): The maximum overall signage permitted on a Multiple Development Site is 150 s/f. The applicant proposes a maximum of 820 s/f for the site. Therefore, they are seeking a variance of 670 s/f.
Application of Shady Lane Realty, Inc., for Two Sign Variances at 123 Saratoga Road, Glenville, NY 12302. This project involves replacing an existing pylon sign and replacing it with a new ground sign with LED display. Said property is located in a Community Business Zoning District and is identified on tax map 22.15-2-51.
In accordance with the Codes of the Town of Glenville the following variances are being sought.
1) 270-70(B)(1): The maximum height for a ground sign shall be 8 feet. The applicant proposes a ground sign 16 feet in height. Therefore, they are seeking a variance of 8 feet in height.
2) 270-70(D)(5): The LED display area shall not exceed 32 s/f in size, on each side of the sign. The applicant proposes the LED display area of 44 s/f each side. Therefore, they are seeking a variance of 12 s/f of LED display area for each side of the sign.
Application of Electric Guard Dog, LLC., Columbia, SC on behalf of Old Dominion Freight Line, Inc. 11 7th Street, Glenville, NY 12302 for a Use Variance request to install a 10 foot high electric fence around the site. The proposed electric fence would be installed behind an existing chain link fence. Said property is located in an RDT Zoning District and is identified on tax map 29.-3-16.114 & 29.-3-16.41
In accordance with the Codes of the Town of Glenville 270-52(D)(4) Electric fences are prohibited for commercial, industrial and utility type uses.
