TOWN OF GLENVILLE
ZONING BOARD OF APPEALS

        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday August 26, 2013, at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

        Application of Kristen Trapalis, 604 So. Holmes Street, Glenville, NY  12302 for an Area Variance that will allow for the construction of a 38’ x 16’ pool deck that will exceed the maximum square footage permitted on the lot.  Construction of this deck has already begun.  Said property is located in the Suburban Residential Zoning District and is identified on tax map 38.11-2-23
        In accordance with the Codes of the Town of Glenville 270-9, G, 4:  The total of all accessory structures shall not exceed 75% of the footprint of the dwelling (488s/f).  Therefore the applicant is seeking a variance of 572 s/f.

        Application of Richard DeSimony, 9 Droms Road Ext, Glenville, NY  12302 for an Area Variance to allow for the construction of a new 25’ x 30’ two story detached accessory structure that will exceed the maximum square footage permitted for an accessory structure.  The total square footage of the proposed garage is 1,210 s/f (720 s/f -1st floor and 490 s/f – 2nd floor).  Said property is located in the Suburban Residential Zoning District and is identified on tax map 15.7-5-4.
        In accordance with the Codes of the Town of Glenville 270-9, G, 2: The maximum size of an accessory structure is 576 s/f.  Therefore, the applicant is seeking a variance of 634 s/f.  

        Application of Peter Looker, 1965 Amsterdam Road, Glenville, NY for an Area Variance that will allow placement of a 12’ x 18’  10’ high solar gazebo (accessory structure) in the front yard.  Said property is located in the Suburban Residential Zoning District and is identified on tax map 29.-4-5.1
        In accordance with the Codes of the Town of Glenville 270-9, C: No permitted accessory structure or use shall be located in any front yard.  Therefore, the applicant is seeking total relief from this section of the ordinance.

        Application of Mike Chrys for 5 Area Variances for property located at 124 Saratoga Road, Glenville, NY  12302 owned by Garner Builders LLC and Richard Cirincione, PO Box 341769, Tampa, FL 33694.  The variances are required for the recently extended parking area on the property.  Said property is located in the Community Business Zoning District and is identified on tax map: 22.15-2-52.211
        In accordance with the Codes of the Town of Glenville the following variances are being requested:
1)      270-73, B (1): every parking space shall be at least 9’ 6” x 18’.  The applicant has provided spaces 9’ x 18’.  Therefore he is requesting a variance of 6” in width for 23 spaces.
2)      270-73, B (2): aisles for maneuvering within parking areas. The minimum width for two directional traffic flow shall be a 24’.  The applicant has provided aisle widths of 20’.  Therefore he is requesting a variance of 4’ in width for two aisles.
3)      270-141, B (3):  Minimum landscape area.  any property being developed for nonresidential purposes will maintain a minimum of 25 feet of green space between the street ROW and the parking lot.  Landscaping and/or curbing is required in order to prevent vehicle incursion.  Furthermore, no vehicles will be parked in this twenty-five foot green area.  The applicant has extended and paved the parking lot to the lot line along Tech Park Road providing 0’ setback.  Therefore, he is seeking a variance of 25’ or total relief from this section of the ordinance.
4)      270-141, C (2): Landscape areas in parking lots.  Parking lots with 20 or more spaces are to be subdivided by internal landscape islands with not less than one island for every 10 parking spaces.    23 parking spaces have been provided which requires 2 landscape islands.  The applicant has provided no landscape islands. Therefore, he is seeking a variance of 2 landscape islands or total relief from this section of the ordinance.
5)      270-141, B (1):  Minimum landscape area:  All nonresidential uses will retain at least 35% of the property as green space.  The applicant has provided 30% green space.  Therefore he is seeking a 5% variance.
