ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, April 25, 2011 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of Philip L. Horstman, 7 Swaggertown Road, Glenville, NY 12302 for a Conditional Use Permit that will allow for the expansion of the existing Horstman Farm Market located on Ballston Road. The applicant is proposing to utilize a recently constructed open-sided structure for his seasonal farm stand. The structure is currently used for winter storage of his farm equipment. The property is located in a Suburban Residential Zoning District and is identified on tax map 30.10-1-27.1.
In accordance with the Codes of the Town of Glenville 270-126 Expansion of conditional use - Any expansion or alteration of a conditional use, whether it be the expansion or reconfiguration of the principal building, parking lot, driveways, accessory buildings, etc., is subject to the review procedures outlined in this article (Zoning Ordinance).
The farm stand is currently operating under a Conditional Use Permit. Therefore, a revision to the Conditional Use Permit is required for the proposed expansion.

The property is located in a Suburban Residential Zoning District and is identified on tax map 30.10-1-27.1.
In accordance with the Codes of the Town of Glenville 270-15 Roadside produce stands are permitted by Conditional Use but may not exceed 600 s/f in size.
A previous area variance was granted to allow a farm stand to be constructed up to 1,440 s/f in size. Therefore the applicant is requesting a new variance for an additional
1,962 s/f.
Application of Frank G. Herba, 1759 Union Street, Niskayuna, NY 12309 on behalf of the current property owner, Bruce Whatley, 5 Rolling Brook Dr., Clifton Park, NY 12065 for Three Area Variances that will allow for the construction of a new single family dwelling at vacant property located at 952 Sacandaga Road, Glenville, NY 12302. The applicant is proposing to construct the new home 40' from the southern lot line, 38' from the northern lot line and 71' from the front lot line. The property is located in a Rural Residential/Agricultural Zoning District and is identified on tax map 8.1-1-9.
In accordance with the Codes of the Town of Glenville 270 Attachment 1 - Minimum setback in the RRA zoning district:
The minimum side yard setback is 50'. Therefore the applicant is seeking two side lot line variances. One for the southern side of 10' and one for the northern side of 12'.
The minimum front yard setback is 75'. Therefore the applicant is seeking a front yard setback of 4'.
