ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, November 22, 2010 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of Shawn Enides, 424 Sacandaga Road, Glenville, NY 12302 for an Area Variance that will allow for a 6' high stockade fence in the front yard. The fence has already been installed on the property which is located at the corner of Vernon Blvd and Sacandaga Road. The property is located in a Suburban Residential Zoning District and is identified on tax map 29.11-4-75.
In accordance with the Codes of the Town of Glenville 270-52, B (2): Fences on residential properties will not exceed four feet in height in the front yard, including along side lot lines to the front of the front plane of the dwelling. Therefore, the applicant is seeking a variance of 2' in height for the fence.
Application of Timothy O'Brien, 3 Snyder Lane, Alplaus, NY 12008 for an Area Variance that will allow for the construction of an 11'8" x 22' carport located 12' 4" from the northerly side lot line. The property is located in a Suburban Residential Zoning District and is identified on tax map 23.18-3-7.2.
In accordance with the Codes of the Town of Glenville 270-Attachment 1, The minimum side yard setback shall be 15'. Therefore the applicant is seeking a side yard variance of 2' 8".
Application of John B. Ham, 167 Amsterdam Ave, Glenville, NY 12302 for an Area Variance that will allow for the construction of a new 22' x 26' attached garage 8' from the front property line of Prado Street. The existing carport will be demolished as part of this application. Said property is located at the corner of Amsterdam Ave and Prado Street in a Suburban Residential Zoning District and is identified on tax map 29.10-2-22.2.
In accordance with the Codes of the Town of Glenville 270-Attachment 1. The minimum front yard setback shall be 30'. Therefore the applicant is seeking a variance of 22'.
Application of Stewarts Shops Corp., PO Box435, Saratoga Springs, NY 12866 for a Conditional Use Permit for property located at 5246 Amsterdam Road, Glenville, NY 12302 that will allow for the construction of a 14' x 50' addition to the existing 2,400 s/f convenience store. Additionally, the underground fuel tanks will be replaced, the number of gasoline dispensers will be increased from two to three, a new and larger 20' x 73' canopy will is proposed and parking spaces will be increased. The applicant will be acquiring the 1.2 acre parcel immediately to the west in order to accommodate this expansion. The property is located on the north side of Amsterdam Road, directly across from the Rt. 103 Bridge to Rotterdam Junction, is located in a General Business Zoning District and
is identified on tax map: 13.-1-6.2.
In accordance with the Codes of the Town of Glenville, 270-19, D, 4: Gasoline service stations are permitted by Conditional Use Permit.
Application of Stewarts Shops Corp, PO Box 435, Saratoga Springs, NY 12866 for a Sign Variance that will allow for a new 15' tall pole sign to be located 2' from the front property line of 5246 Amsterdam Road, Glenville, NY 12302. The property is located in the General Business Zoning District and is identified on tax map 13.-1-6.2.
In accordance with the Codes of the Town of Glenville 270-134 C. 6. b. 10 - Setbacks. Freestanding monument or pylon signs shall have a minimum setback of 10 feet from the right of way line and 10 feet from the side property line and shall be located in a manner that does not interfere with required minimum sight distance at driveways and intersections.
