TOWN OF GLENVILLE
ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, June 28, 2010 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
APPLICATION OF RALPH RUGGIERO, 158 Sunnyside Road, Glenville, NY 12302 for an Area Variance that would allow for the construction of a 6' x 8' covered front porch 20' from the front lot line. Said property is located in the Suburban Residential Zoning District and is identified on tax map 39.6-1-11.
In accordance with the Codes of the Town of Glenville 270 Attachment 1: Dimensional Regulations: The minimum front yard setback in the Suburban Residential Zoning District is 30'. Therefore, the applicant is requesting a variance of 10'.
APPLICATION OF RICHARD D. FOSTER, 26 Ralmar Drive, Glenville, NY 12302 for an Area Variance that would allow for the construction of a 24' x 32' (768 s/f) detached garage and carport exceeding the allowable square footage. Said property is located in the Suburban Residential Zoning District and is identified on tax map 16.13-2-4.
In accordance with the Codes of the Town of Glenville 270-9: Accessory uses and structures, G (2): The maximum size for an accessory structure is 576 s/f. Therefore a variance of 192 s/f is requested.
APPLICATION OF JOHN & LINDA DIVINETZ, 691 Sacandaga Road, Glenville, NY 12302 for an Area Variance that would allow for the construction of a 24' x 34' (816 s/f) detached garage 5' from the southerly side lot line. Said property is located in the Rural Residential Zoning District and is identified on tax map 14.3-4-11.
In accordance with the Codes of the Town of Glenville 270-9: Accessory uses and structures, F. (2): all accessory structures 280 s/f to 1200 s/f in size must be located a minimum of 10 feet from side and rear property lines. Therefore, a side yard setback variance of 5 feet is requested.
APPLICATION OF HAMPTON RUN APARTMENTS, 20 Corporate Woods Blvd., Albany, NY 12211 for a Sign Variance that would allow for a 1' x 4' (4 s/f) addition to the existing 32 s/f monument sign at 14 Glenridge Road, Glenville, NY 12302. This sign addition would exceed the square footage allowed for apartment complexes. Said property is located in the General Business Zoning District and the Town Center Overlay District and is identified on tax map 22.11-4-20.
In accordance with the Codes of the Town of Glenville 270-69: Signs by Zoning District - A.(4)(a): Residential development identification signs will not exceed 32 s/f in size. Therefore, a sign variance of 4 s/f is requested.
APPLICATION OF FRANK AND PAT MAROTTA, 1 Budd Lane, East Greenbush, NY 12061 for Three (3) Conditional Use Permits for property owned by the Church of North Hills, PO Box 2037, Scotia, NY 12302. The vacant property is located on the north side of Mohawk Avenue just west of Cramer Ave and has recently been subdivided into three lots. The applicant proposes to construct on duplex dwellings on each of the three lots. Said property is located in a Suburban Residential Zoning District and is identified on tax map 29.19-3-1.1 (individual tax ID numbers have not been assigned yet)
In accordance with the Code of the Town of Glenville 270-15: Suburban Residential Zoning District. D (1). Two family dwellings are permitted by conditional use permit. Therefore, a conditional use permit is required for each of the three lots.
APPLICATION OF SIMON'S ROCK, INC., 147 Barrett St., Schenectady, NY 12305 for a Conditional Use Permit for property at 66 Freeman's Bridge Road, owned by Van Curler Greenhouses, 66 Freeman's Bridge Road, Glenville, NY 12302. The applicant is seeking to use an existing barn and outside space to operate a contractor's business/yard. Said property is located in a Research Development and Technology District and is identified on tax map 30.-1-3.
In accordance with the Codes of the Town of Glenville 270-20: RDT Zone, D (4). Contractor's offices, shops and yards are permitted by Conditional Use Permit. Therefore, a Conditional Use Permit is required to allow the use.
APPLICATION OF THOMAS PAI, 477 Dawson Road, Glenville, NY 12302 for Two Area Variances to allow for 2 new lots with less acreage than the minimum required for property located at 3 Snake Hill Road. Lot 1 is proposed as 1.44 acres and Lot 2 is proposed as 1.34 acres. This request pertains to a 4-lot subdivision request that was recently denied by the Planning & Zoning Commission. Said property is located at the northeast corner of Sacandaga Road and Snake Hill Road, is in the Rural Residential Zoning District and is identified on tax map 14. -3-41.1
In accordance with the Codes of the Town of Glenville 270-Attachment 1: the minimum lot size for new lots located in the Rural Residential Zoning District with water is 2 acres.
APPLICATION OF THOMAS PAI, 477 Dawson Road, Glenville, NY 12302 for Three Area Variances for his property at 126 Saratoga Road, Glenville, NY 12302 which would allow for the further expansion of his parking area. Said property is located in the Community Business Zoning District and is identified on tax map 22.15-2-52.212.
In accordance with the Code of the Town of Glenville 270-73, C, (3): Location of parking areas and spaces: All parking lots/areas associated with non-residential uses will be located no closer than 25 feet to any street right-of-way, nor closer than 10 feet to the rear or side property lines.
Variance request #1: To allow for an additional parking space in the rear of the property (identified as space #1) to be located 4 feet from the front lot line of Rude Chase Rd. Therefore, the applicant is requesting a variance of 21 feet.
Variance request #2: To allow for an additional parking space in the rear of the property (identified as space #13) to be located six feet from the side lot line and four spaces on the southeast side of the front building to be located 8' from the side lot line. Therefore, the applicant is requesting variances of 4 feet and 2 feet respectively.
In accordance with the Codes of the Town of Glenville 270-73, B, (2): Dimensions for off street parking spaces and aisles: Aisles for maneuvering within parking areas will be 24' for two directional flow traffic.
Variance request #3: To allow for an additional parking space in the rear of the property (identified as space #13) to be located 6' within the required maneuvering aisle and for four spaces on the southeast side of the front building to be located 4' within the required maneuvering aisle. Therefore, the applicant is requesting a variance to reduce the aisle from 24' to 18' in the rear and from 24' to 20' in the area adjacent to the front building.
