ZONING BOARD OF APPEALS



        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, May 24, 2010 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.


        APPLICATION OF DONNA AND ANTHONY GATULIK, 1298 Vley Road, Glenville, NY  12302 for an Area Variance that would allow for a 18' x 46' garage addition to the existing duplex dwelling unit  at 1300 Vley Road) a distance of 12' 6" from the northwesterly side lot line.  Said property is located in the Suburban Residential Zoning District and is identified on tax map 29.5-1-5.12.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1: Dimensional Regulations:  the minimum side yard setback in the Suburban Residential Zoning District for two-family dwellings without sewer is 20'.  Therefore, a variance of 7' 6" is requested.

        APPLICATION OF RODGER ANDERSON, 204 Spring Road, Glenville, NY  12302 for an Area Variance that would allow for an addition to the existing single family dwelling 10' from the northerly side lot line.  Said property is located in the Suburban Residential Zoning District and is identified on tax map 15.3-2-2.
        In accordance with the Codes of the Town of Glenville 270-Attachment 1: Dimensional Regulations:  the minimum side yard setback in the Suburban Residential Zoning District for single family dwellings without sewer is 15'.  Therefore, a variance of 5' is requested.

        APPLICATION OF EDWARD R. JACKSON, 399 Rector Road, Glenville, NY  12302 for Two (2) Area Variances that would allow for the construction of a 2,208 s/f detached accessory structure with an average height of 15' 4".  The proposed structure is 36' x 48' with a 10' x 48' open overhang.   Said property is located in the Rural Residential Zoning District and is identified on tax map 20.00-4-57.11.
        In accordance with the Codes of the Town of Glenville 270-9: Accessory Uses and Structures:
Variance #1:  D. Height. No accessory building or structure shall exceed 15 feet (average) in height in a residential zoning district.   Therefore, a variance of 4" is requested.
Variance #2:  F.  Accessory structures in the RA Zoning District.  The maximum square footage permitted is 1,200 s/f.  Therefore, a variance of 1,008 s/f is requested.

        APPLICATION OF GAIL CAMPBELL, 343 Closson Road, Glenville, NY  12302 for an Area Variance that would allow the placement of a 10' x 20' detached accessory structure (garage) located entirely within the front yard.  The structure is proposed to be located 41' from the front lot line and 15' from the westerly side lot line.  Said property is located in the Rural Residential and Agricultural Zoning District and is identified on tax map 14.3-3-3.1.
        In accordance with the Codes of the Town of Glenville 270-9: Accessory Uses and Structures.  C.: Location.  No permitted accessory use or building shall be located in any front yard.  Therefore, total relief from this section of the ordinance is requested.





        APPLICATION OF BFC HOME BUILDERS, LLC, 2435 Route 9, Malta, NY  12020 for Four (4) Area Variances for property located at 1116 Sacandaga Road.   The applicant is seeking the variances to allow for the construction of a new single family dwelling with a front setback of 31', rear setback of 20', southern side setback of 20' and a northern side setback of 20'.  The existing structure on the property would be demolished as part of this project.  Said property is located in a Rural Residential and Agricultural Zoning District and is identified on tax map 4.-1-1.
        In accordance with the Code of the Town of Glenville 270-Attachment 1: Dimensional Regulations: The minimum setbacks for a single family dwelling with public water are:
        Variance #1 (front yard setback):  75'.   Therefore, a variance of 44' is requested.
        Variance #2 (rear yard setback): 50'.  Therefore, a variance of 30' is requested.
        Variance #3 (southern side setback): 50'. Therefore, a variance of 30' is requested
        Variance #4 (northern side setback): 50'. Therefore, a variance of 30' is requested

        APPLICATION OF SIMON'S ROCK, INC., 147 Barrett St., Schenectady, NY 12305 for a Conditional Use Permit for property at 66 Freemans Bridge Road,  owned by Van Curler Greenhouses, 66 Freemans Bridge Road, Glenville, NY 12302.  The applicant is seeking to use an existing barn and outside space to operate a contractor's business/yard.  Said property is located in a Research Development and Technology District and is identified on tax map 30.-1-3.
        In accordance with the Codes of the Town of Glenville 270-20: RDT Zone, D (4). Contractor's offices, shops and yards are permitted by Conditional Use Permit.  Therefore, a Conditional Use Permit is required to allow the use.

        APPLICATION OF FRANK AND PAT MAROTTA, 1 Budd Lane, East Greenbush, NY  12061 for Three (3) Area Variances for property owned by the Church of North Hills, PO Box 2037, Scotia, NY  12302.  The vacant property is located on the north side of Mohawk Avenue just west of Cramer Ave.  The property also runs between Mohawk Avenue and Alexander Avenue making it a "thru- lot".  The applicant is seeking variances to allow for the creation of three new lots (and future construction of duplex dwellings) each with substandard lot width.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 29.19-3-1.1.
        In accordance with the Code of the Town of Glenville 270-Attachment 1: Dimensional Regulations: The minimum lot width for two family dwellings with public sewer is 120'
Variance #1 (Lot #1): 117'± along Mohawk Ave.  Therefore, a variance of 3' ± is requested.
Variance #2 (Lot #2): 102' ± along Alexander Ave.  Therefore, a variance of 18' ± is requested.
Variance #3 (Lot #3): 94' ± along Alexander Ave. Therefore, a variance of 26' ± is requested.

        APPLICATION OF FRANK AND PAT MAROTTA, 1 Budd Lane, East Greenbush, NY 12061 for Three (3) Conditional Use Permits for property owned by the Church of North Hills, PO Box 2037, Scotia, NY 12302.  The vacant property is located on the north side of Mohawk Avenue just west of Cramer Ave and has recently been subdivided into three lots.  The applicant proposes to construct on duplex dwellings on each of the three lots.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 29.19-3-1.1 (individual tax ID numbers have not been assigned yet)
        In accordance with the Code of the Town of Glenville 270-15: Suburban Residential Zoning District. D (1).  Two family dwellings are permitted by conditional use permit.  Therefore, a conditional use permit is required for each of the three lots.
