ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, July 27, 2009 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Public Hearing regarding the Draft Environmental Impact Statement (DEIS) that was prepared for the Use Variance application of Ralph & Jill Graziano for property located at Riverside Place, Alplaus, NY 12008. Said property is identified on tax map 31.5-1-40
Application of Michael Lamb, 2 Country Fair Lane, Glenville, NY 12302 for an Area Variance that will allow for the installation of a 6' high stockade fence in the front yard of Swaggertown Road. The proposed fence will setback a distance of 44' from the property line of Swaggertown Road. Said property is located in a Suburban Residential Zoning District and is identified on tax map 15.3-2-28.
In accordance with the Codes of the Town of Glenville 270-52 (B)(2) - the maximum height of a fence in any front yard shall be 4 feet.
Application of Timothy MacFarlane, 381 Washout Road, Glenville, NY 12302 for two Area Variances that will allow for the placement of a 12' x 21' detached open carport within 10' of the dwelling and the construction of a 10' x 24' attached open carport 15' from the side property line. Said property is located in the Rural Residential/Agricultural Zoning District and is identified on tax map 13.-1-39.
In accordance with the Codes of the Town of Glenville 270-3 - and Accessory building or structure must be located at least 10 feet from the principal building. And 270 Attachment 1 - the minimum side yard setback in the Rural Residential/Agricultural Zoning District is 50'.
Application of Stanley Lee, 130 Johnson Road, Glenville, NY 12302 for two Area Variances that will allow for the construction of a 24' x 30' detached garage with a 16' x 24' greenhouse attached to it. The proposed structure will have an average height of 19' 4". Said property is located in a Rural Residential/Agricultural Zoning District and is identified on tax map 13.-1-1
In accordance with the Codes of the Town of Glenville 270-9 (C) - No permitted accessory structure shall be located in any front yard. And 270-9 (D) - Accessory structures shall not exceed an average height of 15 '.
Application of Blase P. Iuliano, 217 Scotch Bush Road, Burnt Hills, NY 12027 for two Area Variances at 16 Berkley Road, Glenville, NY 12302 for lot width that will allow the applicant to proceed with a subdivision of this property into two lots. The lot with the existing house would have a frontage of 104.10' while the vacant lot would have frontage of 106'. Said property is located in a Suburban Residential Zoning District and is identified on tax map 22.6-5-37.
In accordance with the Codes of the Town of Glenville 270 Attachment 1 - the minimum lot width for properties in the Suburban Residential Zoning District without public sewer is 120'.
Application of Sealed Air Corp, Scotia Glenville Industrial Park, Bldg. 201, Glenville, NY 12302 for an Area Variance that will allow for the construction of a 60' 9" tall polyethylene pellet silo on an existing pad. The proposed silo would be in addition to 4 existing silos similar in height. Said property is located in the Research Development and Technology Zoning District and is identified on tax map 29.-3-16.41.
In accordance with the Codes of the Town of Glenville 270 Attachment 1 - the maximum height for a building in the RDT Zoning District is 50'.
Additional Item for consideration:
Request by Mr. & Mrs. Palmier, 1068 Sacandaga Road for a revision to their area variance approval to allow temporary storage units. The original approval was granted in July 2007.
