TOWN OF GLENVILLE
ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, August 25, 2008 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

        Application of Charlton Suburban Services, Ltd., 2211 Maple Avenue, Charlton, NY 12019 for a Conditional Use Permit that will allow for the expansion of the existing permitted sand and gravel mine from 10 acres to 16.5 acres at the Smith Sand Pit, 1648 North Road, Glenville, NY  12302.  The mine is located in a rural setting, west of North Road and south of Potter Road.  The entrance to the mine is located on the west side of North Road, approximately 1,700 feet north of West Glenville Road.  Said property is located in the Rural Residential/Agricultural zoning district and is identified on tax map 3.00-2-8.1.
        In accordance with the Codes of the Town of Glenville Section 270-47 (Mining and excavation) (A) Those mining operations that were active and operating under a valid NYSDEC permit at the time of the adoption of this chapter are allowed to expand subject to NYSDEC approval and a Conditional Use Permit from the Town of Glenville.

Application of Dale E. Leffler, 934 Washout Road, Glenville, NY  12302 for three Area Variances that will allow for the construction of a 48' x 30' detached garage.   Variances requested are to allow for a second garage and maximum of stalls, to exceed the 15' maximum height and to exceed 75% of the footprint of the dwelling.  Said property is located in a Rural Residential/Agricultural zoning district and is identified on tax map 13.00-3-5.
In accordance with the Codes of The Town of Glenville Sections 270-9 (A)(1) - Only one garage (attached or detached) is permitted per residential lot and it shall be limited to a maximum of three stalls, 270-9 (D) - No accessory building or structure shall exceed 15 feet in height in a residential zoning district and 270-9 (H) - The combined footprint of all accessory structures on a residentially developed lot shall not exceed 75% of the footprint of the dwelling.

Application of Karla Houst, 26 Marion Blvd, Glenville, NY  12302 for an Area Variance that will allow for a 10' 6" x 20' addition to the existing detached garage with a setback distance of 6' to the side lot line.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 29.15-1-10.
In accordance with the Codes of the Town of Glenville Section 270-9 (E) - Garages (both attached and detached) must be located at least 10 feet from the side and rear property lines.

Application of Robert Bergman, 5 Saratoga Drive, Glenville, NY 12302 for an Area Variance that will allow for the construction of an open porch and steps with a setback distance of 19' from the front property line at 156 Sunnyside Road, Glenville, NY 12302.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 39.6-1-10.
In accordance with the Codes of the Town of Glenville Section 270 Attachment 1 - the minimum front yard setback is 30'.  However Section 270-7 (G) (4) allows for projections of uncovered steps and porches to extend six feet into the required setback.  This would allow for a setback of the porch and steps to be 24' from the front lot line. The applicant proposes a 19' front setback which requires a 5' variance.

        Application of Thomas O'Bryan, 390 Saratoga Road, Glenville, NY  12302 for an Area Variance that will allow for a 20' x 20' deck connecting the house and garage and a series of three decks (16' x 20', 16' x 22' and 24' x 16') that will connect the garage to the above ground swimming pool.  Said property is located in a Professional Residential Zoning District and is identified on tax map 15.20-1-3.
        In accordance with the Codes of the Town of Glenville Section 270-9 (H) - The combined footprint of all accessory structures on a residentially developed lot shall not exceed 75% of the footprint of the dwelling.

        Application of Greno Industrial Supply, 2820 Amsterdam Road, Glenville, NY  12302 for a Use Variance that will allow for the construction of a 9,750 square foot addition to the rear of the existing structure for the purpose of materials storage. The parcel is located on the north side of Route 5, just a few hundred feet west of the intersection of Route 5 and Vley Road Extension, is located in the Community Business zoning district and is identified on tax map 20.20-1-2.
        In accordance with the Codes of the Town of Glenville Section 270-18: Community Business Zoning Districts do not permit manufacturing facilities.

        Application of Steven Junquera, 564 Sacandaga Road, Glenville, NY 12302 on behalf of Leanne Sweet, 9 Helping Hand Lane, Glenville, NY 12302 for a Use Variance that will allow for the establishment of a contractor's yard at 567 Sacandaga Road, Glenville, NY  12302.  The property in question is located on the west side of Sacandaga Road, approximately 250 south of Ridge Road, adjacent to Stewart's.  The property also has frontage on Ridge Road, just west of Stewart's.  The parcel is primarily zoned Suburban Residential, although the western/southwestern portion of the property is zoned Rural Residential/Agricultural and is identified on tax map 21.3-2-2.1
        In accordance with the Codes of the Town of Glenville Section 270-14: Rural Residential and Agricultural Districts do not permit contractor's yards.

        Application of Rick Dicresce, 178 Freemans Bridge Road, Glenville, NY  12302 for a Use Variance that will allow for the establishment of a used car sales business on property that is currently occupied by Enterpise Rent-A-Car.  This property is located on the east side of Freemans Bridge Road, across from Salisbury Chevrolet.  Said property is located in a General Business Zoning District and is identified on tax map 30.10-3-3.
        In accordance with the Codes of the Town of Glenville Section 270-19: General Business Zoning Districts do permit used car sales.

        Continuation of the Application of Anita Pietrzak, 11 Brierwood Court, Burnt Hills, NY 12027 for a sign variance at 562 Saratoga Road, Glenville, NY 12302.   The applicant has revised her original request from an additional pole sign to an 18" x 48" addition to the existing ground sign.  This application was originally heard at the May 2008 ZBA meeting.
