ZONING BOARD OF APPEALS
PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, May 21, 2007 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.
Application of Paul Mertzlufft, 14 Sparton Lane, Ballston Lake, NY 12019 for an Area Variance that will allow for the installation of stockade-type fence 6 feet in height in a front yard of a corner lot. The applicant is proposing 3 sections of 6 foot high fence to be installed in-between existing trees along Cloverleaf Drive. Said property is located in a Suburban Residential Zoning District and is identified on tax map: 9.19-2-33.
In accordance with the Town of Glenville Zoning Ordinance Article VIII §270-52 B.(2) Fences on residential properties will not exceed four feet in height in the front yard.
Application of Thomas R. Coppola, 67 Maple Ave., Glenville, NY 12302 for a Use Variance that will allow for the construction of an addition to an existing 28’ x 29’ dwelling which is considered a legally established non-conforming use. The proposed addition will be 63’ x 32’ in size. Said property is located in a Research/Development/Technology Zoning District and is identified on tax map 30.-1-6.12.
In accordance with the Town of Glenville Zoning Ordinance Article XV § 270-96: Nonconforming buildings and uses cannot be expanded or in any way enlarged. This also applies to buildings in which a portion of the building contains a nonconforming use. The nonconforming use portion of the building is not to be expanded.
Application of Pat Popolizio for a Conditional Use Permit that will allow for an already-built outdoor barbecue/cooking accessory structure in the front yard of the Water’s Edge Lighthouse Restaurant at 2 Freeman’s Bridge Road, Glenville, NY 12302. The structure is located 6 feet from the front lot line bordering the state owned public boat launch. Said property is located in a Riverfront Recreation/Commercial Zoning District and is identified on tax map 30.19-1-22.
In accordance with the Town of Glenville Zoning Ordinance Article V §270-23: Restaurants, excluding fast food restaurants are permitted by Conditional Use Permit.
Application of Pat Popolizio for an Area Variance that will allow for an already-built outdoor barbecue/cooking accessory structure in the front yard of the Water’s Edge Lighthouse Restaurant at 2 Freeman’s Bridge Road, Glenville, NY 12302. The structure is located 6 feet from the front lot line bordering the state owned public boat launch. Said property is located in a Riverfront Recreation/Commercial Zoning District and is identified on tax map 30.19-1-22.
In accordance with the Town of Glenville Zoning Ordinance Article III § 270-9 (C) No permitted accessory use or building shall be located in any front yard.
Application of Douglas Sandmann, DDS for a sign variance to allow for an already installed new sign face to a non-conforming sign at 493 Saratoga Road, Glenville, NY 12302. The new sign face is made of plastic and the sign is internally illuminated. Said property is located in a Professional Residential Zoning District and is identified on tax map: 15.12-2-4.
In accordance with the Town of Glenville Zoning Ordinance Article XVII § 270-134: C. 6.b – At any time that there is a new sign or modification or a replacement of an existing sign the followings standards shall apply: § 270-134 C.6.b (3) Plastic, aluminum and other metal-type materials are only permitted in the sign frame and/or the light housing. And § 270-134 C.6.b (6) Sign lighting should minimize glare and maintain the aesthetic character of the area. Therefore, signs may not be internally lit, but raised lettering signs may be backlit. All other signs shall be externally lit.
Application of Linda Cochrane, 622 Rector Road, Glenville, NY 12302 for an Area Variance that will allow for the construction of a second garage on the property. The proposed garage will be 28’ x 28’ two stall detached garage located 25 feet from the side lot line. Said property is located in a Rural Residential Zoning District and is identified on tax map
20.-4-15.111.
In accordance with the Town of Glenville Zoning Ordinance Article III § 270-9 A.(1): Only one garage (attached or detached) is permitted per residential lot and it shall be limited to a maximum of three stalls.
