ZONING BOARD OF APPEALS


        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, April 23, 2007 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

        Application of M & B Builders, 116 North Holmes Street, Scotia, NY 12302 on behalf of Wayne Reedy for an Area Variance at 626 Orlinda Ave., Glenville, NY 12302.  The applicant proposes to demolish an existing detached garage and construct a new 24’ x 24’ detached garage 3 feet from the rear property line.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.11-2-52.
        In accordance with the Town of Glenville Zoning Ordinance Article 3.F.5 – detached garages must be located at least 10 feet from the side and rear property line.


        Application of Ben Iwinski, 401 Vley Road, Glenville, NY 12302 for Area Variances that will allow for the construction of a new 24’ x 36’ detached garage.  Construction of the new garage would be in addition to an existing 480 s/f detached garage and would exceed the maximum allowance of total square footage for accessory structures by 594 s/f.  Upon completion of the new garage the applicant proposes to demolish the 480 s/f garage.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 29.11-4-38.1.
        In accordance with the Town of Glenville Zoning Ordinance Article 3.F.1.a – only one garage (attached or detached) is permitted per residential lot.  And Article 3.F.8 – The combined footprint of all accessory structures on a residentially developed lot shall not exceed 75% of the footprint of the dwelling.


        Application of Ron & Robyn Hutchins, 728 Church Road, Glenville, NY  12302 for an Area Variance that will allow the applicant to pursue a building permit application for an existing 30’ x 90’ accessory structure/garage that exceeds the allowed maximum allowance of total square footage for accessory structures by 1,356 s/f.  Said property is located in Rural Residential/Agricultural Zoning District and is identified on tax map 14.-2-40.
        In accordance with the Town of Glenville Zoning Ordinance Article 3.F.8 – The combined footprint of all accessory structures on a residentially developed lot shall not exceed 75% of the footprint of the dwelling.


        Application of Jason & Christina Wood, 605 Riverside Ave., Glenville, NY 12302 for an Area Variance that will allow for the construction of a new attached garage and addition 8 feet from the side property line.  The proposal includes demolition of the existing attached garage.  Said property is located in a Suburban Residential Zoning District and is identified on tax map 38.7-5-61.
        In accordance with the Town of Glenville Zoning Ordinance Article 5.B.5 – the minimum side yard setback is 15 feet.
        Application of Christopher & Amy Godlewski, 711 Glen Ave., Glenville, NY 12302 for an Area Variance that will allow for the installation of a 5 foot high chain link fence in a front yard.  The property is a corner lot located on Glen Ave. and McMichael Dr. and therefore has two front yards.  The applicants propose to install the fence 35 feet from the front lot line of McMichael Drive.   Said property is located in a Suburban Residential Zoning District and is identified on tax map  38.7-1-15
        In accordance with the Town of Glenville Zoning Ordinance Article 8.I.2.b – Fences on residential properties will not exceed 4 feet in height in the front yard.

        Application of Colin Development, 1520Northern Blvd., Manhasset, NY 11030 for Area Variances that will allow for the development and construction of a Hess Express convenience store and gas station at 123 Freeman’s Bridge Road (intersection of Freeman’s Bridge and Dutch Meadows Roads).  The applicant is seeking a variance to construct the Hess Express building 15 feet from a front property line instead of the required 35 feet.  Said property is located in a General Business Zoning District and identified on tax map
30.14-2-5;  30.14-2-6;  30.14-2-7.1;  and 30.14-2-7.2 (lots to be combined)
        In accordance with the Town of Glenville Zoning Ordinance Article 5.F.4 – the minimum front yard setback is 35 feet.

       In accordance with the Town of Glenville Zoning Ordinance Article 5.F.3 – gasoline service stations are permitted by Conditional Use Permit
