TOWN OF GLENVILLE
ZONING BOARD OF APPEALS

        PLEASE TAKE NOTICE that the Zoning Board of Appeals will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY 12302-4518 on Monday, March 26, 2007 at 7 p.m. to hear all persons interested in the following applications as provided for by the Zoning Ordinance of the Town of Glenville.

Application of Robert Mortensen, 2792 Ridge Road, Glenville, NY  12302 for Area Variances that will permit for the construction of two 8-unit apartment buildings on NYS Route 5 (Amsterdam Road) immediately adjacent to the west of 1163 Amsterdam Road.  The applicant is also proposing to construct two detached garage units in front of the apartment buildings.  Said property is 2.8 acres in size, located in a Multi-Family Zoning District and is identified on tax map 29.-4-36.1
In accordance with the Town of Glenville Zoning Ordinance Article 5.C.4 – the minimum lot size for multi-family dwellings is 3 acres.  And Article 3.F.3 – no permitted accessory use or building shall be located in any front yard.

Application of Tim Coppola, 2 Cherry Lane, Glenville, NY  12302 for an Area Variances that will allow for the construction of  a new 14,400 s/f warehouse/office building at the intersection of Business Blvd., Capital Blvd., and Progress Parkway in Corporations Park.  Said property is located in the Research Development and Technology Zoning District and is identified on tax map 29.-3-8.1.
        In accordance with the Town of Glenville Zoning Ordinance
·       Article 19.C.2(a) – All non-residential uses will retain al least 35 percent of the property as green space.  The applicant is proposing 33.6 percent green space.
·       Article 10.A.3.(c) and (d) – All parking lots/areas associated with non-residential uses and multi-family uses will be located no closer than 25 feet from any street right-of-way, nor closer than 10 feet from the rear or side property lines.  Additionally, only green space and vegetation will be permitted within the 25 foot setback between the parking lot and the street right-of-way.  The applicant is proposing 10’ and 15’ setbacks for parking on the three front yards.
·       Article 3.F.3 – No permitted accessory use or building shall be located in any front yard.  The applicant is proposing to locate an enclosed dumpster, a permitted accessory structure/use, in the front yard of Capital Blvd.

Application of Tim Coppola, 2 Cherry Lane, Glenville, NY  12302 for a Conditional Use Permit that will allow for the construction of  a new 14,400 s/f warehouse/office building at the intersection of Business Blvd., Capital Blvd., and Progress Parkway in Corporations Park.  Said property is located in the Research Development and Technology Zoning District and is identified on tax map 29.-3-8.1.
        In accordance with the Town of Glenville Zoning Ordinance Article 5.G. 3 – Contractors offices, shops and yards are permitted in the RDT Zoning District with Conditional Use Permit Approval.
