Chairman Carr announced the Michael Cellini Site Plan Review application, formerly Item #2 on the agenda, has been removed.  An appeal by a neighbor has been filed with the Zoning Board of Appeals, which objects to an interpretation made by the Building Inspector that allowed this application to come forward.  Until the ZBA makes a determination, Town Law requires a stay of proceedings and no action can be taken.  This appeal will be heard this month at the June 22nd ZBA meeting.

2.  Town of Glenville                                                      Zoning Map Amendment
    Vicinity of Freemans Bridge Road   Recommendation to the Town Board


The Town of Glenville is proposing the rezoning of approximately 130 acres from “Research/
Development/Technology” to “General Business.”  The area under consideration for rezoning is generally bound by the Pan Am Southern Rail Line to the north, the Kromme Kill to the south, the Town of Glenville/Village of Scotia municipal border to the west, and the Lowe’s and Reserve at Glenville properties to the east.

Approximately 120 acres of the area to be rezoned is owned by Piotrowski, with the remaining 10+ acres being owned by the Town of Glenville and the Pan Am Southern Railroad.  

M. Carr stated that this is potentially ‘down zoning’ the property.  The current Research/Development/Technology classification allows larger projects that could impact the environment.  Rezoning the property to General Business allows lesser intensity of use.

T. Bodden asked if this property is within the footprint of the Freemans Bridge Road Master Plan, which was adopted about ten years ago.  K. Corcoran affirmed it is.  T. Bodden asked if this proposal is inconsistent with that plan and K. Corcoran answered, “Partly.”  He said half of the property is consistent, and the western half is not.  The Town Board is considering this because a new master plan is being crafted and because of the potential impacts of the new casino planned for Schenectady.

P. Huff asked if the former Lyons’ property is included.  This is the brownfield area which was recently changed from a Class 2 to a Class 4 Inactive Hazardous Waste Site.  It was determined this property is not part of the 130 acres slated for rezoning.

T. Bodden asked how far the rail line is from Sunnyside Road (Suburban Residential Zone).  It is approximately 1/3 mile, which would prohibit a negative impact on the residents of Sunnyside Road.  He sees less intensity of the property use, but likely more density.  

The Town property involved was identified as the “L-shaped” or arrowhead shape property to the north.  It is only accessed by Lowe’s Road.  J. Gibney asked if traffic reports were done at the time of the Freemans Bridge Road Master Plan in 2004, and K. Corcoran said they were.  The plan still indicates a paper street connecting Lowe’s Road and Sunnyside Road.

MOTION

In the matter of the zoning map amendment application by the Town of Glenville, to be located in the vicinity of Freemans Bridge Road, at properties identified per the application, the Planning and Zoning Commission recommends that the Town Board approve.

Reasons supporting recommendation:      
  • Changing zoning from RDT to General Business allows for a less intense use of the property.
  • The proposed change is compatible with surrounding properties.
  • It is consistent with anticipated development.

Chairman Carr announced the resignation of Javier Tapia from the Commission, and wished him well in his new position out of state.

With no additional items on the agenda, the meeting was adjourned at 7:30 p.m.

The next meeting of the Town of Glenville Planning and Zoning Commission is to be held on Monday, July 13th, 2015.  The agenda meeting will be held Monday, July 6, 2015.
