DMPM Property Management Site Plan Review 108 Freemans Bridge Road (Preliminary) This proposal calls for construction of a 7,000 sq. ft. retail building on a vacant acre property, located on the east side of Freemans Bridge Road, just south of the railroad tracks. Area variances will be required for the proposed parking lot encroaching into buffer areas and side yard setbacks, as well as minimum green space. This property is zoned General Business. Engineer Eric Holt and Dan Maggs, property owner, were present to address the Commission. Mr. Maggs said he wanted to expand his business and make use of the property. He is proposing a 7,000 sq. ft. building which he may use for his current business, Freemans Bridge Road Wine & Liquor. The property has also been for sale and he is trying to create some options for the future of his enterprise. E. Holt stated the plan includes a retention basin to deal with the runoff from the building. The parking lot will be porous pavement or use an under-drainage system, dependent upon conditions found prior to construction. Parking space is planned to be 14,500 sq. ft. which is 27 parking spaces and green space is now 9,000 sq. ft., which is 30% of the property. There will be lighting on the building, shining towards the parking lot for security. One monument sign is proposed and three trees will be planted along the front property line. Landscaping includes plantings Planning & Zoning Commission Minutes September 9, 2013 Page 2 around the sign, and a vegetative screen/buffer along the Mastroianni property line. Mr. Holt also stated that the gas and sewer access is on the same side of the road as the property, and municipal water is across the road, as is a hydrant. The required curb cut was discussed. D. Maggs stated he had applied for one several years ago, but that permit has expired. He will re-apply to NYS DOT for a permanent permit, which is good for one year, closer to construction time. He does not anticipate any delays with this. E. Holt stated that there was a question of property contamination and a contingency plan for any contamination discovered. Mr. Holt has a copy of the on-going DEC investigation which shows a (TCE) plume across the road. The plume and contaminated area by-passes the 108 Freemans Bridge Road site. Mr. Maggs also said DEC did shallow and deep well testing on his property in the northwest corner. This was followed by EPA testing, with the same results. Chris ONeill, NYS DEC, advised Mr. Maggs to handle any contamination discovered as a spill, and to report it immediately to the State. M. Carr then referred to a memo prepared by Planner I Michael Burns, sent to Dan Maggs on August 1, 2013. He reiterated items to be addressed, including variances for building setbacks, parking setbacks, and green space, potential fencing, adequate parking, loading zone (which is now shown on the plan), lighting, stormwater management (E. Holt stated this has been provided to M. Burns and the basin will handle 100% of a 100-year storm event), grading plan needs to be shown on the site plan, and signage, elevations and renderings need to be provided. This memo is attached and made part of these minutes. K. Semon said the applicant may want to fence the detention pond (basin). The railroad right-of-way was discussed and does not appear to be an issue; any requirements would be addressed by NYS DOT. Mr. Maggs said the variance applications were submitted today, September 9th. MOTION In the matter of the preliminary site plan review application by DMPM Property Management for a 7,000 sq. ft. retail building located at 108 Freemans Bridge Road, the Planning and Zoning Commission finds that this application will not result in a significant potential adverse environmental impact. Town of Glenville and FEMA Code Amendment Recommendation to the Town Board The Federal Emergency Management Agency (FEMA) recently re-evaluated flood hazards within the Town of Glenville, and throughout the nation. FEMAs efforts have resulted in revised 100-year and 500-year base flood elevations for the Town. As a condition of continued participation in the National Flood Insurance Program (NFIP), Glenville must adopt the new Flood Insurance Study and FIRM maps by amending our Flood Damage Prevention Local Law (Chapter 151 of the Town Code). Building Inspector Paul Borisenko addressed the Commission regarding this code amendment. He explained this amendment would update current law and map numbers. If Glenville wants to be part of the flood insurance program, this amendment must be adopted. Previous floodplain mapping was somewhat crude and inaccurate. Lidar mapping (LIght Detection And Ranging) has allowed this new technology to define the flood plain lines. About 400 property owners were notified of the changes, and there were no challenges to the mapping. There are significant changes on Freemans Bridge Road, up to Maple Avenue. Planning & Zoning Commission Minutes September 9, 2013 Page 4 Flood insurance is required in floodplain areas if the homeowner has a mortgage. If the Town does not participate in the program, no one could get a mortgage in those areas. M. Storti said the floodplain maps will be available on the Schenectady Internet Mapping system (SIMS and SIMS LITE) within a few days. Retail Building Below are comments & questions generated from my preliminary review of a conceptual site plan for 108 Freemans Bridge Road which contains a new 7,000 sq. ft. retail structure, parking layout and proposed stormwater management area. Please note these comments are not prioritized. If you wish to sit down and discuss these item by item, I am available to do so at your convenience, just give me a call. Zoning District: 108 Freemans Bridge Road is zoned General Business. Retail businesses are permitted uses by site plan review. Building Setbacks: Setback requirements for the General Business zoning district are - Front yard: 35 ft., Side yard: 30 ft., Rear yard: 40 ft. Setbacks shown on the conceptual plan are inaccurate. Area variance(s) may be required. Further detail is needed to ascertain specifically what area variances are needed. Parking Setbacks: Parking areas are not to be located closer than 10 ft. to the side and rear property lines. It appears area variances will be required for encroachment into the required side and rear yards. Specific area variances will be determined upon submittal of the actual site plan. Required Greenspace: Greenspace required is 35% for non-residential uses. As depicted, greenspace is deficient (29%) and an area variance would be required. Landscaping Plan: A landscaping plan is required per Section 270-139 of the Towns Zoning Ordinance. Some highlights: one street tree is required per 30 feet of road frontage. A twenty-five (25) ft. green space is required between the street right-of-way and the parking lot. Fencing: No fencing is shown on the conceptual site plan. If fencing is being considered, the location and a typical construction detail must be added to the site plan. Vehicular Parking: Parking requirements for general retail are: minimum - 1 space per 350 sq. ft. gross floor area (gfa) and maximum - 1 space per 200 sq. ft. gfa. Therefore, for the estimated 7,000 sq. ft. gfa building, maximum number of parking spaces would be 35 spaces and minimum would be 20 spaces. Twenty-eight (28) spaces are shown on the conceptual plan, which is adequate. Loading Zone: It is unclear if or where a building loading zone would be located. If at the north side (railroad tracks), access to the loading zone needs to be shown on the site plan and this may interfere with the proposed stormwater management area and further reduce required green space. Lighting: On-site and building lighting locations should be shown on the site plan. All lighting fixtures should be direct downward and not project onto adjacent properties or upward to interfere with approaching aircraft. Stormwater Management: Less than one acre land disturbance is proposed (lot size is 30,504 sq. ft.). A Basic Erosion and Sedimentation Control Plan is required with locations of best management practices and typical details shown on the site plan. The town my wish to have the Basic Erosion and Sedimentation Control Plan reviewed by the Towns designated engineer (TDE) at the owners expense. Stormwater calculations must be provided to ensure the stormwater retention area is adequately sized. Grading and typical details should be added to the site plan to show the type of stormwater retention structure that is to be constructed. A grading plan is required for the entire site. Signage: The location of the proposed sign is shown on the site plan. However, a typical detail should be added to show sign design and if additional signs are to be located on the building facade. A sign permit will be required. Architectural Design: Renderings of the buildings sides, visible from public areas, should be provided. Water & Sanitary Sewerage Disposal: Proposed locations of water and sanitary sewer line connections should be shown on the site plan along with typical construction details. Please consult the Town of Glenville Water & Sewer department for utility connection locations and specific construction details. Will the propose building contain a sprinkler system? Will a fire hydrant be located on-site? If so, the location(s) should be reviewed by the Thomas Corners Fire Department. Pedestrian Connections: An area for a future sidewalk, along Freemans Bridge Road, should be shown on the site plan, preferably within the Freemans Bridge Road right-of-way. Consideration should be given to on-site benches, bike racks, etc. for pedestrians visiting the stores within the building. Site Access: The proposed driveway onto Freemans Bridge road will require a New York State Department of Transportation (NYSDOT) highway access permit and a work permit. Furthermore, consultation should begin ASAP with NYSDOT to identify any concerns with the driveway location and its proximity to the existing Freemans Bridge Road railroad crossing.
