Mohawk Honda Site Plan Review - Final 175 Freemans Bridge Road (Public Hearing) Mohawk Honda is seeking approval to expand their parking area to accommodate their inventory. Additional landscaping and storm water management facilities are also proposed. The property is zoned General Business. Preliminary site plan approval was issued for this project on July 8, 2013. Mike Hale, Enviroscapes by Design, was present to address the Commission. Kurt Bedore, KB Engineering & Consulting was also present for any questions the Commission might have. Mr. Hale said the requested Conditional Use Permit was granted by the Zoning Board of Appeals. He stated the plan shows double spaces to create parking rows, and the existing lighting scheme will be continued but with LED lights installed. Bio-retention basins in the islands will control the stormwater, and empty into the existing basins. More shrub-type plantings will be added on the islands. There will be 69 parking spaces created, but a net number is 67 spaces due to the placement of the landscape islands. Since demolition of previous buildings, the area has been graded, prepped, and seeded; it is not paved yet. M. Carr reminded Mr. Hale that no parking is allowed on the grass areas. Mr. Hale will pass this stipulation along to the applicants and stated the applicants are aware of this requirement. With the Commission having no other issues, the hearing was then opened to the public. With no one wishing to speak, the hearing was closed. It was noted that there are no objections by any other agencies. MOTION In the matter of the final site plan review application by Mohawk Honda for the expansion of their parking area located at 175 Freemans Bridge Road, the Planning and Zoning Commission hereby approves the application. The Commissions decision is based upon the following findings: 1. The proposed use does conform to other applicable provisions of the Zoning Ordinance, including, but not limited to, landscaping requirements, building design, off-street parking requirements, building setbacks, fence requirements, sign regulations, storm water management and erosion control requirements, etc. 2. The proposed use does exhibit adequate and logical vehicular access and circulation, including intersections, road widths, curbing, and traffic controls. 3. Mohawk Honda Site Plan Review 175 Freemans Bridge Road (Preliminary) and Conditional Use Permit This proposal calls for the construction of a 5,100 sq. ft. addition to Mohawk Hondas automotive sales facility. The addition would be used for auto detailing, washing, and repair. The addition would be located on the east side of the existing building. Planning & Zoning Commission Meeting Minutes November 18, 2013 Page 3 Michael Hale, Enviroscapes by Design, again represented the applicant. He stated that the plan calls for one wash bay for in-house purposes and detailing and service bays. There will be one construction entrance at the southeast corner of the parcel. The building is 175 x 30. There will be improved roof drainage which did have some problems with ice and water in the past. As a result, internal drainage has been included, which will eventually drain into the existing stormwater system. When Chairman Carr asked if there would be signs on the building, Mr. Hale said they have not been mentioned, just bay doors. Mr. Bedore provided an elevation drawing that shows no signage. The colors will match the rest of the buildings. M. Hale then addressed the carwash bay. It is a highly efficient system which does not use much more water than is currently being used. The discharge is pretreated, settles out in a settling tank, and drains as necessary into the sewer system. Chairman Carr stated it is necessary that the applicant understand that no parking is allowed on any grassy areas, and the applicant must agree to comply. Mr. Hale stated that the applicants agree to this. Chairman Carr then read an e-mail received by the Planning Department from the neighboring property owner, Donna Plush, 438 Ballston Road, as follows: Mr. Corcoran, I live next door to Honda Motors. I am very concerned about the fumes from the auto detailing they have applied for. Elmos used to be there, and there were days we were not able to be outside due to the fumes of paint. I do not want that again. Please address this. Also, a car wash? Where will all the water go, our water table is high enough. M. Carr said the water has been addressed; there will be no net increase of water into the subsurface during the washing of cars. M. Hale said the detailing or repainting is done on repairs, and is not full scale painting. It is his understanding that some detail bays may be repositioned; if so, there will still be only a one or two bay increase. M. Carr stated that if there are issues with fumes, the applicant must address them. K. Bedore added that there would be necessary compliance with State regulations. DMPM Property Management Site Plan Review - Final 108 Freemans Bridge Road (Public Hearing) The applicant is seeking approval to construct a 6,120 sq. ft. retail building on a acre parcel. Preliminary site plan approval was issued for a 7,000 sq. ft. building, so the latest plan includes a smaller building and more green space. The property is located on the east side of Freemans Bridge Road, just south of the railroad tracks. The zoning for the property is General Business. Eric Holt was present to address the Commission. He provided copies of an e-mail from Michael J. Keegan, New York Department of Transportation, dated November 14, 2013, which states: To Whom It May Concern; I have reviewed the preliminary plan for the property located at 108 Freemans Bridge Road. I am granting conceptual approval based on the design and construction of the entrance to NYSDOT standards and specification. This approval is conceptual and will require that the property owner apply for a driveway permit prior to construction. E. Holt said the applicant has appeared before the Zoning Board of Appeals and was issued the requested variances. There is now added green space on the east side of the parcel, the building size has been reduced, and the total green space of the lot has increased to 37%. Mr. Holt has been working with Joel Bianchi, MJ Engineering, regarding responses to Mr. Bianchis review of the project stormwater plans. Dan Maggs, the property owner, has been discussing the curb cuts with DOT, and will apply for permits in the spring when paving can begin. M. Carr noted that as of the November agenda meeting, the Commission was waiting on the stormwater report. Per the letter from MJ Engineering to the Planning Department, dated November 8, 2013, the plans need to incorporate a standard construction detail/specification showing materials of construction, depths of material, aggregate design mix, load bearing and construction guidelines, additional detailing for the proposed stormwater retention facility, and location, along with a detail or description of the materials of construction, for the perimeter trench drain that will be installed as a back-up system in the event of clogging of the porous pavement. Planning & Zoning Commission Meeting Minutes November 18, 2013 Page 6 Mr. Holt stated these issues have been addressed with Mr. Bianchi. Chairman Carr then entered a letter received November 18, 2013 from James and Patricia Mastroianni, 104 Freemans Bridge Road, into the record, which is attached and made part of these minutes. For clarification, it is noted the letter is addressed to the Zoning Board of Appeals, which has already acted on requested variances. Addressing several issues in the letter, Mr. Holt said the largest vehicles on the property would be beverage delivery trucks. The sight distance from the proposed new curb cut is 600 in either direction. K. Semon asked about the porous pavement. E. Holt said the plan is to use porous pavement throughout and an Inspection Maintenance Plan (IMP) has been submitted. The entire paved area will sheet drain to the south. M. Carr asked if there will be a negative impact to the neighbor to the east, and E. Holt said there would not be and added that the percolation rate is less than one minute, as the soils located there are so good. Roof drainage/gutter waste will also be directed to the other side of the building. The system was designed per 100-year flood event criteria. K. Semon asked why the south corner, near the road, is designated for snow storage. E. Holt stated he did not anticipate a lot of snow being pushed there; if there is an excess, it would be hauled away by truck. J. Gibney stated that the biggest issue in this application is stormwater, and this has been addressed satisfactorily. Chairman Carr then opened the public hearing. MOTION In the matter of the final site plan review application by DMPM Property Management, for the construction of a 6, 120 sq. ft. retail building located at 108 Freemans Bridge Road, the Planning and Zoning Commission hereby approves the application. Mark Klos for Vintage Automotive Services Site Plan Review 4 Sarnowski Drive (Preliminary) and Conditional Use Permit The applicant is requesting to establish an automotive repair business in the existing 4,224 sq. ft. building located across from TrustCo Bank and immediately west of (behind) Pet Lodge/Checkerhill Farms. The property is zoned Research/Development/Technology. M. Klos was present to answer any questions the Commission may have. He said he plans to use two-thirds of the vacant building that he is leasing for antique and classic car repair. He takes the cars apart, and puts them back together. Mr. Klos said there is no painting done at his business; it is strictly repairs. There are not bay drains in the building; it is a sealed floor. There is one lift in place now. Water is hard piped in from Venbro, located next door to this building. The building has no sanitary facility; the tenant will use the facility in the bike shop next door, which is approximately 500 away. A letter has been submitted stating the bike shop is allowing this use. There is no sign as of yet on the building. Mr. Klos will apply for one after obtaining required approvals. K. Semon noted the list of chemicals used and /or stored on the site indicated on the Conditional Use Permit Application as: lubrication and hydraulic oils stored in drums to be recycled, cleaning solvents used in parts washer stored in washer and sent to recycling, anti-freeze stored in drums and recycling machine. He asked if this is a temporary containment system. Mr. Klos said when the containers are brought in the building they will be within another container in the event of spills. Brake fluid, anti-freeze, and transmission fluid are examples of what is stored, and they are 16-gallon and 5-gallon drum sizes. Total combined capacity will not exceed 1,100 gallons of storage. When asked, M. Klos said he could put four vehicles comfortably in the bays. No engines or parts will be stored outside. Carr asked the applicant to obtain a letter from the local fire department approving the fire suppression plan. It was noted that the Glenville Environmental Conservation Commission, as SEQRA lead agency, issued a negative declaration provided that no automobiles with fluids will be stored on the outside of the building on any unpaved surfaces. The project site is located on the east side of Freemans Bridge Road, opposite Precision Glass & Aluminum, approximately mile north of Auto Solutions principal property. The property is zoned General Business. Dan Morelli and the applicants were present to address the Commission. Mr. Morelli stated the driveway and building are both existing, and would be used for detailing cars. They would be washed at the car wash on Freemans Bridge Road (Raindancer Car Wash), then waxed and detailed at 120 Freemans Bridge Road. Morelli said there are no floor drains in the building and the floor is concrete. There will be no washing of autos done in this building. No chemical solvents or hazardous materials will be used or stored in the building. Mr. Morelli said two vehicles at a time can be detailed in the building. The property to the rear is vacant and he anticipates no vehicles to be parked there. Two existing spaces are paved and part of the driveway. The maximum number of vehicles including parking and detailing is five automobiles. Employee parking is not needed. M. Carr asked about sanitary facilities and was told there is a bathroom which is functioning and is connected to an existing septic system. Dana Gilgore noted in case of septic system failure, the town cannot legally issue a permit for repairs or replacement of the septic system when public sewers are available. Mr. Morelli stated that if the system needed to be upgraded or repaired, the applicant would do so; that is not a problem. J. Gibney asked about the area in front of the building. D. Morelli said there is a 37 x 30 paved area directly in front of the building and rest is overgrown at this time. The plan is to clear this overgrown area out and replace it with gravel. M. Carr asked if the building is structurally sound. Mr. Morelli said it is sound, is cement block, the roof has been replaced and the heating system has been replaced. The looks of the building will be improved once the overhead doors are installed. There will be exterior lights on the building, and probably a sign. Fire suppression is by extinguishers. M. Carr asked if the Quonset hut is on this property. Mr. Schaeffer said that is a separate parcel, which he also owns. The vehicles parked there are construction trailers for his business. The house on that property is not being used at this time, but maybe used in the future. The property is located on the south side of NYS Route 5, just west of Mariaville Fence. No new construction or additions are proposed. The front/northernmost 20+% of the property is zoned Highway Commercial, with the rear 80% being zoned Riverfront Recreation/Commercial. Mrs. Kalinowski stated one permitted event has been held on the property so far, a craft fair and antique show. She is looking to hold parties, weddings, receptions, and other recreation activities on the site. She may have car shows, athletic events, and whatever patrons are looking for. She said it is fenced in front, which allows her to control the traffic. No alcohol is allowed on the site, and no access to the building would be allowed. Port-a-johns would be brought in for the public. M. Carr read from a memo prepared by Planner Mike Burns noted below: facilities that promote the use of motorized vehicles meant to propel riders or passengers for recreational purposes (i.e., go-karts, motorcycles, snowmobiles, all-terrain vehicles, etc.) are not permitted within the Riverfront Recreation/Commercial District. The applicant proposes to rent the property for events such as antique and flea markets, pow-wows, swap meets, festivals, exhibitions, sports events, car & bike shows, weddings and receptions, private parties, primitive camping in conjunction with an event, fund raising, etc. It should be noted, that any event which is likely to attract 2000 persons or more shall be subject to the provisions governing Mass Gatherings. The owner shall apply for and secure a Mass Gatherings permit from the Town Clerks Office. T. Bodden asked about parking. C. Kalinowski said there are 12-acres for parking, and she agrees to keep driveways open for emergency vehicles. Building Inspector Paul Borisenko stated a designated parking area and circulation plan should be shown on the plan. C. Kalinowski said the wells on the premises are not used as they are not potable. The applicant is requesting that he be allowed to file the map now, with the deadline for filing having expired on March 15, 2010.
