The property is located on the south side of NYS Route 5, just west of Mariaville Fence. No new construction or additions are proposed. The front/northernmost 20+% of the property is zoned Highway Commercial, with the rear 80% being zoned Riverfront Recreation/Commercial. 8. Christopher Maddalone Request to extend the Woodruff Drive and Judy Drive filing deadline for the Park Ridge Estates subdivision The eight-lot Park Ridge Estates subdivision was issued final approval in January, 2010. However, the final approved map was never filed since the applicant was delayed in getting financing for the infrastructure work. The applicant is requesting that he be allowed to file the map now, with the deadline for filing having expired on March 15, 2010. 2. Betts Two-family Dwelling Conditional Use Permit Vley Road Recommendation to the ZBA A Conditional Use Permit is required for the construction of a two-family dwelling proposed for a .51 acre vacant lot off Vley Road. The property is located between lots number 469 and 511 Vley Road, near the west side of the Sacandaga Road overpass. Access to the property is from an existing curb cut on Vley Road. Public water, natural gas and electric utilities are located at the street. An on-site wastewater disposal system is planned. The property is zoned Suburban Residential. Richard Betts, property owner, addressed the Commission. He explained his father owned the property since 1985, which is located east of Williams Avenue. He now owns it and would like to construct a ranch-style duplex on it. The duplex would have two bedrooms per unit, with the total square footage of 1975 sq. ft. Mr. Betts said years ago there was a structure on the property. Environmental Design Partnership is engineering the project. M. Carr stated the Commission has no issues with this application. Planning & Zoning Commission Meeting Minutes October 14, 2013 Page 2 MOTION In the matter of the Conditional Use Permit application by Richard Betts to construct a two-family residence on his property off Vley Road, the Planning and Zoning Commission recommends that the Zoning Board of Appeals approve the application. The Commissions findings in support of our recommendation are as follows: The establishment/operation of the conditional use will not be detrimental to or endanger the public health, safety, or general welfare of the community. The conditional use will not compromise the use and enjoyment of other property in the immediate vicinity, nor will it substantially diminish or impair property values within the neighborhood. The conditional use will not hinder the normal and orderly development and improvement of surrounding properties. The proposal does provide adequate utilities, access roads, drainage, and other necessary facilities to serve the conditional use. The proposal does provide adequate measures for ingress and egress to the site, in such a manner as to minimize traffic congestion in the public streets. Chairman Michael Carr noted this is the third request (note: research proves this is the fourth request) for filing extensions for this project. Since approval (in 2008), the housing industry has not been able to support condominiums and the financing of condos.
