3. Baptist Health Site Plan Review and
7 Swaggertown Road Minor (two-lot) Subdivision
Final (Public Hearing)
Baptist is proposing to construct the first phase of their five-phase, multi-year project. The first phase includes a 67-unit, 72-bed assisted living nursing facility. The two-lot subdivision would separate out an 8.87-acre building lot from the 48-acre parcel for the assisted living building. Phase 1 also includes parking, infrastructure, the boulevard entrance road and a storm water basin designed to accommodate this phase. The property is zoned Mixed Use Planned Development.
M. Carr noted the submission of new information on the proposed infiltration basin on August 9, 2010 by Baptist Health’s engineer. He introduced Tony Alotta, who was on hand to present an overview of Phase I of the project. He stated that Baptist Health is seeking site approval to build a 72 bed assisted living facility and 67 apartment units for senior citizens.
Tom Gears, from the architectural firm of SWBR presented the latest rendering of the project. He stated that the building will be three stories and highlighted the roof details and siding color scheme.
Peter Romano from Chazen Engineering, stated that site utilities will include on-site water and sanitary sewer pump station. He noted that the storm water management system would incorporate a “green” design utilizing rain gardens and that there will be an infiltration basin located in the northeast corner of the property. He noted that the storm water basin is designed for full build out. P. Romano stated that Baptist Health has added bushes, trees and landscaping to breakup the monotony of the view of the basin for the neighbors. M. Carr noted that the Town’s independent engineering consultant must review the revised plans.
M. Huff asked about the status of the Thomas Corners Fire Department with regards to the project. P. Romano stated that he spoke with the Fire Chief and will be submitting a letter to him.
M. Carr opened the hearing to the public. Several residents expressed concerns over the proposed project.
Paul Kenny of 48 Swaggertown Road had four major concerns regarding the proposed project. They were:
1. Infiltration basin
P. Kenny asked who would be responsible if the storm water management system failed. D. Gilgore stated that the system will be designed in accordance with state guidelines. M. Carr stated that the Town has hired an independent engineering firm to review the storm water management plan, at Baptist’s expense.
2. Buffer zone
Mr. Kenny stated that he was in favor of a buffer zone, but would like to see it expanded.
3. Noise
Mr. Kenny stated that he was concerned over noise associated with the project. P. Romano stated that the applicant plans on placing the heating and cooling units to the rear of the property and that noise levels with comply with HUD regulations. Building Inspector Paul Borisenko stated that the Town’s Zoning Ordinance sets a limit of 75 dB(A) at the property line.
4. Construction
Mr. Kenny expressed concerns about the effects of project construction on his well.
Sylvia Poggi, a member of the East Glenville Neighborhood Association, spoke against the project due to possible problems with her well.
Chuck Steiner, President of the Schenectady County Chamber of Commerce was on hand to support the project.
Stephen De Dell of 53 Swaggertown Road expressed concerns over increased traffic in the area. P. Romano addressed his concerns and noted that the NYS Department of Transportation will conduct traffic studies during each phase of construction. He stated that Swaggertown Road will be widened from Route 50 to the proposed site entrance.
Phillip Adams of 104 Marson Avenue asked if the final master plan included access to Horstman from Marson Avenue. P. Romano stated no. P. Adams also did not object to this project.
Dan Martin of 10 Birch Knoll Drive expressed concerns over the “paper street” at the end of Ellesworth Drive. He was concerned that it might be used as an access drive. P. Romano stated that there are no plans to do this.
Tony Alotta stated that Baptist Health has a petition with 100 signatures in favor of this project.
The Board discussed the possibility of keeping the public hearing open. It was decided to close the hearing.
M. Carr read two e-mails regarding the project. Barbara and Peter Notch of 57 Swaggertown Road were opposed to the retail portion of the project. Bob Lacey of 16 Vista Drive was in favor of the facility, but opposed to the retail portion.
T. Bodden noted that the Commission is currently reviewing Phase I of the project and each additional phase is subject to review. M. Carr noted that the information provided must be reviewed by the town designated engineer and the application will be on the September agenda.
4. Morris Strauss Site Plan Review and
19 Glenridge Road (Preliminary)
The applicant is seeking Site Plan approval to construct a 4,992 square foot retail/office building at the existing Towne Center Plaza. The property is located on the north side of Glenridge Road, opposite the Glenville branch of the Schenectady County Library. This parcel is zoned General Business and is within the Town Center Overlay district.
Morris Strauss was present to give an overview of the project. He stated he plans to construct a 4,992 square foot retail/office building to accommodate a current tenant. He stated that the new building will have radiant heat. J. Gibney noted that the original site plans allowed a medical center that was never built. M. Carr asked if the project was located within the town center. K. Corcoran stated that it was. M. Storti clarified that the proposed lighting would be consistent with town center plans.
M. Carr requested storm water calculations for the new project.

In the matter of the site plan review, preliminary application by Morris Strauss,19 Glenridge Road for construction of a 4,992 square foot retail/office building at the existing Towne Center Plaza, the Planning and Zoning Commission finds that this application will not result in a significant potential adverse environmental impact. Consequently, the Planning and Zoning Commission hereby issues a negative declaration.

MOTION
In the matter of the final site plan review application by Morris Strauss of 19 Glenridge Road to construct a 4,992 square foot retail office building, the Planning and Zoning Commission hereby conditionally approves the application. The Commission hereby schedules a public hearing for September 13, 2010 to consider the final site plan review application. The conditions for the preliminary approval are as follows:
1. The storm water calculations must be formalized.
2. The resident lighting expert on the PZC shall review the lighting plans.
3. The driveway connections must meet county standards.
However, in order to schedule a public hearing on September 13th, nine copies of the revised site plan must be created and submitted to the Town of Glenville Planning Department no later than 14 days prior to September 13th 2010.

5. Thomas J. Pai Site Plan Review
126 Saratoga Road (Preliminary) – Continued

The applicant is asking to expand two parking areas; one in the front yard of the existing professional building and the other in the rear yard. Several variances were granted for this proposal. The property, located on the southeast corner of Route 50 and Rudy Chase Drive, is zoned Community Business.
Thomas Pai was on hand to present an overview of his application. He noted that he obtained 10 variances from the Zoning Board of Appeals. He outlined his plan for landscaping. M. Huff noted that as per the Zoning Board of Appeals, all work must be completed within 60 days of final site plan approval.

The Commission hereby schedules a public hearing for September 13, 2010 to consider the final site plan review application. The conditions for the preliminary approval are as follows:
1. The project adheres to the ten Zoning Board of Appeals variances granted.
A public hearing has been scheduled for September 13th 2010.
