562 Saratoga Road Combined Preliminary and
Final (Public Hearing)
This proposal involves a 31’ by 10’ addition along the north side of the existing office building. The property is located on the northeast corner of Route 50 and Kile Drive, and it is zoned Professional/Residential.
Nancy Cappiello was present to address the Commission regarding her application. She said the addition would make patient access better and eliminating the sidewalk and steps would help control skateboarding problems that occur on her property.
T. Bodden opened the hearing to the public. With no one wishing to speak, the public hearing was then closed.
P. Borisenko said the application was straightforward and he has no issues with the proposal.
P. Huff asked about the expansion of the building behind the office and Dr. Cappiello stated that the building was finished inside, but no expansion took place.
K. Corcoran noted that there would be no additional demand on parking.
S. Marsh asked that final site plans submitted for signatures be in black print for copying purposes.

MOTION
In the matter of the site plan review application by Nancy Cappiello for a 31’ x 10’ addition to her property located at 562 Saratoga Road, the Planning and Zoning Commission finds that this application will not result in a significant potential adverse environmental impact. Consequently, the Planning and Zoning Commission hereby issues a negative declaration.
Reasons supporting this recommendation are that this project will not result in one or more of the following impacts:
1. A substantial change in air quality, ground or surface water quality; traffic or noise levels; erosion, flooding, leaching or drainage problems.
2. The removal/destruction of large quantities of vegetation or wildlife; substantial interference with the movement of fish or wildlife; impacts to significant habitat areas.
3. The creation of a material conflict with the Town’s Comprehensive Plan or other approved/adopted plans or goals.
4. An impact to important historical, archeological, architectural or aesthetic resources.
5. The impairment of the character of the community or neighborhood.
6. A major change in the type or quantity of energy to be used.
7. The creation of a hazard to human health.
8. A substantial change in the use, or intensity of use of land, including agricultural, open space or recreational resources.
9. The encouraging or attracting of a large number of people to a place for more than a few days, compared to the number of people who would come in the absence of such an action.
10. Changes in two or more elements of the environment, no one of which has a significant impact on the environment, but when considered together, result in a substantial adverse impact on the environment.

In the matter of the preliminary site plan review application by Nancy Cappiello for a site plan review application for a 31’ x 10’ addition to her building located at 562 Saratoga Road, the Planning and Zoning Commission hereby conditionally approves the application.
Conditions of preliminary approval are as follows:
1. Final site plans submitted for signatures will be black and white.
2. Approval is contingent upon Town satisfaction that the existing septic system can accommodate the expanded use, per Schenectady County referral note dated May 18, 2009.

The Commission has held a public hearing for this project on this date, June 8, 2009, to consider the final site plan.

MOTION
In the matter of the final site plan review application by Nancy Cappiello for a 31’ x 10’ addition to her building located at 562 Saratoga Road, the Planning and Zoning Commission hereby conditionally approves the application. The Commission’s decision is based upon the following findings:
1. The proposed use does conform to other applicable provisions of the Zoning Ordinance, including, but not limited to, landscaping requirements, building design, off-street parking requirements, building setbacks, fence requirements, sign regulations, storm water management and erosion control requirements, etc.
2. The proposed use does exhibit adequate and logical vehicular access and circulation, including intersections, road widths, curbing, and traffic controls.
3. The proposed use does exhibit satisfactory pedestrian and bicycle access and circulation, including separation of pedestrian traffic from automobile traffic, the placement and usefulness of on-site sidewalks and walkways, the accommodation for pedestrians at adjacent street intersections, and overall pedestrian and bicyclist safety and convenience.
4. The proposed use does exhibit adequate and logical location, arrangement, and setting of off-street parking and loading areas.
5. The proposed use does exhibit adequate and logical placement, arrangement, size, and design of buildings, lighting, and signs.
6. The proposed use does provide for the adequate type and arrangement of trees, shrubs, and other landscaping elements, as they relate to visual and noise buffering of adjacent sites and the reduction of visual impacts from the street.
7. The proposed use does demonstrate adequate provisions for the collection and/or disposal of storm water, sanitary waste, and garbage.
8. The proposed use will allow for adequate on-site snow plowing and snow storage.
9. The proposed use does demonstrate adequacy and durability of structures, roadways, utilities, and landscaping in areas with moderate to high susceptibility to flooding, ponding, and/or erosion.
10. The proposed use does retain existing trees and vegetation for aesthetic reasons, and minimize soil erosion and siltation.
11. The proposed use does protect adjacent properties against noise, glare, light pollution, odors, litter, unsightliness, or other objectionable features.
12. The proposed use does provide suitable open space for buffering and/or recreation purposes.

The conditions of approval are as mentioned in the preliminary site plan approval regarding black and white copies of the site plan being provided to the Town and adherence to the Schenectady County referral suggestion regarding the size adequacy of the existing septic system for the proposed expansion.

Concept Subdivision
1. Leonard Attanasio Conceptual 6-lot
40 St. Anthony Lane Subdivision
The applicant is proposing to subdivide the Woodlin Club property into six single-family home lots. The property is located off the northern terminus of St. Anthony Lane.
Mr. Attanasio explained that he had submitted a concept for a 4-lot subdivision and the Commission has questioned what would happen with the rest of the property. He has come back with a 6-lot subdivision. He stated there would be a trail for public access to the Indian Kill, but as this is just a concept, no details are shown. He then provided a new map showing a larger cul-de-sac and seven lots.
Discussion followed on the sequencing of building, demolition of the Woodlin Club, and possible phasing of construction. T. Bodden noted this could be a ‘nightmare’ for the assessor. P. Borisenko said that he and Engineering Tech Dana Gilgore have been pushing to change the road ordinance to see all infrastructure and stormwater completed before any building permits are issued. This would help prevent any projects being partially completed and then abandoned.
K. Corcoran reminded the Commission that the Woodlin Club is presently a non-conforming use.
S. Marsh voiced concern regarding the Club becoming an ‘attractive nuisance’; he suggested selecting a definite date for building demolition and pool removal as part of the plan.
T. Bodden said the Commission would probably agree that they would prefer that everything is done at once, especially because of the non-conforming use issue.
With no further items on the agenda, the meeting was adjourned at 7:50 p.m. The next meeting of the Town of Glenville Planning and Zoning Commission is to be held on Monday, July 13, 2009. The agenda meeting will be held on Monday, July 6, 2009.
