1. Approval of the minutes of the October 12, 2009 meeting

2. Joseph Donzelli Minor (2-lot) Subdivision
9 Snyder Lane Preliminary
The proposed subdivision would divide an existing 23,909 +/- square foot parcel into two lots. The existing house and improvements would remain on a proposed 11,992+/- square foot parcel, while the remaining 11,917 +/- square foot parcel would be used as a building lot for a new single-family residence. The property is located within a Suburban Residential zoning district with access to public sanitary sewer.
Mr. Donzelli was present to answer any questions the Commission may have. He stated that his daughters live at number 7 Snyder Lane and number 9 Snyder Lane. If this subdivision is approved, he would like to build a house for his wife and himself at what would be number 11 Snyder Lane. The proposed lot is bigger than 7 Snyder Lane.
Chairman Carr said that the Commission is aware that area variances regarding square footage of the lot would be necessary. He said although the degree of variance is not severe, the applicant must appear before the Zoning Board of Appeals to ask that these variances be granted. He added that the applicant would need to connect to the municipal sewers. This would require a Town-maintained grinder pump.
Discussion followed about the rationale for variances and J. Gibney suggested the applicant provide a map with other area homes and lot sizes shown. He must be prepared and thorough. Mr. Donzelli also asked what could be done in the floodplain area of his lot, and Building Inspector Paul Borisenko explained any construction or filling of the area would need a Floodplain Development Permit. Any buildings would need to be elevated two feet based on the New York State Building Code.

This application will be continued after appearing before the ZBA. Per the applicant’s request, it may be possible to combine preliminary and final Planning and Zoning approval at one meeting.
3. Richard J. DiCresce, Jr. Site Plan Review
178 Freemans Bridge Road Amendment
The applicant is proposing to erect a carport in the rear of his property for the purpose of storing his antique car as well as lawn maintenance equipment.
Mr. DiCresce said this is the same mobile carport he already had on his property, but he replaced it with a new one and moved the older one to the back of the property.
Attorney Huff asked if the carport had side walls. R. DiCresce said it has two sides and a canvas back. The front is open and faces the airport. P. Borisenko clarified that a structure is considered temporary if it is not up more than six months per year. This carport would be considered permanent. He also said he had no issues with this application.
MOTION
In the matter of the amendment to a previously approved site plan for property owned by Richard DiCresce, Jr. and located at 178 Freemans Bridge Road, to erect a carport in the rear of his property for the purpose of storing his antique car as well as lawn maintenance equipment, the Planning and Zoning Commission approves the amendment, conditioned upon the receipt of two additional full size site plan copies for the required PZC chair signature.

Attorney Huff stated that although Mr. DiCresce did not promise, he did state that he would be willing to put additional plantings around the carport.
With no further items on the agenda, the meeting was adjourned at 7:30 p.m. The next meeting of the Town of Glenville Planning and Zoning Commission is to be held on Monday, December 14th, 2009. The agenda meeting will be held on Monday, December 7th, 2009.
