Supervisor Koetzle called the meeting to order at 7:30 PM;
Supervisor Koetzle asked the Town Clerk, Linda C. Neals, to call the roll.
Present: Supervisor Christopher A. Koetzle, Councilmen Alan Boulant, John C. Pytlovany, Sid Ramotar and Councilwoman Gina M. Wierzbowski
Absent: None
Also present were Attorney Michael Cuevas, Director of Operations James MacFarland, Comptroller George Phillips and Highway Superintendent Tom Coppola and Deputy Highway Superintendent Jeff Gemmette.
Town Council Reports:
Councilman Ramotar – “I went on a tour of the parks with Jamie MacFarland about a week ago to familiarize myself a little more with what takes place in Indian Meadows, the baseball fields and Maalwyck Park.”
Councilwoman Wierzbowski – “Supervisor Koetzle and I had the pleasure of attending the premier of the “How to Unmake a Bullying” video that Glendaal School produced. It was extremely well done, the kids worked very hard on it and I am really excited to get with Councilman Pytlovany and see if we could some how find a way to include it in our DARE program. Maybe look at ways to share it for a town wide viewing at the Senior Center or something like that. I feel that this is a subject that comes to the forefront far too often with bad or unfortunate news with regard to bullying. Anything that we can do as a Board, representing the whole Town to try to make kids more aware is something we all need
to do.”
Supervisor Koetzle – “It was a very good movie and the kids did all of the work including the billboards.”
Councilman Boulant – “Tomorrow night at 5:30 pm at Mohawk Honda there will be a “Chamber Mixer”. We are having regular meetings for “Oktoberfest”, it’s really taken on some steam and I think it’s going to be a must attend event held on Saturday, October 1st.
A lot of the business owners on Freemans Bridge Road are talking about the demolition of the old ALCO plant on Erie Blvd. and I have this feeling that once that is all done and things start to go in a much more positive direction as far as the development aspect of it, it’s almost like Freemans Bridge Road is gong to extend down instead of Erie Blvd. extending up. I think it is going to be a very positive thing for us and I have to commend Mark Storti and Ray Gillen, I think they are doing a great job with it and there are a lot of positive things coming out of it. There is a lot of activity in Glenville right now with some of the vacant properties, nothing really solid but a lot of things going on.”
Councilman Pytlovany – “On June 4th the Scotia-Glenville DARE Advisory Board held their 15th Annual Golf Tournament to raise money for the DARE program here in Glenville. It was a huge success; we had great weather, a great attendance from both the golfers and the sponsors. I haven’t gotten the figures yet but it was well done by all the DARE Board members.”
Supervisor Koetzle – “Item No. 5 on the agenda is a public hearing to consider a petition to extend water service from Water District No. 11 existing water mains on Hetcheltown Road to the premises at 163 Hetcheltown Road.”
Supervisor Koetzle opened the public hearing at 7:42 pm.

Supervisor Koetzle shared the following information:
Tuesday, June 21st at noon we will be having our Glenville Solar Installation Celebration.
The Glenridge Road reconstruction project has begun. The construction materials are being staged right now, fencing is up, utilities have been marked and we look forward to that project improving the major Town corridor to the east, easing some of the rush hour traffic jams that occur.
The Gazette had an editorial regarding the Maritime Center. It stated the obvious that we need to work together to find a suitable reuse for the center now that BOCES has ended their lease. We have been assisting the Maritime Center, Attorney Cuevas, Jamie MacFarland and I took a tour of the property, we have met with some interested parties and discussed some possibilities. We are moving forward working with HUD and the County to help develop a new model for the center’s operation. There are no Town funds at stake in this; we do not hold the mortgage from the point of view that we have any liability of payment we just simply pass through the payment to HUD.
At the last work session I thought that the Chairman of the Efficiency in Government, Dave Tomasky did a wonderful job presenting an idea on evaluating efficiency in government and utilizing the ISO-9001 program. He gave us a nice overview about how we can begin to look at if we are meeting our customer’s needs and talked about the residents in terms of being a customer. We will do a type of outreach with our residents and customers and make sure we are using our resources wisely and that everything is being managed correctly. I would like to continue this conversation and see what exactly we want to measure, how exactly we want to do it and try to give that committee some direction before they start going down the
road.
I met with the Animal Protection Foundation to discuss the possibility of housing our stray dogs. They are at capacity and they are having problems with facilitating Schenectady’s needs. They are talking to Schenectady about that now but they are opened to working with us. We are waiting for a proposal; the cost is going to be a big factor.
The U.C.C. continues to pop up now and again. The County has given us a revised proposal that we are reviewing now, position remains the same though; the consolidation has to make sense for Glenville in addition to making sense for the County. Until the town resident’s best interests are served we can not agree to take part in the U.C.C. but we are keeping an opened mind during discussions and are hopeful we can get there. They seem opened to some of our ideas.
Councilman Boulant – “The Safety Village – there was a caravan that went to Rochester today to view the existing facility that’s located out there. I was asked to go but I could not make it but I suggested that they video it. That might be something that we could show members of the town at a later date.”
Supervisor Koetzle – “The budget season is upon us, July 15th we will be giving out our budget memo to the department heads to start formulating their budgets. We will start thinking about where we want to be, at our next work session we will start looking at some of the numbers where we have a fund balance.”
Supervisor Koetzle moved ahead with the agenda items.
RESOLUTION NO. 96-2011

WHEREAS, the Water and Sewer User Fee Roll of the Town of Glenville has been approved for collection as of June 1, 2011; and
WHEREAS, such warrant for Water District #11 totals $1,644,336.94 including water rents receivables, Special Contracts and Sewer,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby accepts such roll.

RESOLUTION NO. 97-2011

WHEREAS, the New York State Department of Transportation (NYSDOT) is in the process of improving Glenridge Road, particularly in the area of the Alplaus Creek and the D & H Railway Bridge; and
WHEREAS, as a result of such road reconstruction, National Grid finds it necessary to relocate portions of its electric and gas distribution facilities, underground, to the east side of the Alplaus Creek ; and
WHEREAS, the Town of Glenville owns the land where the electric and gas distribution lines would be relocated, being part of the Cozy Dale open space area; and
WHEREAS, Niagara Mohawk Power Corporation will pay the Town the sum of One Thousand and no/100 ($1,000.00) for an easement approximately 20 feet wide and about 203 feet long in approximately the same location as existing overhead utility lines;
NOW THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Supervisor to execute the attached Grant of Easement to the Niagara Mohawk Power Corporation described above, for the purposes and under the terms and conditions outlined.

RESOLUTION NO. 98-2011

WHEREAS, the Town Board of the Town of Glenville (herein called the “Town Board” and “Town,” respectively), in the County of Schenectady, New York, has received a written petition, dated May 16, 2011, pursuant to section 191 of the Town Law, for the extension of Water District No.11 (herein called “District”) whose petition was signed by the owners of at least one-half (1/2) of the assessed valuation of all taxable real property situate in the proposed District and including the signatures of resident owners of at least one-half (1/2) of the assessed valuation of such taxable real property situate in the proposed District owned by resident owners, all as
shown upon the latest completed assessment roll of said Town, and a map, plan and report for the extension of Water District No.11 of the Town of Glenville and the construction of a Water system therein, consisting of water mains including land or rights in land, connections, fill, services, appurtenances and related site work (herein called the “Water Improvement”) from existing water mains on Hetcheltown Road to 163 Hetcheltown Road, a distance of approximately 400 feet was prepared and is now on file in the office of the Town Clerk of the Town for public inspection; and
WHEREAS, pursuant to the Order duly adopted on May 18, 2011, the Town Board has determined to proceed with the establishment of the proposed extension to the District and adopted an Order reciting a description of the boundaries of the extension of the District in a manner sufficient to identify the lands included therein as in a deed of conveyance, the improvements proposed, the maximum amount proposed to be expended for the construction of the Water Improvement in the District, the proposed method of financing to be employed, the fact that a map, plan and report describing the same are on file in the Town Clerk’s office for public inspection and specifying June 15, 2011, at 7:30 PM, as the time when, and the Glenville Municipal
Center, 18 Glenridge Road, Glenville, New York, in the Town, as the place where, the Town Board would meet to consider the establishment of an extension of the District and to hear all person interested on the subject thereof concerning the same, and for such other action on the part of the Town Board in relation thereto, as may be required by Law ; and
WHEREAS, certified copies of such Order were duly published and posted pursuant to the provisions of the Town Law; and
WHEREAS, the Town Board has given due consideration to the impact that the proposed extension to the District may have on the environment and on the basis of such consideration, the Town Board has found that no substantial adverse environmental impact will be caused by the extension of the District; and
WHEREAS, the Town Board and the Town have complied in every respect with all applicable federal, state and local laws and regulations regarding environmental matters, including compliance with the New York State Environmental Quality Review Act, comprising article 8 of the Environmental Conservation Law and, in connection therewith, a duly processed Negative Declaration and/or other applicable documentation has been filed in the office of the Town Clerk; and
WHEREAS, a Public Hearing in the matter was duly held by the Town Board on said June 15, 2011, commencing at or about 7:30 PM, at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York, at which all interested persons desiring to be heard were heard, including those in favor of, and those opposed to, the proposed extension to the District.
NOW, THEREFORE, upon the evidence adduced at such public hearing be it
RESOLVED AND ORDERED by the Town Board of the Town of Glenville, in the County of Schenectady, New York as follows:
Section 1. It is hereby determined that:
- The Notice of Public Hearing was published and posted as required by Law, and is otherwise sufficient;
- All the property and property owners benefited included within the proposed extension to the District hereinabove referred to in the recitals hereof are benefited thereby;
- All the property and property owners benefited are included within the limits of the proposed extension to the District; and
- It is in the public interest to establish the extension to the District.
Section 2. The establishment of the proposed extension to the District is hereby approved, as hereinafter described, and said District shall be designated and known as Extension No. 37 to Water District 11 in the Town and shall include the property commonly known as 163 Hetcheltown Road.
Section 3. The Water Improvement is hereby authorized to be constructed in the District and the amount proposed to be expended therefor, including the expenses incurred in connection with the establishment of the extension to the District, is to be fully borne by the developer; the plan of financing is to be fully and completely borne by the developer, at no cost to the Town or other users in the District.
Section 4. The permission of the State Comptroller is not required with respect to the extension of the District because the cost of the extension to the typical property is not above the Average Estimated Cost to the Typical Properties for the establishment of similar types of districts as computed by the State Comptroller.
Section 5. The Town Clerk of the Town is hereby authorized and directed within ten days after the adoption of this Resolution and Order, to file certified copies thereof, in duplicate, in the office of the State Department of Audit and Control in Albany, New York, record same in the office of the Clerk of the County in which the Town is located.
Section 6. This Resolution and Order shall take effect immediately.

WHEREAS, a local law to amend Chapter 238 – Street Standards being proposed as Local Law No. 2 of 2011, a copy of which is attached hereto, was introduced at this meeting by a member of the Town Board of the Town of Glenville; and
WHEREAS, the Town Board wishes to hold a public hearing with respect to the adoption of said Local Law;
NOW, THEREFORE, BE IT RESOLVED, that a public hearing be held by the Town Board of the Town of Glenville with respect to the adoption of the aforesaid Local Law at 7:30 PM on July 20, 2011, at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York, and it is further
RESOLVED that the Town Clerk is hereby authorized and directed to cause public notice of said hearing to be given as provided by law.

RESOLUTION NO. 100-2011

WHEREAS, the New York State Department of Transportation (NYSDOT) is in the process of improving Glenridge Road, particularly in the area of Maple Avenue, the Alplaus Creek and the D & H Railway Bridge; and
WHEREAS, James H. Maloy, Inc., Contractors, of Loudonville, New York, will be a primary contractor for such road reconstruction and will need space to store vehicles, equipment, supplies and materials necessary for such work; and
WHEREAS, the Town of Glenville owns the land being part of the Cozy Dale open space area that would be suitable for such purposes; and
WHEREAS, James H. Maloy, Inc. is willing to enter into a temporary easement with the Town, wherein in exchange for the use of town land, it will agree to restore the property after the project is done, maintain adequate insurance coverage and hold the Town harmless and provide the Town with reclaimed stone from the construction site;
NOW THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Supervisor to execute the attached Grant of Easement to James H. Maloy, Inc. described above, for the purposes and under the terms and conditions outlined.

RESOLUTION NO. 101-2011

WHEREAS, the New York State Department of Transportation (NYSDOT) is in the process of improving Glenridge Road, particularly in the area of Maple Avenue, the Alplaus Creek and the D & H Railway Bridge; and
WHEREAS, as a result of such road reconstruction and in order to increase the width of the tunnels under the railroad tracks, NYSDOT finds it necessary to acquire by eminent domain an irregular shaped parcel of Town land located on the northern side of Glenridge Road, east of the Delaware and Hudson Railway, and temporary easements on the northern and southern sides of Glenridge Road and northwest side of Bruce Drive for work areas during the road reconstruction work, all as described in the attached Explanations of Acquisition; and
WHEREAS, the Town of Glenville desires to assist the NYSDOT in this road reconstruction project that will benefit all Town residents by conveying such land and granting the aforementioned temporary easements; and
WHEREAS, NYSDOT will pay the Town, in accordance with the attached Offers of Settlement, the fair market value of the property to be acquired (approximately 1.42 acres) in the sum of Nine Thousand Nine Hundred Fifty and no/100 ($9,950.00), an additional Two Hundred Fifty and no/100 ($250.00) for the temporary easements along Glenridge Road (approximately 0.1624 acres), and an additional Two Hundred and no/100 ($200.00) for a temporary easement on Bruce Drive, all as determined by accepted appraisal standards;
NOW THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Supervisor to accept the sums offered by NYSDOT for the taking of 1.42 acres of Town land (currently part of the Cozy Dale Open Space area) and for the temporary easements on Glenridge Road and Bruce Drive, as described in the attached Explanations of Acquisition, a total consideration of $10,400.00, and to execute any and all documents necessary to accept the Offers of Settlement and to convey title to such land and temporary easements.

RESOLUTION NO. 102-2011

WHEREAS, the Town of Glenville Employee Personnel Manual contains provisions outlining the terms and conditions of employment for Town employees who are not members of a bargaining unit; and
WHEREAS, Said Personnel Manual places all full-time appointed town officials in one grouping for the purpose of identifying the benefits those employees are to receive, but singles out the Deputy Superintendent of Highways to receive the same benefits as provided in the Highway Department Employees Association agreement with the Town; and
WHEREAS, as a matter of equity and fairness, the Town Board of the Town of Glenville wishes to provide the Deputy Superintendent of Highways with the same health insurance, dental and vision insurance and health insurance for retirees as all other full-time, appointed officials except the Police Chief and Police Lieutenants;
NOW THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby amends “Section IV, S. BENEFITS FOR EMPLOYEES NOT REPRESENTED BY A UNION, 2. Group Benefits, C. Appointed full time” to provide that the Deputy Superintendent of Highways shall receive the same health insurance, dental and vision insurance and health insurance for retirees as provided in the CSEA agreement with the Town and further amends such section to make technical corrections, all as in Schedule A attached hereto.

New Business
Councilman Ramotar – “This past week-end I came back from Binghamton where Burnt Hills Varsity Baseball won the State Championship. I would like for the Town Board to recognize this at our next board meeting.”
Councilwoman Wierzbowski – “I neglected to mention that I attended a meeting at the Alplaus Fire Department with Superintendent Coppola with regards to the Maple Avenue and Alplaus Avenue work that is going to be done. The essence of the project is that they are going to be straightening the curve west bound towards Freemans Bridge Road just past the railroad overpass. They are going to be adding two turn lanes, a right turn lane coming from Freemans Bridge Road and a left turn lane heading west on Maple Avenue. They are also installing a traffic light. This was a formal public meeting with a formal public comment period. There was a question and answer session before and after the public hearing.
Some of the concerns that the residents expressed were that there was going to be, as a result of this, increased traffic on Bruce Drive and their concern was that children wait for buses, people walk on that road and the speed limit is 35 mph and with all of the construction that is going to be happening as a result of the round-a-bout and in the stretch where they are widening the two bridges on Glenridge Road. They are concerned about how much that traffic is going to affect Alplaus. They had some different ideas with regard to asking the developer to pay for sidewalks and things like that. I have no idea if that is possible but I said that I would relay that to the Board. They do anticipate, if everything goes according to plan, they do have some land acquisition that they need to do with some residents, not a huge amount of land I think it was less than one-half acre with four properties. They have a pretty tight schedule because their goal
is to try and finish the project before the work begins with the Glenridge Road project. I will keep you posted on that project.”
Councilman Boulant – “Target is still on track, demolition is still scheduled for September and the grand opening in October 2012.”
Councilman Pytlovany – “This Sunday, Father’s Day, is the Village’s Annual Crusin–on–the-Avenue Car Show. Mohawk Avenue will be closed from the Western Gateway Bridge to Sacandaga Road from 1:00 pm to 5:00 pm.”
Supervisor Koetzle – “I received an email from a developer who wanted to let me know what a great job Terri Petricca is done in the process of Price Chopper’s rehab. Secondly, I had the privilege to be invited to the Northeastern Police Chiefs Conference. It became very apparent to me among his peers how respected our Chief is and viewed as an expert and becoming known as a national speaker on many issues regarding law enforcement. They are putting him on the NYS Association of Chiefs of Police Board of Governors. We should all be proud that our staff is seen as experts in their field and respected by their peers.”
Supervisor Koetzle asked for a motion to adjourn; motion to adjourn was Moved by Councilman Boulant; Seconded by Councilman Pytlovany, everyone being in favor the meeting was adjourned at 8:00 PM.
