Supervisor Koetzle called the meeting to order at 7:00 PM. Supervisor Koetzle gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Koetzle asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
RESOLUTION NO. 1-2010

WHEREAS, Councilman Christopher A. Koetzle was elected to the position of Town Supervisor in the November 2009 General Election and was duly sworn in as Town Supervisor on January 1, 2010 thereby creating a Town Councilmember vacancy on the Glenville Town Board; and
WHEREAS, pursuant to Article 4, Section 64(5) of New York State Town Law the Town Board is authorized to appoint a qualified person to the Town Councilmember vacancy;
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby appoints Gina Wierzbowski, 2138 Ridge Road, Glenville to the position of Councilmember commencing January 6, 2010 and terminating December 31, 2010.

WHEREAS, the last resolution authorizing persons entitled to withdraw funds from bank accounts held by the Town of Glenville named Frank X. Quinn as Supervisor, Valerie M. DiGiandomenico, Town Councilwoman and Jeffrey Prescott, Assistant to the Comptroller as the authorized signatories on said accounts; and
WHEREAS, Frank X. Quinn and Valerie M. DiGiandomenico are no longer employees of the Town of Glenville;
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby designates Christopher A. Koetzle, Supervisor of the Town of Glenville, Alan Boulant, Deputy Supervisor of the Town of Glenville, and Jeffrey Prescott, Assistant to the Comptroller of the Town of Glenville, individually, not jointly, to be the only persons authorized to withdraw funds from any and all bank accounts held by the Town of Glenville; and
BE IT FURTHER RESOLVED the designation of Frank X. Quinn, Supervisor and Valerie M. DiGiandomenico, Town Councilwoman of the Town of Glenville as authorized signatories on Town accounts is revoked.

WHEREAS, the Town of Glenville Planning and Zoning Commission (PZC) routinely solicits engineering firms to assist with the review of technical elements of subdivision and site plan review applications; and
WHEREAS, there are a number of qualified local engineering firms who provide municipalities with consulting engineering services;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby authorizes the Town Planner to retain the services of any one of the following firms to perform an engineering review of any application that comes before the Planning and Zoning Commission, with the cost for engineering review to be paid for by the planning/zoning applicant:

WHEREAS Section 284 of the Highway Law requires that money spent for the repair and improvement of highways in the Town be spent pursuant to a written agreement between the Highway Superintendent and the Town Board; and
WHEREAS the attached agreement has been approved by the Highway Superintendent and is in the form used by the Town for numerous years,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves entering into the attached contract with the Superintendent of Highways authorizing the expenditure of $805,887.00 for the repair [5110.0] and $141,000.00 for the improvement [5112.0] of highways, sluices, culverts and bridges having a span of less than five feet in the Town of Glenville.

WHEREAS, the Town of Glenville has a responsibility to enhance and improve efficiencies for the design and construction of public works projects;
WHEREAS, the Town Board has determined that it is in the best interest of the town to establish an Engineering Services Advisory Committee who shall work in conjunction with the Town Highway Superintendent and town staff to provide guidance on engineering matters for the town including the review of engineering plans and applications. The Engineering Services Advisory Committee will work with town staff, county, state and federal agencies, town boards and commissions, residents, businesses and developers to ensure that required standards, codes and regulations are met for all projects, including non-public ones.~ The Engineering Services Advisory Committee will also provide guidance and assistance for the design, administration and
implementation of all town public works construction projects related to roadway, grading and drainage improvements and water, sewer and parks matters;
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby creates an Engineering Services Advisory Committee consisting of at least three but not more than seven members each serving a 2-year term at the pleasure of the Town Board and without compensation, commencing January 2010. The Town Supervisor will appoint the Chairman of the Committee. The Committee will meet as necessary to fulfill its responsibility and will provide, at a minimum, bi-annual reports to the Town Board on the status of its progress and findings.

WHEREAS, the Town Board is committed to open and transparent governing for its taxpayers, especially for the Town’s Financial and Budget responsibility;
WHEREAS, to help achieve this goal of transparency the Town Board hereby establishes a Budget and Finance Advisory Committee having the following duties and responsibilities:
1. Work with the Town Supervisor and Town Department Heads to prepare annual budgets for consolidation into an overall financial recommendation to the Town Board.
2. Review income and expense reports and other financial reports prepared by the Comptroller.
3. Assist with the preparation and review of all independent audit reports and provide recommendations to the Town Board on necessary action items.
4. In conjunction with the Supervisor, provide oversight to the Comptroller to ensure sound financial practices.
5. Review town financial policies, procedures and contractual obligations for services and make recommendations to the Town Board for improvements.
6. Promote greater transparency and more openness within the town budget process.
7. Examine all sources of revenue and provide recommendations to the Town board for new sources of revenue. ~
8. Work with Department Heads to help prepare and update capital expenditure plans (vehicles, infrastructure, facility, etc) for recommendation to the Town Board.
NOW, THEREFORE, BE IT RESOLVED, the Glenville Town Board hereby creates a Budget and Financial Advisory Committee consisting of at least three but not more than seven members each serving a 2-year term at the pleasure of the Town Board and without compensation, commencing January, 2010. WHEREAS, Freedom Park is a non profit organization made up of unpaid volunteers, and
WHEREAS, Freedom Park expenses consist of paying performers and a sound technician as well as maintaining the sound system, and
WHEREAS, each year Freedom Park strives to provide a diversity of programming that will serve a variety of audiences from preschoolers to senior citizens at the Wednesday night performances from the end of June through the end of August, and
WHEREAS, acts include big band, country, popular, Polish, Celtic, German, Jazz, Dixieland and rhythm and blues, and
WHEREAS, admission to all performances are free, and
WHEREAS, most of the funding for Freedom Park comes from contributions made by individuals and families in the area, and
WHEREAS, the Village of Scotia contributes, each year, along with maintaining the physical plant, and
WHEREAS, the Town Board of the Town of Glenville is desirous of continuing its support to Freedom Park by giving of its fair share,

WHEREAS, the County Legislature of the County of Schenectady has issued a Certificate to the Chief Financial Officer of the Town Certifying that the contribution of the Town of Glenville to the taxes of the County of Schenectady for the fiscal year beginning January 1, 2010 is $14,262,394.37; and
WHEREAS, the Town must levy said sum against the taxable real estate, and direct the extension of such taxes against each such parcel,

1. The Town Board of the Town of Glenville does hereby levy the sum of $ 14,262,394.37 by the County Legislature as said Town's contribution to the taxes of the County of Schenectady for the fiscal year beginning January 1, 2010.
2. The taxes due the County of Schenectady shall be extended against each parcel of taxable real estate at a rate to be established by the County of Schenectady per $1000 of taxable assessed value.

WHEREAS, a minor zoning text amendment has been proposed by the Town of Glenville Planning Department; and
WHEREAS, the proposed amendment involves the addition of laundromat to the list of land uses permitted as a “personal service;”
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby schedules a public hearing for Wednesday, January 20, 2010, at 7:30 p.m., or as shortly thereafter as possible, at the Town of Glenville Municipal Center, to consider this zoning text amendment.

RESOLUTION NO. 43–2010

WHEREAS, by Resolution 62-2006 the Town Board abolished the position of Town Attorney and thereafter created two positions of Attorney (part-time) by Resolution 71-2006; and
WHEREAS, the Town Board is aware of recent opinions of the State Comptroller and the State Attorney General that part-time attorneys providing legal services to municipalities are, in many cases, more appropriately treated as independent contractors and should not receive credit in the state retirement system;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby authorizes the Supervisor to execute such paperwork as is necessary to abolish two positions of Attorney (part-time).

RESOLUTION NO. 44–2010

WHEREAS, the Town Board has reviewed its options for procuring general legal services, municipal finance/bond counsel services and comprehensive labor relations services for the Town and the various departments thereof; and
WHEREAS, the Town Board has determined that the Town would best be served by contracting with the law firm of Roemer Wallens & Mineaux LLP for such legal, municipal finance/bond counsel services and comprehensive labor relations services;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby authorizes the Supervisor to execute a three year contract for legal and comprehensive labor relations services with the law firm of Roemer Wallens & Mineaux LLP, 13 Columbia Circle, Albany, New York in an initial annual amount of $96,000 per annum, payable monthly, with subsequent years at no more than $96.000 plus the lesser of the annual increase in the Consumer Price Index or 3%,
NOW BE IT FURTHER RESOLVED, that the Town Board of the Town of Glenville approves the following budgetary transfer:

From: 01.00.1010.1000 To: 01.00.1420.4000 Amount: $7,942.00

WHEREAS, the Town Board has reviewed its options for procuring legal services for the Town Planning & Zoning Commission and the Zoning Board of Appeals; and
WHEREAS, the Town Board has determined that the Town would best be served by contracting for such legal services with McCary & Huff; 107 N. Ballston Avenue, Scotia, New York;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby authorizes the Supervisor to execute a one year contract for legal services to the Town Planning & Zoning Commission and the Zoning Board of Appeals,
AND BE IT FURTHER RESOLVED, that the Town Board of the Town of Glenville hereby approves the following budgetary transfer:

RESOLUTION NO. 46–2010

WHEREAS, the Clifton Park Water Authority and the Town of Glenville have previously entered into an agreement for the bulk purchase of water by the Authority from the Town; and
WHEREAS, the aforesaid agreement expired on December 31, 2009; and
WHEREAS, the Authority desires to extend said contract on the same terms and conditions as set forth therein for a period of ninety (90) days; and
WHEREAS, the Authority serves an adjacent municipal corporation with whom the Town of Glenville and the Glenville Water District wish to cooperate concerning providing water for bulk purchase to the extent same is possible and consistent with the Town’s desire to avoid any adverse impacts to its existing water customers; and
WHEREAS, the Glenville Water District has determined that it has sufficient source water, treatment capacity and pumping ability to deliver the required volume of water to the Authority; and
WHEREAS, the Town desires to sell water in bulk to the Authority on the same terms and conditions as the agreement which expired December 31, 2009 for an additional period of ninety days from December 31, 2009;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby authorizes the Supervisor to execute an agreement extending the Bulk Water Purchase Agreement between the Clifton Park Water Authority and the Glenville Water District No. 11, under the same terms and conditions, for a period of ninety (90) days.
