SPECIAL MEETING OF THE TOWN BOARD
TOWN OF GLENVILLE

Supervisor Koetzle called the meeting to order at 7:30 PM;
Supervisor Koetzle asked the Town Clerk, Linda C. Neals, to call the roll.
Present: Supervisor Christopher A. Koetzle, Councilmen Alan Boulant, Mark Quinn, Sid Ramotar and Councilwoman Gina M. Wierzbowski
Absent: None
Also present were, Attorney Mike Cuevas, Director of Operations James MacFarland.
A motion was made by Councilman Boulant and Seconded by Councilman Quinn to adjourn into Executive Session to discuss the CSEA and Highway Memorandum of Agreement’s.

Supervisor Koetzle adjourned this portion of the meeting at 7:32 pm and reconvened at 7:45 pm; the following actions were taken.
RESOLUTION NO. 229– 2010
Moved by: Councilman Boulant
Seconded by: Councilman Quinn
WHEREAS, the Glenville Highway Department Employees Association and the Town of Glenville are parties to a collective bargaining agreement establishing the terms and conditions of employment for Town employees who are members of the association; and
WHEREAS, the aforesaid agreement expired on December 31, 2008; and
WHEREAS, the Association and the Town have negotiated a successor agreement for a term of four years that has been memorialized in writing in the form of a Memorandum of Agreement; and
WHEREAS, the members of the Association have ratified the Memorandum of Agreement; and
WHEREAS, the Memorandum of Agreement provides for a lump sum cash payment to Association employees for calendar year 2009 in the amount of 2% of earnings and wage increases for calendar years 2010, 2011 and 2012 in the amount of 2% each and a 15 cents per hour adjustment to longevity; and
WHEREAS, the Memorandum of Agreement authorizes the change in health insurance to a Town designated plan from multiple plans; changes the health insurance from an HMO 25 plan to an HMO 30 plan; adjusts the amount paid to employees opting out of Town health insurance; establishes new criteria for eligibility for Town health insurance in retirement; and establishes new contribution rates toward health insurance for new Town employees; and
WHEREAS, the Attorney for the Town and the Town’s Acting Director of Operations have recommended ratification of the Memorandum of Agreement by the Town Board;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby ratifies and adopts the proposed Memorandum of Agreement and authorizes the Supervisor to execute a collective bargaining agreement with the Glenville Highway Department Employees Association under the terms and conditions outlined in the Memorandum of Agreement covering the calendar years 2009, 2010, 2011 and 2012.

RESOLUTION NO. 230– 2010

WHEREAS, the Civil Service Employees Association, Glenville Town Hall Unit and the Town of Glenville are parties to a collective bargaining agreement establishing the terms and conditions of employment for Town employees who are members of the association; and

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby ratifies an adopts the proposed Memorandum of Agreement and authorizes the Supervisor to execute a collective bargaining agreement with the Civil Service Employees Association under the terms and conditions outlined in the Memorandum of Agreement covering the calendar years 2010, 2011 and 2012.

RESOLUTION NO. 231– 2010

WHEREAS, the Management/Confidential employees in the Town of Glenville are not represented by bargaining agents, but instead have their terms and conditions of employment established by Town policy which is incorporated in the Town of Glenville Employee Personnel Manual; and
WHEREAS, the Town has negotiated new collective bargaining agreements with units of employees represented the Civil Service Employees Association (CSEA) and the Highway Department Employees Association (HDEA); and
WHEREAS, the new collective bargaining agreements provide for changes in the terms and conditions of employment for those represented employees and the Town desires to provide similar changes for the unrepresented Management/confidential employees; and
WHEREAS, the Attorney for the Town and the Acting Director of Operations propose that the Town provide a lump sum cash payment to unrepresented Management/Confidential employees for calendar year 2010 in the amount of 2% of earnings and wage increases for calendar years 2011 and 2012 in the amount of 1.75% each and merit awards from the fund established in the 2011 Town Budget; and
WHEREAS, the agreements with the CSEA and the HDEA provide for the change in health insurance to a Town designated plan from multiple plans; change the health insurance from an HMO 25 plan to an HMO 30 plan; adjust the amount paid to employees opting out of Town health insurance; establish new criteria for eligibility for Town health insurance in retirement; and establish new contribution rates toward health insurance for new Town employees, the Attorney for the Town and the Acting Director of Operations recommend similar changes for non-represented Management/Confidential employees; and
WHEREAS, the changes in terms and conditions of employment for unrepresented Management/Confidential employees are summarized in the attached Schedule of Proposed Changes to the Town of Glenville Employee Personnel Manual are recommended by the Attorney for the Town and the Town’s Acting Director of Operations for adoption by the Town Board;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby adopts the Schedule of Proposed changes to the Town of Glenville Employee Personnel Manual, effective immediately and approves the above-stated adjustments to wages and compensation for the calendar years 2010, 2011 and 2012.

RESOLUTION NO. 232-2010

Seconded by: Councilman Quinn
WHEREAS, the Town of Glenville and the Civil Service Employees Association, Town Hall Unit are parties to a collective bargaining agreement; and
WHEREAS, CSEA filed a contract grievance with the Public Employment Relations Board on September 28, 2009 and a subsequent grievance on November 29, 2009, both pertaining to a dispute over the contractual benefits due a part time employee in the CSEA unit; and
WHEREAS, the Town Acting Director of Operations and the Attorney for the Town have negotiated a proposed settlement with CSEA which would avoid further litigation by a withdrawal of the pending grievances and result in a fair application of the terms of the contract as to the benefits due and owing the employee; and
WHEREAS, the Town Comptroller calculated the value of the accumulated sick, vacation and other leave credits due the employee as $7,342.13;
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville, approves the Stipulation of Settlement between the Town and CSEA (on behalf of Walt Hayes) and authorizes the payment to the former employee for unused, accumulated leave credits in the amount of $7,342.13.
