Present: Supervisor Frank X. Quinn, Councilmen Edward F. Rosenberg, Mark A. Quinn, Christopher A. Koetzle and Councilwoman Valerie M. DiGiandomenico

Supervisor Quinn called the meeting to order at 7:00 PM; gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Council Reports:
Councilman Quinn reported that the Open Space Committee met on Thursday and discussed the plans for the donated property known as the “Christiana Property”. Mr. Lucier, a neighbor of that property attended the meeting who was just a wealth of knowledge. He discussed a lot of the historical uses which included bow hunting, trapping, cross country skiing, hiking just to name a few. They will be coming up with an allowable use document which will detail what types of activities that will be allowed and what won’t. One of the things that we are seeking through an informational meeting is for the neighbors and any other interested parties to buy into the concept when we finally develop it. We are already looking at perhaps a public/private partnership to develop both a kiosk and parking lot there. I am sure the boy scouts will come through to help us develop the trails.
Councilman Koetzle reported that the “Welcome Packets” that the Small Business and Economic Development Committee is working on there’s been some press on that recently and as a result we have received a lot of comments from businesses that are interested in being in those packets. These packets are meant to go to new residents within the town and meant to give our businesses more exposure. Councilman Koetzle thanked the staff members that volunteered during the modified bulk item pickup. There were 23 employees that volunteered their time over four Saturdays to make this work. This was the only way we got that cost down to make it work. Councilman Koetzle also acknowledged Meridan Construction and thanked them for participating in the program.
The paper work for the solar grant is in, along with a scope of work attached to it.
Councilman Koetzle reported that he had received a call from a Town of Ballston Town Board member who is interested in working with us and the Burnt Hills/Ballston Lake School District with getting the sidewalk extended on Lakehill Road near the middle school in the Town of Glenville. There is a Safe Ways to School Grant they are interested in pursuing as a partnership so we could continue the sidewalk.
Councilman Koetzle also reported on the essay project with Pashley School regarding a proposal that is going through our committee structure here in the town regarding Indian Meadows and dogs in the park. We received 64 essays, 23 agree with the proposed ban of dogs in the parks and 43 disagree. I would like to recognize the effort of these students in some way. The board decided to set up a screening committee to review the essays.
Councilwoman DiGiandomenico reported that flowers were planted outside of the Municipal Center and thanked Virginia Graney for all of the help that she contributed.
Councilman Rosenberg reported that the radio system is still progressing and there are going to be some site visits on Friday the 15th. They will be looking at the new site, the new shelter on Hillside Avenue and the Church Road tower was approved by the Board. The cars are complete and they are still projecting to start the communication center late summer or early fall.
Councilman Rosenberg also reported on the County wide dispatch, the County of Schenectady scheduled some site visits all over the county for possible sites.
Supervisor Quinn commented that he had not seen or heard any further action. I asked for two things; why not in Glenville and what is this going to cost? The county is marching down the road and we may get a bill and we don’t know what is going on.
Councilman Rosenberg reported that they will be breaking ground soon on the public safety training center starting phase I of the project. No one knows if phase II has received funding or not.
James MacFarland presented the Municipal Separate Storm Sewer (MS4) Annual Report:
The town continues to meet the program requirements that have been established for the six “Minimum Control Measures” which are:
· Public Education and Outreach
· Public Involvement and Participation
· Illicit Discharge Detection and Elimination
· Construction Site Control
· Post Construction Control
· Stormwater Management for Municipal Operations
Highlights of this past year’s program include – forming a partnership with the Scotia-Glenville Schools and the Village of Scotia, bringing the Highway Garage into further compliance with good housekeeping requirements; elimination of floor drain use during car washing in our Police Department; when appropriate, outsourcing SWPPP review to the County Soil and Water Conservation District resulting in a faster turnaround at a better price which benefits both the town and the developer that pays for the review; working with Lowe’s to grant a 5-acre disturbance waiver (such waivers under town authority for the first time); receiving a satisfactory rating after being the first program to be audited in DEC Region
IV.
Challenges for the upcoming year will be to continue staff training for all program elements and to meet the program expectations regarding tracking program effectiveness through measurable parameters.
The town’s MS4 program is highly decentralized, with Planning, Public Works, Engineering, Building and Human Services Departments all contributing significantly to operate effectively and cooperatively in achieving the required program elements.
Lastly, I can report that as a result of this program in Glenville, the stormwater in our town continues to improve in both quality and the manner in which it impacts the storm systems in our community.

Supervisor’s Comments:
Supervisor Quinn shared the following information
May 8th – Attended the Schenectady County-wide Intermunicipal Watershed Board meeting. We reviewed the progress on our ’08 – ’09 goals.
May 9th – The annual Schenectady County Indian Kill fishing day was held.
May 11th & 26th – Attended the Schenectady County Military Affairs Council meetings. The goal setting was completed for the coming year.
May 20th – Attended the Memorial Day Parade down in the Village of Scotia
May 25th – Attended the Memorial Day Service at the Veterans site near the Thomas Corners Fire Department.
May 29th – Participated in a briefing and a discussion with the newly elected Congressman Murphy regarding the mission of the 109th.
June 24th –Local Government Council meeting
July 4th – Alplaus will hold its annual 4th of July parade.
Reminder to turn in any goals for the coming 2009 – 2010 season, that is input for a work session and the budget proposal that is up and coming.
The May financials were distributed and by looking at it I think the most important things that are in there, not a tremendous amount of change from the previous month, statistically a 10% difference, we are over budget so far year to date by 4% and on expenditures year to date we are under almost 4½%.
On the budget, we submitted over 1 million dollars in projects for the federal stimulus money and that money is coming from the feds to the state, to the county and then to us. We have not received any money so far.
On grievance day there were 185 property owners that grieved their assessments out of 11,200 properties which is 1.7%.
Town liaison appointments based on the activities that we have all been involved in year-to-date, in order to improve communication and coordination between town departments and the board. I am switching the following appointments effective July 1st; Ed Rosenberg will take over the highway department and Chris Koetzle will take the police department. This will hopefully improve communication and coordination.
Councilman Koetzle – “Regarding your announcement I am asking you to consider to moving that announcement until after we have a work session discussion on the liaison system. I think there are still some things that we should talk about before you before we go ahead and make this decision. I would like to talk about this during our work session before you make the change.”

RESOLUTION NO. 103-2009

WHEREAS, the Town of Glenville Town Board is proposing an extension of Fire Protection District No. 4 and Fire District No. 5 to cover an area of the Scotia-Glenville Industrial Park commonly referred to as “no-man’s land” more specifically described on the attached descriptions; and
WHEREAS, the proposed boundary extension constitutes an unlisted action in accordance with 6 NYCRR Part 617 (State Environmental Quality Review Act {SEQRA}); and
WHEREAS, the Glenville Town Board has assumed SEQRA Lead Agency for this action; and
WHEREAS, the Glenville Environmental Conservation Commission has recommended that the Town Board find no significant adverse environmental impacts associated with this proposed boundary extension, and that the Board issue a SEQRA “Negative Declaration;”
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby determines that the proposed extension of Fire Protection District No. 4 [and Fire District No. 5] will not result in a significant adverse environmental impact, and
BE IT FURTHER RESOLVED, that the Glenville Town Board hereby issues a SEQRA “Negative Declaration” (attached) for this action, based on the following findings:
· This action establishes a new boundary for Fire Protection District No. 4 and Fire District No. 5. Consequently, this action does not result in any construction, land disturbance, or activities that could lead to an environmental impact.
· This action will not result in any adverse changes to air quality, ground or surface water quality, traffic levels or noise levels.
· There will be no removal or destruction of vegetation or fauna, nor any impacts on significant habitat areas as a result of this action.
· This action will not create a conflict with any Town-adopted plans or policies, nor will it be contrary to any adopted community goals or objectives.

WHEREAS, over the past several years, the Town of Glenville has hired a certified public accounting firm to complete Audits of the Town's Financial Statements, and
WHEREAS, this audit is conducted in accordance with generally accepted auditing standards, the standards for financial audits contained in Government Auditing Standards; and
WHEREAS, for 2008 three bids for fixed prices for financial statement audits among five years(2006-2010) were received from a request for quotes sent out to CPA firms in the region; and
WHEREAS, the UHY LLP Certified Public Accountants (an independent Member of Urbach Hacker Young International) bid for 2008 of $23,400 for the financial statement audit represented the most experienced bidder with over 35 years of experience,
WHEREAS, the UHY LLP Certified Public Accountants (an independent Member of Urbach Hacker Young International) has estimated for 2008 that $5,000 will be the costs for the single audit required due to the level of federally funded grants received in 2008,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Supervisor to enter into an agreement with UHY LLP Certified Public Accountants, 66 State Street, Albany, New York, 12207-2595, to provide the audit of the Town's general purpose financial statements and the single audit for the year ended December 31, 2008, in the form of the N.Y. State Comptrollers’ Annual update document; and
BE IT FURTHER RESOLVED that the fees for these services will be based on the actual time spent at their standard hourly rates; and
BE IT STILL FURTHER RESOLVED that the fees for this service shall be Twenty Thousand Four Hundred Dollars ($20,400.00), based on preliminary estimates by prior and current auditors plus the additional amount of One Thousand Five Hundred and Forty Dollars ($1,540.00) for auditing Section 8 Housing, totaling an amount not to exceed Twenty Eight Thousand Four Hundred Dollars ($28,400.00), to be taken from budgeted account 01.00.1320.4500 except for Three Thousand One Hundred and Sixty Dollars ($3,160.00) for auditing the Highway Fund-Part Town to be taken from account 04.00.5140.4000; Eight Hundred Eighty Dollars ($880.00) for auditing the Water Funds to be taken from account 50.11.8310.4500; Eight Hundred Eighty Dollars

One of the purposes of the meeting was to take action in connection with the establishment of Drainage District No. 9, Town of Glenville, Schenectady County, New York.
WHEREAS, a Map, Plan and Report were previously filed with the Town Board, and said Map and Plan having been prepared by a duly licensed surveyor and engineer, showing the boundaries of the proposed Drainage District, in accordance with the Town Law, and
WHEREAS, said Map and Plan call for the establishment of a Drainage District, as shown on said map and plan, together with all necessary work, including legal and engineering expenses and such other lawful disbursements in connection therewith, all of which costs were paid for by the developer and with no cost to the Town or the residents of the proposed district, and
WHEREAS, this Town Board did call a public hearing to be held on May 6, 2009, and due notice of said public hearing was given, as required by the Town Law, and the said Town Board having a public hearing on May 6, 2009, in connection therewith, and evidence having been taken at the said public hearing in connection with the relief asked for, and after due consideration having been given in connection with the proceeding and the evidence produced at the said public hearing,
IT IS DULY
ORDERED, that the Town Board of the Town of Glenville does hereby DETERMINE as follows:
(1) The notice of hearing was published and posted as required by law and is otherwise sufficient.
(2) That all of the property and property owners, within the proposed Drainage District are benefited thereby.
(3) That all of the property and property owners benefited are included within the proposed Drainage District.
(4) It is in the public interest to establish the proposed Drainage District as hereinafter described,

ORDERED, that this Town Board does hereby approve of the establishment of said Drainage District No. 9 as shown on the Map, Plan and Report,

ORDERED, that the approval herein of the establishment of said Drainage District includes a certain tract, piece or parcel of land located in the Town of Glenville, County of Schenectady and State of New York, referred to as “Eternity Heights Subdivision ‘Drainage District’”, more particularly bounded and described in Exhibit “A” annexed hereto and made a part hereof,
AND IT IS FURTHER
RESOLVED, that this resolution is subject to a permissive referendum. Within 10 days after the adoption of this resolution by the Town Board, the Town Clerk shall, as set forth in Town Law, post and publish a notice which shall set forth the date of the adoption of this resolution and contain an abstract of this resolution, concisely stating the purpose and effect thereof. Such notice shall specify that such resolution was adopted subject to a permissive referendum.

WHEREAS Section 284 of the Highway Law requires that money spent for the repair and improvement of highways in the Town be spent pursuant to a written agreement between the Highway Superintendent and the Town Board; and
WHEREAS the attached agreement has been approved by the Highway Superintendent and is in the form used by the Town for numerous years,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves entering into the attached contract with the Superintendent of Highways authorizing the expenditure of $846,217.00 for the repair [5110.0] and $158,550.00 for the improvement [5112.0] of highways, sluices, culverts and bridges having a span of less than five feet in the Town of Glenville.

WHEREAS, this Town Board has previously authorized the construction of sewer improvements within Extension No. 7 to Sewer District No. 9 of the Town of Glenville, commonly known as the Woodcrest Sewer Extension, and
WHEREAS, this Town Board has previously authorized the Commissioner of Public Works to advertise for bids in connection with the construction of the project, and
WHEREAS, sealed proposals were received and opened on April 28, 2009 at the Glenville Municipal Center, and
WHEREAS, the Commissioner of Public Works has reviewed the bids received and has recommended that the lowest bidder complying with the Town’s specifications be awarded the bid, and
WHEREAS, JAT Construction Co., Inc., P.O. Box 247 Selkirk, NY 12158 was the low bidder at a price of $174,786.00 and further agreed to a price reduction of $13,500.00 to be taken from the restoration line item, making the total contract price $161,286.00,
NOW, THEREFORE BE IT RESOLVED, that this Town Board acting as Commissioners for the Sewer District, does hereby authorize the Town Supervisor to enter into an agreement with JAT Construction Co., Inc., P.O. Box 247, Selkirk, NY 12158, for the construction of improvements within Extension No. 7 of Sewer District No. 9 commonly known as the Woodcrest Sewer Extension, pursuant to the bid specifications at a cost not to exceed $161,286.00.

WHEREAS, the Town of Glenville Town Board has previously authorized necessary police radio and public safety center communications enhancements which will require lease agreements with the owners of pre-existing communication towers;
WHEREAS, these communications towers sites were selected by the Towns’ Communications Consultant who was hired to oversee this project to ensure optimum performance of the police radio communications upgrade;
WHEREAS, the Town has entered into negotiations with the respective owners of the tower sites and prepared the attached proposed lease agreements which are summarized as follows:
--Scott E. and Mary R. Ennis, 2646 Water Road, Amsterdam, NY 12010 for a 5-year renewable lease at $1,000 per month for the first 12 months starting on the date of new equipment installation and $1,100 per month thereafter until January 1, 2012 and $1,200 per month for the remaining 5-year term. The lease shall renew automatically for a like term unless otherwise indicated per the agreement; and
--Hillside Venture LLC, 1301 Hillside Avenue, Niskayuna, NY 12309 (Water Tank and Land) for a 5-year renewable lease at $1,000 per month starting on the date of new equipment installation and adjusted on the first day of each yearly term to an amount equal to three percent (3%) of the monthly rent in effect prior to the adjustment date. This lease agreement can be extended for five successive 5-year periods.
--American Tower Asset Sub, LLC, 1243-55 Waters Road, Schenectady, NY 12302 (Pattersonville, NY) for a modification of the commencement date to the existing lease agreement to take effect for a 5-year renewable term on March 13, 2009 for $1,250 per month increased by the Annual escalator of 3% on the first anniversary of the Commencement Date of this Agreement and each anniversary of the Commencement Date thereafter during the Term. This lease agreement can be extended for four additional periods of 5 years each.
NOW, THEREFORE BE IT RESOLVED that based upon review of the proposed Lease Agreements, the Town Board hereby authorizes the Town Supervisor to sign the Lease Agreements on behalf of the Town for the terms and conditions identified.

WHEREAS, the addition of properties to the Town of Glenville’s portion of the Empire Zone requires an amendment to Chapter 128 (Empire Zone) of the Code of the Town of Glenville; and
WHEREAS, prior to taking action on this proposed amendment, the Glenville Town Board must conduct a public hearing;
NOW, THEREFORE, BE IT RESOLVED that the Town of Glenville Town Board hereby schedules a public hearing for Wednesday, July 15, 2009 at 7:00 p.m., or as shortly thereafter as possible, to consider amendments to Chapter 128 of the Code of the Town of Glenville (Empire Zone), constituting the addition of 22 acres to the Empire Zone within the Town of Glenville.

NOW, THEREFORE, BE IT RESOLVED that Richard LeClair, Commissioner of Public Works is authorized to hire three (3) Public Works Laborers (seasonal) at the budgeted rate of $8.00 per hour (no benefits) from 6/1/09– 8/31/09 as authorized within the 2009 Town Budget.

Town Administrator’s Report
Tony Germano – “At the last work shop meeting we had given you a medical insurance update, of course the NYS Budget was adopted and it does have an assessment and tax for any employer offered medical insurance premiums. We were notified by our insurance broker that a couple of our insurance providers had decided to raise their rates, one of which was mid-stream, they advised they were going to raise their rate in July even though the contract period begins in January. I understand that MVP has been persuaded by the NYS Department of Insurance not to raise their rates in July as a result the $6,000 increase to us we will not have to pay this year but I assure you that rate will go up probably in January.
CSEA, dental and vision have notified us that they will be raising their rates and I understand they do have the right to raise rates mid-stream and of course CDPHP Medicare Advantage they will also be raising their rates. Their rate is a little bit higher then the 4 or 5% that the provider is passing on to us because it is really a brand new program and they were trying to find out what the right price was so that is going up a whopping 130% plus or minus.
The net effect to the town for the remainder of this year is it looks like with all of these rate increases we are probably looking at a $25,000 increase in what we had planned for this year.
Our Alplaus shared services grant, the $579,000 grant between us, the Town of Clifton Park and the Glencliff School, it has cleared the division of budget. The State Department tells us that they have now vouchered it and when I talked to them a few weeks ago they had said the check for $579,000 or a major portion of it, there may be a 10% hold back, we should have in the town in about a month and a half. Hopefully we will have that money this fiscal year.
Once we get that money we do owe a portion of it to Clifton Park once they start their sewer project and they send us an appropriate bill indicating their expense we would then be able to make payment; the same thing with the school and the bottom line is this money would be used to offset debt for the Alplaus Sewer Project.”
New Business
Councilman Rosenberg asked to add the following items to the next work session’s agenda:
Union Contracts, higher rate to Town Residents that use Village Water.
The abolishment of the Office of the Receiver of Taxes was discussed as to whether the Board wanted to move forward or not. It was decided that it would be discussed at the next work session.
The Town of Glenville Town Board Meeting was adjourned at 8:50 pm.
