Present: Supervisor Frank X. Quinn, Councilmen Edward F. Rosenberg, Mark A. Quinn, Christopher A. Koetzle and Councilwoman Valerie M. DiGiandomenico
Absent: None
Supervisor Quinn called the meeting to order at 7:00 PM; Councilman Rosenberg gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Council Reports
Councilman Quinn – “The Park Planning Commission met yesterday and we reviewed the initial site-plan for Maalwyck Park and all of the improvements that are to be done there. Quite of few people from the Participation-In-Government Class from Scotia-Glenville showed up at our Park Planning Meeting which was very refreshing. When we discussed the skateboard parks and athletic fields they had some very valuable input.
We also talked about the archeological process and it looks to be an artifact rich area because at one time it may have been an Indian settlement.”
Councilman Koetzle – “The Small Business and Economic Development Committee is having it’s second in a series of small business meetings. This one regarding the Town Center Master Plan and Development is April 23rd at 7:30 am at the Glenville Queen Diner. All business owners are invited as well as all residents. The Glenville Business Association will provide coffee and other beverages for this meeting. Reservations are appreciated so we can plan; please call Mayfair Jewelers at 399-3701.
I would like to update you on the modified bulk item program. We sent out some RFP’s (Request for Proposals) and we received nothing back on this program that would make it worth while as far as affordability; $45,000 was the cheapest that came back. We were very fortunate in that process to have a local company (Meridian Construction Co.) come forward who really wanted to help the community and has come up with a program that we are very excited about. The modified plan, there would be a drop off point here at the Town Center. The owner who is here tonight is Ed Wierzbowski, has agreed to run the program four (4) consecutive Saturdays, starting on April 25th through May 16th from 7:00 am to
12:00 noon at the Glenville Municipal Center. The details will be posted on our web-site.”
Councilwoman DiGiandomenico – Reminded the residents that Grievance Day will be Tuesday, May 26th. She also read the following announcement:
NYS to eliminate STAR rebate check program. The NYS Executive Budget eliminated the 1.4 billion dollar STAR rebate check program. This is the program that provided a NYS rebate check to eligible homeowners and has no relation to an individual’s property tax bill. This rebate check program was based on income as well as age of the property owner and resulted in a rebate check of up to $450.00 last year.
Please note this does not affect your basic or enhanced STAR Program. The program names are similar but the programs are different. The basic and enhanced STAR Programs along with other exemption programs that reduce an eligible homeowners’ tax assessment for calculating school taxes remain in effect and have not been impacted by this state budget. Your usual STAR Program is still in effect.
Supervisor Quinn – “Item No. 5 on the agenda is a public hearing to hear all persons interested in a proposed local law to adopt a new Chapter 201 of the Code of the Town of Glenville, entitled “Telephone Directory Distribution.”
Supervisor Quinn opened the public hearing at 7:28 pm.
No one wished to speak; Supervisor Quinn closed the public hearing at 7:29 pm.

Supervisor’s Comments
Supervisor Quinn shared the following information:
March 19th – A private vendor visited us to discuss materials and provide information related to the possibility of the Town seeking enhanced internal auditing services.
March 24th – Attended the Local Government Council meeting in Albany. The discussion centered around, besides all of the different towns and villages and cities sharing ideas of what they are dealing with on the current agenda and in the future, this one focused on options or alternatives for managing appropriations and expenses given the current economic environment. What do you do and what are your options to manage taxes when the revenues are so flat.
March 25th – A team from the NYS Comptroller’s Office are reviewing our town policies and procedures related to on-line financial transactions. There concern and interest is the privacy of the citizen who uses this service being protected.
March 26th – Scotia’s Mayor Kastberg and Trustee Neals met with me and Tony regarding the next step for moving forward on the Fire Protections District #4 actions. That will be on the agenda for our work session on the 8th of this month.
March 26th – We attended the Alplaus Residents Association meeting.
March 27th – The Professional & Business People’s Association had a fundraiser for Sarah Sames at the Solid Surface’s facility on Freemans Bridge Road. They held an auction, provided food and beverages and they were able to raise $18,000.
April 2nd – Staff from Congressman Tonko’s office will be here along with Ray Gillen and we will be going down to the GSA property and inform them of what is going on so they can take any and all actions to help and support us to get that project done.”
Supervisor Quinn stated some information and facts that may not have been shared the night of the Alplaus Residents Association meeting or may have been stated in a way that weren’t necessary accurate. He went on to explain the inter-department charges relating to the Alplaus Sewer Project.
A discussion regarding this issue continued between the Board members and the Supervisor.
Supervisor Quinn moved ahead with the resolutions.
RESOLUTION NO. 74-2009

WHEREAS, the Town of Glenville Town Board is considering potential environmental impacts associated with construction of a 180-foot tall, lattice-style microwave tower on Church Road, the purpose of which is to enhance land mobile radio communications for the Town of Glenville Police Department; and
WHEREAS, the proposed tower, which would include three stabilizing guy wires, would be located to the rear (north) of the Town of Glenville water storage tank at the Town-owned property at 1086 Church Road; and
WHEREAS, prior to making a determination of environmental significance, per the State Environmental Quality Review Act (SEQRA), the Town Board desires to hold a public hearing to solicit input on potential environmental impacts associated with the proposed tower;
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby schedules a public hearing for Wednesday, April 15, 2009, at 7:30 p.m., or as shortly thereafter as possible, at the Town of Glenville Municipal Center, to consider comments on potential environmental impacts associated with the Town’s proposed 180-foot tall microwave tower at 1086 Church Road.

RESOLUTION NO. 75-2009

WHEREAS, the Town of Glenville is preparing a grant application for the RESTORE NY COMMUNITIES INITIATIVE for consideration by the Glenville Town Board and subsequent submission to the Empire State Development Corporation; and
WHEREAS, the Town Board desires to hold a public hearing to discuss the RESTORE NY application and the Property Assessment List prior to making a decision on approval of the RESTORE NY application for submission;
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby schedules a public hearing for Wednesday, April 15, 2009 at 7:30 p.m., at the Town of Glenville Municipal Center, to consider comments on the proposed RESTORE NY project and the Property Assessment List.

RESOLUTION NO. 76-2009

WHEREAS, a vacancy currently exists on the Town of Glenville Planning and Zoning Commission (PZC); and
WHEREAS, Cindy Gotobed, a Glenville resident, is interested in filling the vacancy on the PZC; and
WHEREAS, two individuals expressed interest in the vacant PZC position, both of whom were interviewed by Mike Carr, PZC Chairman and Town staff; and
WHEREAS, Ms. Gotobed possesses relevant experience for the PZC position, having been employed as an architectural designer and having served on the Rochester Environmental Conservation Commission,
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby appoints Cindy Gotobed of 228 Lake Hill Road, Burnt Hills (Town of Glenville), to the Town of Glenville Planning and Zoning Commission, effective immediately, with the term ending on December 31, 2015.

RESOLUTION NO. 77-2009

WHEREAS, the Town of Glenville Town Board is proposing a local law that would place restrictions on the delivery of telephone directories on private property and prohibit delivery on public properties, in addition to establishing a licensing process and fee for delivery of telephone directories; and
WHEREAS, this proposed local law constitutes an unlisted action in accordance with 6 NYCRR Part 617 (State Environmental Quality Review Act {SEQRA}); and
WHEREAS, the Glenville Town Board has assumed SEQRA Lead Agency for this action; and
WHEREAS, the Glenville Environmental Conservation Commission has recommended that the Town Board find no significant adverse environmental impacts associated with this proposed local law, and that the Board issue a SEQRA “Negative Declaration;”
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby determines that the proposed local law regulating the delivery of telephone directories will not result in a significant adverse environmental impact, and
BE IT FURTHER RESOLVED, that the Glenville Town Board hereby issues a SEQRA “Negative Declaration” (attached) for this action, based on the following findings:
· This action establishes regulations for the delivery of telephone directories. Consequently, this action does not result in any construction, land disturbance, or activities that could lead to an environmental impact.
· This action will not result in any adverse changes to air quality, ground or surface water quality, traffic levels or noise levels.
· There will be no removal or destruction of vegetation or fauna, nor any impacts on significant habitat areas as a result of this action.
· This action will not create a conflict with any Town-adopted plans or policies, nor will it be contrary to any adopted community goals or objectives.

RESOLUTION NO. 79-2009

WHEREAS, the Town of Glenville on April 4, 2007, after a duly held public hearing, approved the maximum amount to be expended on Glenville Alplaus Sewer District #1 and Sewer District #1 Extension #1 of $2,815,000.00; and
WHEREAS, the Town of Glenville has borrowed the funds necessary to complete the project by issuing debt to cover the costs of the project, and
WHEREAS, the outstanding debt balance of said funds may be refinanced through the Environmental Facilities Corporation; and
WHEREAS, said refinancing may be done for up to a period of probable usefulness of up to thirty years; and
WHEREAS, it appears to be in the best interest of the property owners within Alplaus Sewer District #1 and Sewer District #1 Extension #1 that the original period of probable usefulness of twenty years be extended to the allowable period of thirty years reducing the estimated cost per year of the project for residents,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves the re-financing of the Alplaus Sewer District #1 and Sewer District #1 Extension #1 project cost for a period not to exceed thirty years through the New York State Environmental Facilities Corporation at either a hardship non interest rate and/or a subsidized interest rate.

Discussion…
Councilman Rosenberg – “I can give you some background information and then possibly I guess I want to know whether or not we even have a consensus that we want to expend any resources on this across the board with some basic information.
As it was explained to me this grant only covers the base pay of a starting officer so if you hire someone who has experience at a different rate then the town would be responsible for that difference. You must keep how many officers you have, if you hire an additional officer you must keep that many officers on throughout the entire grant and for a full budget cycle after the grant expires. So if you hire somebody half way through the year that means you have to keep them on for 18 months and you are not reimbursed for those expenses.
Although I realize that we are not committing ourselves to hiring anybody else I am questioning whether or not we want to commit any resources to even doing the application.”
Councilman Quinn – “I can save you time at least with regard to my feelings on this. Although I have been a pretty consistent supporter of public safety and initiatives related to it, these types of grants, after they expire, end up being budget busters for a lot of municipalities. I’d rather hear a sensible, rationale coming from the department as to the need for an officer and the availability in our budget presently of having an officer. There is a history with these COPS Grants, some cities ended up really busting their budgets badly by taking advantage of these and three years later figuring out wow, now the taxpayers have to take care of all of this. I am going to be painfully honest with you, I don’t support this application.”
Supervisor Quinn – “He has articulated my points of view as well. I am prepared to go to a work session and if we want to have a special vote that night but I am also prepared tonight to say, no.”
RESOLUTION NO. 80-2009

WHEREAS funding has been made available under a competitive grant process through the U.S. Department of Justice under the Community Oriented Policing Services (COPS) Hiring Recovery Program, or “CHRP”, which provides funding to allow law enforcement agencies to hire/rehire officers in an attempt to create and preserve jobs, and
WHEREAS the program requires no matching funds to the grant, but requires that any officers hired with COPS CHRP funding must be retained for a minimum of one year following the three year funding period,
WHEREAS the Town of Glenville’s Board believes that it is in the best interest of the Town of Glenville and its citizens to apply for available funding, and approves submission of the application for funding under the 2009 COPS Hiring Recovery Program,
NOW THEREFORE BE IT RESOLVED that Frank X. Quinn, Supervisor of the Town of Glenville, is authorized execute all necessary documentation for the 2009 funding application under the CHRP program.
