Present: Supervisor Frank X. Quinn, Councilmen Edward F. Rosenberg, Mark A. Quinn, Christopher A. Koetzle
Absent: Councilwoman Valerie M. DiGiandomenico
Supervisor Quinn called the meeting to order at 7:00 PM; Councilman Quinn gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll.
Town Council Reports:
No reports this evening
Supervisor Quinn – “Item number 5 on the agenda is a public hearing to hear all persons interested in a proposed local law to amend Chapter 195, “Parks and Recreation”, regulating dogs in the town parks.
James MacFarland, Director of Parks and Recreation made the following comments:
1. Town has had regulations in place for many years relating to control of dogs and pets in the parks, stating that they must be confined to immediate area of owner, leashed/restrained, and animal waste must be picked up.
2. I’ve received email comments from DCO Trzeciak for the past two years or so indicating that he was concerned with dogs being allowed in various areas of the parks, including playground, pavilion and ball fields. The Town Board has also received comments from Mr. Trzeciak this year on the same subject.
3. Based on these comments, as well as some other issues relating to dogs in our parks, the Park Planning Commission considered the question of whether amendments should be made to the town’s ordinance, and after lengthy discussion at their April meeting generally agreed with the DCO’s recommendations.
4. These comments from the PPC favored further restrictions on places where dogs could be allowed within the parks, and were discussed earlier this year at a town board work session.
5. Issues that have been reported to me in the past few years pertaining to dogs in our parks have been predominantly dogs off leash and dog waste on youth sports playing fields.
6. Some of the impetus for looking at this now results from improved facilities at Indian Meadows Park which have created new spaces for dogs (and their owners) to go to in the park, and generally increasing usage by the public.
7. The language that is proposed in this ordinance is a result of the recommendations made by DCO Trzeciak which were added to by the PPC, which I finalized by adding specificity to the general recommendations.
8. Comments that I have received from the youth sports clubs representatives generally favor a ban on dogs being allowed on the youth sports playing fields, largely for reasons of dog waste not being removed.
9. Issues that I believe are relevant to this discussion include enforcement of our existing ordinance, public education and the draft master plan for the Andersen property now owned by the town that contemplates a dog park.
Supervisor Quinn opened the public hearing at 7:09 pm,
Mr. MacFarland – “I would like to submit a letter from Maryann F. Haskell, 41 Edmel Road, who is a regular user of the park and could not be here tonight, to the Town Clerk
.
“I don’t think I can make it tonight to the meeting. I support the changes to the code. However, what is really needed is enforcement of the code. Many people enjoy the park for walking their dogs and totally ignore the leash/cleanup after your pet ordinance. Thank you for all of your work and dedication to the parks of Glenville.”
No one wished to speak; Supervisor Quinn closed the public hearing at 7:10 pm.

Supervisor’s Comments:
Supervisor Quinn shared the following information:
November 24th – attended the Local Government Council meeting at the Center for Economic Growth. The presenters at that meeting were interesting because they are the key people involved in the NYS Retirement Fund. They gave us a briefing on the status of the NYS Retirement Fund which took a big hit in the stock market for the last year so their assets are way down. The prediction is that because of that and the number of people drawing on it, it is sufficiently large and keeps growing each day. Their prediction is that if not for the coming year certainly the year after it will be a double digit increase in contributions to this fund.
December 1st – I attended the Schenectady County Military Affairs Council meeting and we talked about some issues. I will be flying down to Washington, D.C. to talk to the Senator’s and Congressmen from our area about the 109th and its mission. The 109th has a mission to support Afghanistan and Iraq, which they do and they go over there on a regular basis, sometimes just personnel deployment, sometimes aircraft and sometimes both. Also five years ago there was a recommendation for some closings and they were on the list and once you make the list you are always on the list. It is not for sure that there will be a base closing survey in the coming year but what we are doing is
making sure that we keep the 109th in front of everybody. They have 1,200 personnel working there with a 123 million dollar budget.
December 8th I will be working with the State Association of Towns and the State Comptroller. There is a training telecast for newly elected officials.”
Supervisor Quinn moved ahead with the agenda items.
RESOLUTION NO. 170-2009

WHEREAS the Town of Glenville operates a Section 8 Housing Choice Voucher Program funded by the U.S. Department of Housing and Urban Development; and
WHEREAS the Town of Glenville is required by the U.S. Department of Housing and Urban Development to prepare and adopt a written Annual Plan that establishes local policies for administration of the Section 8 Housing Choice Voucher Program in accordance with regulations of the U.S. Department of Housing and Urban Development; and
WHEREAS a public hearing is required to be held on said plan,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville will hold a public hearing on January 20, 2010, at 7:00 p.m., at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY for the purpose of receiving comments from the public on the proposed Agency Plan for 2010 for the Section 8 Housing Choice Voucher Program. and
BE IT FURTHER RESOLVED that the Town Clerk is hereby directed and authorized to publish a notice of this public hearing in the Daily Gazette at least forty-five days prior to the date of the hearing.

WHEREAS, the Town of Glenville has previously authorized the construction of a sewer project commonly known as the Woodcrest Sewer Project, and
WHEREAS, it has been necessary to obtain easements and agreements for the placement of grinder pumps and other appurtenances,
NOW, THEREFORE, BE IT RESOLVED that the Glenville Town Board, acting as commissioners of the Sewer District, does hereby accept the following easements and/or agreements to be utilized in connection with the construction and maintenance of the Woodcrest Sewer Project improvements:

Town Administrator’s Report:
Tony Germano – “You all recall that we were fortunate to receive a grant from the NYPA for a sum of $100,000 and this is the “Go Green” for Glenville. The grant will fund the installation of a solar initiative on one of our facilities. Last month, under the authority of the Board, we issued a request for proposals. I am pleased to say we have received 8 or 9 really solid proposals from an array of companies. We put a team in place, we reviewed the proposals and we’re very close to making a recommendation, probably by the end of the week as to who would be awarded the bid.
The design obviously is to place a device on one of our four facilities, here, the Senior Center, the Highway Garage or the Water Plant and as a result of using solar energy we would be able to save money from purchasing and using power off of the grid. There is a rather long payback for this grant but the NYPA is really investing in the future of solar energy and in Glenville so it is a great opportunity. We are hopeful to award the bid sometime later this week and the actual work will need to be completed by July and there may be some other opportunities for us to add on to this grant. We are pleased with the caliber of proposals that we received, they are all very solid and as I said we should have a vendor selected by the end
of the week.”
New Business:
Councilman Quinn – “Just a quick comment regarding the dog regulations. We’ve heard a variety of discussion about increasing enforcement in our current code and getting better enforcement in terms of hours and what not and enhancing the regulations giving it more teeth. I think we could do both; just a little food for thought.”
RESOLUTION NO. 173-2009

One of the purposes of the meeting was to take action in connection with the filing of the Petition for a proposed extension to SEWER DISTRICT NO. 2, as set forth in said Petition for the construction of a sewer system in said District, together with the necessary costs and expenses at a cost to be paid by the petitioner.
The petition, map and plan are filed with the Town Clerk and have been presented to the Board. The Petition is accompanied by a Certificate from the Assessor to the effect that it has been signed by owners of taxable real property situated in the proposed Extension and that they own in the aggregate at least one-half of the assessed valuation of all the taxable real property of the said proposed Extension as shown upon the latest completed Assessment Roll of the Town of Glenville. Said Petition also contains the signatures of resident owners owning taxable real property aggregating at least one-half of the assessed valuation of all the taxable real property of the proposed Extension owned by the resident owners according to the latest completed Assessment Roll of the Town of
Glenville.
WHEREAS, a petition, map and plan have been duly filed with the Town Board in connection with the proposed establishment of an Extension to Sewer District No. 2, and to include the following described real property bounded and described in a parcel as set forth in an attachment hereto and made a part hereof known and designated “Utility Plan, (2) 8 unit Apartment Buildings, 211 Sacandaga Road”, being Exhibit "A", and
WHEREAS, said petition, map and plan call for the construction of a sewer system therein as shown on said map and plan, together with all necessary work, including legal and engineering expenses and such other lawful disbursements in connection therewith, at a total cost to be paid by the petitioner, and
WHEREAS, it becomes necessary to conduct a public hearing in connection therewith,
NOW THEREFORE, the Town Board of the Town of Glenville hereby gives notice that this Board will meet on the 16th day of December, 2009, at 7:00 o'clock, P.M., at the Glenville Municipal Center, 18 Glenridge Road, in said Town for the purpose of considering said petition and the relief asked for.
All persons interested in the subject matter are hereby notified that they will be given ample opportunity to be heard either in favor of the said proposed established Extension and the construction of the improvement therein at a cost to be paid for by the developer, and
IT IS FURTHER,
ORDERED, that a copy of this Order, certified by the Town Clerk, be published once in the DAILY GAZETTE, the first publication to be not less than ten (10) days, nor more than twenty (20) days before the date set for the said hearing; and that the Town Clerk shall also cause a certified copy thereof to be posted on the signboard of the Town, maintained pursuant to Subdivision 6 of Section 30 of the Town Law, not less than ten (10) nor more than twenty (20) days before the day designated for the hearing as aforesaid.
