Present: Supervisor Frank X. Quinn, Councilmen Edward F. Rosenberg, Mark A. Quinn, Christopher A. Koetzle and Councilwoman Valerie M. DiGiandomenico
Absent: None
Supervisor Quinn called the meeting to order at 7:00 PM; gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Council Reports:
Councilman Rosenberg informed the Board that there was a ribbon cutting ceremony in the Village today. He welcomed the “Espresso Therapy”, a coffee shop located at 127 Mohawk Avenue.
The following people exercised the Privilege of the Floor:
Christina Darkangelo-Wood stated that she is a resident of Glenville and spoke about Fire Protection District No. 4. She stated that she is very satisfied with the coverage that she gets from the Scotia Fire Department; she further stated that their response time is very quick which is really important to her because she has a 5 year child. She also stated that she works in Fire Protection District 4 as a chemistry teacher at the S-G High School. She said that it is very comforting to know if we have an emergency in school or in the chemistry lab that we have special firefighters on call to come and help.
Mike Schermerhorn read a written statement regarding Fire Protection District No. 4.
He reminded the Board that this was not the first time that he has come before them to address this important health and safety issue. He spoke to the Board in December of 2004 and again in March of 2009.
He stated that he struggles to understand why the Board is considering any option other than continuing our arrangement with the Scotia Fire Department. Mr. Schermerhorn reminded the Board that in December of 2004 a majority of the residents and business owners that spoke supported the Scotia Fire Department and in March of 2009 the over whelming majority of those in attendance at the public meeting also spoke in favor of the Scotia Fire Department and asked you, our elected officials, to continue the contract with the Village of Scotia. He reminded the Board that he supplied them with figures and facts at that time to support his desire to continue with the current arrangement. He reminded the Board that at the end of the
March meeting some of them made strong supportive closing statements. He stated that he felt good at the end of the meeting and that he was proud of all of the board members for taking the time to listen.
Mr. Schermerhorn reminded the Board of a questionnaire that was sent to residents some years ago and a property owner survey form that was distributed at the March 12, 2009 meeting. He further stated that he never heard what the final facts were but he believes that they would reflect the wishes of those in attendance at the meetings.
He stated that the11 notice that was advertised for the March 12th meeting said “Meeting Purpose – to provide information and obtain public input for enhanced fire protection for those serviced by Fire Protection District No. 4; opportunity for residents and business owners/operators to exchange information and comment on options to improve the current Fire Protection District No. 4 boundary line, review the current fire protection taxpayer cost and discuss options for creating a board of fire commissioners for that district.
Mr. Schermerhorn again reminded the Board that the overwhelming majority in attendance at the March 12th meeting asked that things stay the way they were.
Mr. Schermerhorn stated that this Town Board has provided years of service to the Town of Glenville. He stated that some of them were ending their years of service and others are continuing or beginning their service.
Mr. Schermerhorn finalized his comments with the following statement¨ “I feel it would be disrespectful to the incoming administration and unfair to the residents that are serviced in Fire Protection District No. 4 for you to vote and change a long standing successful relationship now.” He asked the Board to extend the original contract with the Village of Scotia for one more year in order for the new administration to have time to review the current contract and decide what action is necessary. He asked the Board to not make a mistake; the Scotia Fire Department and only them can provide the service that those in District #4 deserve and he asked the Board not to jeopardize the safety of his family and his neighbor’s families.
Supervisor’s Comments:
Supervisor Quinn shared the following information:
November 8th – attended a Veterans Celebration at the Senior Center
November 11th – attended the annual Veterans Day Ceremony at the Veterans Park located near Thomas Corners Fire Department
November 24th – I will be attending the Local Government Council, where the various elected town officials participate and share thoughts and ideas on items of importance to all of us
On December 3rd and 4th I will be going with the Chamber of Commerce to Washington, D.C. This is part of the Schenectady Military Affairs Council and we go down and lobby the Senators and the Congressmen and the Department of Defense and the National Science Foundation which is one of the major missions for the 109th, about keeping the 109th here at Stratton Base and also making sure that they get the allocations needed so they can carry out their missions.
Supervisor Quinn explained the October year to date report; just to highlight a couple of items. Revenue wise we are about $713,000 or 7% over budget on the revenue side except the $556,000 is the FEMA money.
On the expense side we are under about $541,000 or 4.7% of the budget. $454,000 of that is because the health insurance expenses weren’t what we thought they would be this time last year. If we back out the health insurance difference all the other lines in the budget for health insurance for all the different departments and staff we would only be 8/10th of 1% under budget so there are actually two lines in the budget, one in revenue and one in expenses that are statistically significant. If these numbers hold, what we are over in revenue and what we are under in expenses, it could put about 1 million dollars back into the fund balance to actually replace the 1.1 million dollars we put in to the 2009 budget.”

A RESOLUTION adopting the assessment roll for Water District No. 11 of the Town of Glenville, Schenectady County, New York and the assessment roll for Extensions No. 1 through 35 of said Water District.
WHEREAS, on November 4, 2009 the Town Board of the Town of Glenville adopted a preliminary capital expense budget for Water District No. 11 of the Town of Glenville and Extensions Nos. 1 through 35 of said Water District; and
WHEREAS, assessment rolls have been prepared by the Water Commissioners of Water District No. 11, Town of Glenville, Schenectady County, New York based upon said preliminary capital expense budget for and in connection with said Water District; and
WHEREAS, said assessment rolls were completed and filed in the office of the Town Clerk of said Town on June 1, 2009; and
WHEREAS, due notice of the completion of said assessment rolls and of the time and place when and where this Town Board would meet to hear and to consider any objections that might be made to said rolls was duly given by the Town Clerk by the publication of due notice thereof in The Daily Gazette, a newspaper published in the County of Schenectady and circulated in the Town of Glenville, and this Town Board duly met at the time and place specified and a hearing was duly had upon said assessment rolls,

WHEREAS, the 2010 Preliminary Budget of the Town of Glenville has heretofore been filed with the Town Clerk on October 21, 2009,
NOW, THEREFORE, BE IT RESOLVED that the 2010 Preliminary Budget is amended for the 2010 Final Adopted Budget of the Town of Glenville by the changed items noted with an asterisk; and
BE IT FURTHER RESOLVED that Appropriations are increased by $6,500 principally due to Fire District #5 & #9; and
BE IT FURTHER RESOLVED that Tax Levy is increased by $6,500 principally due to the above Fire District #5 & 9.

Councilman Koetzle – “I have a question and it relates to the second to last page in the budget, CEI Charge, perhaps I am reading it incorrectly but I thought we had a discussion that we were planning on no raises for 2010 but it appears we are basing our CEI charges on a 3% raise over the ’09 salary for those people listed in the document and I wasn’t sure if that was going to be removed.”
Tony Germano, Town Administrator – “That number does indicate a raise, that was the formula that was submitted to the Board for consideration with the budget there is no increase in the CEI departmental charge over last year. What we were doing is basically coming up with a distribution formula that would be able to live on if there were raises but the amount of money in the budget this year there will be no change from last year’s budget.”
Councilman Koetzle – “There’s no change in dollar amount but there is a change in distribution from…
Mr. Germano – “The change in distribution, which really means for an average tax payer that they were paying a little over $100 last year, everybody will be paying $56 this year.”
Councilman Koetzle – “Right, but the numbers we are using for example the highway superintendent $85,134 but as it stands now his salary will remain $82,654.”
Mr. Germano – “That’s correct”
Councilman Koetzle – “So it really should be 3% less than what?”
Mr. Germano – “The $149,197 is 3% higher than what is actually in the budget, there is no change from what was in the budget last year to this year.”
Councilman Koetzle – “The $149,197 is 3% higher than what is in the budget. Maybe I am missing something but it seems like it should be 3% lower than what we are saying it is here.”
Mr. Germano – “It should be the same as what’s in the budget from last year, no raise at all for any employee.”
Councilman Koetzle – “So why does this page show a 3% raise?”
Mr. Germano – “Because when this distribution formula was presented it was done early on in the process and at that point we were in anticipation that there could be employee raises but once you approved the Preliminary Budget then we went ahead and made the adjustment.”

WHEREAS, the 2010 Preliminary Budget of the Town of Glenville has heretofore been filed with the Town Clerk on October 21, 2009; and
WHEREAS, a duly public hearing was held on November 4, 2009, to hear all persons in favor of or against the Preliminary Budget as compiled for or against any item or items therein contained, and
WHEREAS, the Preliminary Budget has been amended,
NOW, THEREFORE, BE IT RESOLVED that said amended Preliminary Budget be and it hereby is adopted as the Final Budget of the Town of Glenville for the fiscal year commencing January 01, 2010, and
BE IT FURTHER RESOLVED that said adopted budget shall be spread upon the minutes of this Town Board Meeting, in its entirety.

WHEREAS, the U.S. Post Office located on Mohawk Avenue in the Village of Scotia was opened in the 1930’s and continues to provide necessary services to some 8,000 Village residents as well as surrounding areas in the Town of Glenville;
WHEREAS, the U.S. Postal Service announced that it was considering closing the Scotia Post Office as a means of consolidating and reducing postal services;
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board urges the United States Postal Service to reconsider its proposal to close or consolidate the Scotia Post Office since it continues to provide vital and essential services to the community;

WHEREAS, the Superintendent of Highway requests the reimbursement to these lines to support the 2009 Leaf Program and Snow/Ice Operations; and

RESOLUTION NO. 169-2009

WHEREAS, amendments to the Town of Glenville’s local laws require a public hearing, and
WHEREAS, amendments to the town’s local laws regulating dogs in parks are being considered,
NOW, THEREFORE, BE IT RESOLVED, that a public hearing shall be held on Wednesday, December 2, 2009, at 7:00 pm, or as soon thereafter as can be reached, to hear all persons interested in commenting on revisions to the town’s local law regulating dogs in the parks as follows:
Chapter 195, Article II, Section 17 (195-17) – add the following language:
Dogs shall be restricted from the following areas within the parks: Playgrounds (within the defined playground boundary); basketball courts, tennis courts, interiors of all buildings (including pavilions), and sports playing fields, such as baseball, softball, soccer, and football (playing fields being defined as that area inside the fencing that encompasses the field area, or lines that define the playing surface). These restrictions do not apply to service dogs (animals) trained to assist disabled persons and whose presence is reasonably necessary.

Councilman Rosenberg – “On the Town Justice report again this month as of October fines collected totaled $476,000 versus $391,000 this same time last year.”
Supervisor Quinn – “We have an annual year-end reconciliation meeting to close the books out at year end. We are proposing the 28th of December at 4:00 pm. Please let our Town Administrator know if this is a good time and if not let him know what is good for you.
Because there is a contract involved in Fire Protection District No. 4 we will have a public hearing in December for those services. The awarding of the contract involves $370,000 so there has to be a public hearing.”
The Town of Glenville Town Board Meeting was adjourned at 7:45 pm.
