Present:        Supervisor Frank X. Quinn, Councilmen, Robert E. Bailey, Mark A. Quinn, Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico

Absent: None

                Supervisor Quinn called the meeting to order at 7:30 PM.  Councilman Bailey gave the Invocation and led us in the Pledge of Allegiance.

                Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll.  Everyone was present and accounted for.

Town Council Reports:

                Councilman Quinn – “I met with the Public Safety Committee last week and a member of the Beukendaal Fire Department was kind enough to come and tell us about a very valid legal concern.  Much of the Scotia Industrial Park lies within their fire district, however many property owners have contracted with Scotia Fire District to respond as well.  Beukendaal has a very legitimate concern that should something go wrong down there that they would be held partially liable so it is my hope when our Town Attorney returns we need to discuss this issue and perhaps entertain a hold harmless clause to that effect.”

                Supervisor Quinn – “Please make sure that gets into the attorney’s mail box.”

                Councilman Rosenberg – “We currently decided to change our Board of Assessment Review from a three (3) person panel to five (5), which leaves us two (2) new openings.

                The BAR members have to meet from 9:00 am – 5:00 pm and 6:00 pm – 9:00 pm on grievance day which is always the fourth Tuesday in May and are paid one hundred dollars ($100) for the day and they also meet at their own schedule to review and actually make decisions on grievances and for that they are paid twenty-five dollars ($25.00) an hour for their deliberations.  The number of days depends on how many grievances are filed.  Last year with our total re-val we had 725 grievances, 98 hours of deliberations through the end of May and into June.  The year before when we didn’t have our re-val there were 53 grievances and they only got together for 11 hours.

                If anybody is interested they can drop off a resume or a letter of interest to the Town to my attention and I would like to have those by the middle of April.”

                Councilwoman DiGiandomenico – “I have an update on the Alplaus proposals that will increase, improve and enlarge the facilities for the existing Alplaus Sewer District No. 1 within the Alplaus Hamlet area.

                The Part 85 Sewer Application to the State Comptroller is on schedule with all of the departments completing their sections to date.  On tonight’s agenda we have a resolution scheduling a public hearing for April 4th, also the Board has been invited to attend the Alplaus Annual Meeting tomorrow night, March 22nd, where I will be distributing copies of the schedule for them.”

                The following people exercised the Privilege of the Floor:

                Roger Harrison, President of the CSEA Unit in the Town of Glenville – “I am here tonight along with my fellow CSEA members to remind the Town Board that it’s been nearly a year and a half since our contract has expired.

                Throughout this time we have continued to provide services that the residents and the tax payers in the Town of Glenville need.  I know that the membership, our negotiating team and I are anxious to enter into a new agreement and will be ready to do so when negotiations resume.  We are hopeful that the Town and its negotiating team are just as eager to reach a new agreement.”

Supervisor’s Comments:

                Supervisor Quinn – “A point of clarification in case some people didn’t catch it either from mass media or from any other source.  The Board has decided that there will be no re-evaluation re-assessment done in the year 2007.  Just so all of us have the record and the record is straight.

                I would like to share some of the activities that I have been involved in during the last week and this upcoming week.

                On Monday the 12th I met with Congressman McNulty and a couple of his staff members and we discussed three major projects; one, the Alplaus Sewer District and the Congressman agreed and we submitted items for maybe his member item from the Federal level to see if they could be of financial assistance.

                While there in the office we talked over what it is that the Congressman’s Office could be doing to help move along the GSA (Government Supply Agency) Route 5 Industrial Park properties.  NYS DEC has conducted their technical review.  It went to the DEC of the Feds and the EPA of the Feds for their comments because it is federal lands.  It has been tied up in the office down in NYC which is the regional office and could they help us move that along.  They agreed they would and I got an e-mail that says that it is off the desk.  Once that is done and we get it back we can move to the next step in this long argues process and the next step is to do a feasibility study about the site and determine what the particular negative aspects of the site could be.

                At the same time while I was there, we know in the Town if you have been following that the road extension for the proposed development from NY Developers (Patriot Square) that would run along side of this building and come out through Schenectady County Airport.  That road extension has been waiting for comments from the FAA.  The FAA has not moved on that one and so allegedly through the Congressman’s Office they moved it up to the top of the pile.  How soon we are going to hear from that I can’t tell you but the County Airport and the FAA has a say in what can happen with some of the properties and so hopefully we will hear on that one soon.

                On Tuesday the 13th I had a meeting with Dave Hennessy, Chairman of the Consortium that is dealing with the Homeland Security project on Route 5.  He has the proposed lease from us; they’re trying to lease the property from us and what is a fair price for that lease, so what we did was we took the fair value of the property as it stands and said if they pay their taxes (general, town and outside highway) based on that assessed value that would be approximately $520 and then as they build the facility then as they add value to the property then we would adjust that for each of the years as they did their construction and made it more functional and operational.  He has all of that information, so they pay that in taxes plus the usual utilities and anything else that any renting person would do.

                On Wednesday the 14th I had a meeting with the staff of the Schenectady/Glenville Empire Zone.  They have redone the policies and procedures of that zone and so I was going over the draft, what’s in there, what recommendations and changes, so that was the purpose of that meeting.

                On Thursday the 15th I had a meeting with the representative of C.T. Male and explored pros and cons of value engineering and how it would or could relate to the Alplaus Sewer District.

                On Thursday the 15th at 7:00 pm at the Senior Citizens Center there was a briefing with questions and answers on Conservation Agreements.  If somebody wants to conserve their land for perpetuity and how do they do that and what are the procedures.  One of the interesting things is if they want to do that, it is a legal process and legal documents get filled out to the needs and values of the individuals involved and traditionally it has been done with the Conservancy Agency.  We could do this at the Town; the Town could serve as the conservatory and so Clifton Park already does this and I am trying to get out of them how do they go about doing this.  The biggest problem at least from the sixty or seventy people that were in the room that night was – okay I sign over my land for perpetuity sake I still have it and I still control but at some point I give it up and now the conservancy has it but each year your property value could be going up and therefore our school taxes, town taxes and county taxes are going up.  So people who might have something but not a lot of money are concerned if they turn this over and they still have to keep paying all the property taxes but I am not necessarily gaining; the property value’s going up am I going to benefit from this but there’s a cost if I have to keep paying the taxes, taxes, taxes.  As soon as I can get some more information you will all get a copy.

                Yesterday I had a meeting with the Capital Region Local Government Council and we reviewed various economic development projects that are going on in the seven county area.  Their concern and next month we will get a report, they have been doing research and data collection on what are the infrastructures in locations of these kinds of economic projects.  They are approaching it not only individually but for the region.  Water lines, sewer lines, buildings and roads, all of the things that we would be involved in, so they have taken some case studies and they collected the data from other towns, if A & D comes to town (over in Luther Forest where it is proposed) what’s the potential impact on the other towns.

                This morning at 7:30 I was at a meeting again with the Schenectady/Glenville Economic Development Zone.  We reviewed about eight (8) different proposals, applications for different business that want to be certified.  We voted six (6) of the eight (8) in, two (2) needed more information.

                Tomorrow evening is the Alplaus Residents Association’s Annual Meeting and we have all been invited to attend.  If you are not going to make it and you would like me to make comments that you want me to submit get them to me or Councilwoman DiGiandomenico and we will get them up on the table tomorrow night.

                On Friday at 9:00 AM, I have a meeting with another engineering firm to discuss value engineering.  We have a couple of inputs on this subject so let’s see how it applies not only to Alplaus but for the future.

                On Wednesday the 28th there is a demonstration, for any of us and anybody in the audience who would like to go, of the potential voting machines.  At the County Board of Elections on Broadway they will have different machines for people to stop by and check them out, use them and tell them what you think of the machines.  This is their way of surveying the community.

                On Thursday the 29th there will be a press conference at the 109th Air Wing by the Schenectady Military Affairs Council.  I am the representative for the Town of Glenville to that Council so I will be at that meeting.”

                Councilman Quinn – “Mr. Supervisor, would you be kind enough to give me a copy of that graduated lease plan for the Public Safety Training Facility?

                That is a very reasonable first year level of rent in my opinion and that will relieve a lot of the folks on the Public Safety Committee.”

                Supervisor Quinn continued with the agenda items.

Discussion…

                Supervisor Quinn – “This is being done so that each of the five towns and the city, the County Legislature all go forth to the State who controls this regulation and law so that we are all in sync in going forth to get the state law changed and we are in compliance all the way through with everything.”

RESOLUTION NO. 82-2007

                WHEREAS, I am introducing a Local Law to amend Chapter 270, “Zoning” Article VII Intermunicipal Watershed Rules and Regulations of the Code of the Town of Glenville; and

                WHEREAS, a duly scheduled public hearing must be held in order to change such a law,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville will meet at the Glenville Municipal Center on Wednesday, April 4, 2007 at 7:30 P.M., or as soon thereafter as can be reached, at which time and place will hear all persons interested in a proposed local law to amend Chapter 270, “Zoning” Article VII Intermunicipal Watershed Rules and Regulations of the Code of the Town of Glenville; and

                BE IT FURTHER RESOLVED that the Town Clerk be, and she hereby is directed to prepare the proper notice of said hearing in accordance with law.

RESOLUTION NO. 83-2007

        The meeting was duly called to order by the Supervisor.

        One of the purposes of the meeting was to take action in connection with the filing of the Petition for an extension to be known as EXTENSION NO. 6 to SEWER DISTRICT NO. 9, as set forth in said Petition for the construction of a sewer system in said District, together with the necessary costs and expenses to be paid by the petitioner.

                WHEREAS, the petition, map and plan are filed with the Town Clerk and have been presented to the Board.  The Petition is accompanied by a Certificate from the Assessor to the effect that it has been signed by owners of taxable real property situated in the proposed Extension and that they own in the aggregate at least one-half of the assessed valuation of all the taxable real property of the said proposed Extension as shown upon the latest completed Assessment Roll of the Town of Glenville.  Said Petition also contains the signatures of resident owners owning taxable real property aggregating at least one-half of the assessed valuation of all the taxable real property of the proposed Extension owned by the resident owners according to the latest completed Assessment Roll of the Town of Glenville.

                WHEREAS, a petition, map and plan have been duly filed with the Town Board in connection with the proposed establishment of an Extension to Sewer District No. 9, to be known as EXTENSION NO. 6 to SEWER DISTRICT NO. 9, and to include the following described real property bounded and described in a parcel as set forth in an attachment hereto and made a part hereof, being Exhibit "A", and

                WHEREAS, said petition, map and plan call for the construction of a sewer system therein as shown on said map and plan, together with all necessary work, including legal and engineering expenses and such other lawful disbursements in connection therewith, to be paid by the petitioner, and

                WHEREAS, it becomes necessary to conduct a public hearing in connection therewith,

                NOW THEREFORE, the Town Board of the Town of Glenville hereby gives notice that this Board will meet on the 4th day of April, 2007, at 7:30 o'clock, P.M., at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York for the purpose of considering said petition and the relief asked for.

        The meeting was duly called to order by the Supervisor.

        One of the purposes of the meeting was to take action in connection with the filing of a Petition requesting the establishment of a Drainage District to be known as Drainage District No. 8 of the Town of Glenville for the purpose of, among other things, providing maintenance of the drainage retention areas and other drainage facilities within the subject Drainage District, together with the necessary costs and expenses.  

                WHEREAS, the petition, map and plan were filed with the Town Clerk and presented to the Board.  The Petition is accompanied by a Certificate from the Assessor to the effect that it has been signed by the owner of taxable real property situated in the proposed District and that he owns in the aggregate of at least one-half of the assessed valuation of all the taxable real property of the said proposed District as shown upon the latest completed Assessment Roll of the Town of Glenville.  Said Petition also  contains the signature of the resident owner owning taxable real property aggregating at least one-half of the assessed valuation of all the taxable real property of the proposed District owned by the resident owner according to the latest completed Assessment Roll of the Town of Glenville.

                WHEREAS, a zoning map amendment application has been submitted by John and Patricia Pardi to change the zoning of their property at 3441 Amsterdam Road (tax map # 20.16.-1-5) from Professional/Residential to Community Business; and

                WHEREAS, the purpose of the zoning map amendment is to make the zoning of this property consistent with the zoning of the adjacent property to the southeast, which is also owned by John and Patricia Pardi, and to allow the Pardis to reasonably market their commercial building (Clark and Brown Furniture) at 3441 Amsterdam Road; and  

                WHEREAS, pursuant to New York State Town Law, zoning map amendment applications require a public hearing on the part of the Town Board;

                NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby schedules a public hearing for Wednesday, April 4, 2007 at 7:30 p.m., or as shortly thereafter as possible, at the Town of Glenville Municipal Center, to consider comments on the proposed rezoning application by John and Patricia Pardi for their property located at 3441 Amsterdam Road.

Discussion…

                Councilman Bailey – “We initially started a project in Alplaus some time ago but we ran into a money problem.  The cost when the bids came in exceeded what the project had been estimated at.  Once that happened we had to go back and basically start over.  That process was commenced by the residents of Alplaus who ran another petition and again they got over 50% of the signatures that were needed.  The project cost that we are looking at now is $2,815,000.00 and on a per single family home basis we are advertising that it would come out to be $904.00 per year.  There are some things that we are looking at that will hopefully reduce that cost and we intend to drive it down as much as possible.”

                Supervisor Quinn – “You heard me say during my comments to the Board that Congressman McNulty has got our request on this one into the queue.  So that means Congressman McNulty, Senator Farley and Assemblyman Jim Tedisco all have this in the queue, which may, we will see whether it makes it through budgets in the near future.  All of those besides some other things that are working may help to drive the per unit cost of this thing down.”

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the town of Glenville adopts the following order:

ORDER

Please take notice that the Town Board of the Town of Glenville will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY on Wednesday the 4th day of April, 2007 at 7:30 PM and on said date; and at such place, will hear all persons interested on the proposed increase and improvement of facilities for the existing Alplaus Sewer District, consisting of installing pipes, manholes, and pumping stations to eliminate operation of the existing wastewater treatment facilities serving said Alplaus Sewer District No. 1 and also the Rivercrest Sewer District, Town of Clifton Park; and to connect to the facilities of the Town of Glenville Sewer District No. 9 for conveyance of the wastewater to the City of Schenectady for treatment; and to also enlarge the sewer service area within the Alplaus hamlet area by the extension of new sewer pipes and manholes and pumping stations to the remaining populated section of Alplaus Hamlet, consisting of Extension No. 1 to the Alplaus Sewer District No. 1.

1.      A petition to extend the Alplaus Sewer District No. 1 was filed with the Town Board.  A previous public hearing on all of these matters was held on July 21, 2004.  Subsequently the Town Board passed resolutions to establish Extension No. 1 and to increase and improve the facilities of Alplaus Sewer District No. 1. This will be a single unified project.  A second Public Hearing was held on September 21, 2005 to be certain that all interested parties had been given notice and an opportunity to be heard.  A third Public Hearing was held on April 28, 2006 in order to complete the review required by the State Environmental Quality Review Act (SEQRA). A second petition was duly presented to the Town Board authorizing an increase in the maximum amount to be expended to establish the district extension. A further Public Hearing is being held at this time authorizing an increase of the maximum amount to be expended for the establishment of the district extension.  
 
2.      The real properties to be affected directly by the termination of operation of the Alplaus Wastewater Treatment Plant are those properties currently served by the existing sewers in Alplaus Sewer District No. 1, Town of Glenville, and by the existing sewers in the Rivercrest Sewer District, Town of Clifton Park.  These properties are those described by the map, section and block numbers as identified on the Schenectady County Real Property Tax Service Agency Tax Maps for the Alplaus Sewer District No. 1, which are as follows:

along with such lands as are utilized by the Town of Clifton Park for the routing of their sewer lines and facilities.

3.      The proposed construction of the interceptor sewers from the existing Alplaus Wastewater Treatment Plant to the existing Sewer District 9 facilities makes the extension of sanitary sewers feasible for the presently unsewered portion of the Alplaus Hamlet, generally described as the area west and north of the existing sewered area, being north of the Mohawk River, east of the Delaware and Hudson Railroad, and south of Glenridge Road.  These properties are further described by the map, section and block numbers as identified on the Schenectady County Real Property Tax Service Agency Tax Maps as listed below, as the Extension No. 1 to Alplaus Sewer District No. 1.

4.      The maximum amount that is proposed to be expended for the total project is $2,815,000.00.  This cost is apportioned as follows between the three groups proposed to be served by the project :

5.      The inter-municipal agreement between the Town of Glenville and Town of Clifton Park includes provisions that Rivercrest Sewer District residents be assessed and charged on an equal basis as Alplaus Sewer District residents, in any future improvements as Rivercrest did replace a portion of the Alplaus sewer lines at the time of their connection to the system.

6.      The costs of the project are proposed to be financed by the Town of Glenville by the issuance of bonds for a 30 year term.  Annual debt service costs shall be recovered from the properties served by or benefited by the project on the basis of the parcel’s flow contribution in comparison to the flow contribution of an average single family home, to be called a service unit.  As an example, a two family home would be considered as two service units, one per household.  In addition to the debt service cost, there would be an annual cost for wastewater treatment by the City of Schenectady, and an annual cost for the operation and maintenance of the Alplaus System, and the conveyance of the wastewater in the Sewer District 9 facilities to Schenectady.  The debt service cost is dependent upon the interest rate of the bond issue.  Several rates are presented below to demonstrate the range.  The Town of Glenville historically has had very good bond ratings and these rates shown are expected to include the final rate to be obtained at this time.

Debt service annual costs will vary with the number of service units assessed each year.  Typically service areas add units through new construction.  When the debt is retired at the end of the bond issue, the debt service for this project will no longer be collected.  Annual operating costs and City treatment changes will be adjusted as Town costs change over time.  These O&M and treatment rates have been established for the first year of this project.  See attached spreadsheet for the estimated service unit cost.  A single family home at a 4.25 % interest rate will pay $904.00 per year.

7.      Each property owner not presently served, will also face a one-time personal cost to connect his property’s sanitary pipe to the sewer service lateral connection pipe installed by the project at the edge of the public right of way.  This service connection pipe will need to be completed within two years of the new sewers becoming available for use.  Cost can be roughly estimated at $25.00 per foot.

At the time of connection to the sewer system a new connection will also need to pay the Town permit and inspection fee of $100.00.

The property owner will also need to close out and fill his existing septic tank, with a typical cost of $400.00.

The one-time total first year connection costs for a typical home is about $2200.00.

8.      The Map, Plan & Report are available for review at the office of the Town Clerk during normal business hours.

9.      The purpose of this project is to eliminate the presently deteriorating and occasionally overloaded existing wastewater treatment plant in Alplaus, and to reduce the pollution of the Mohawk River from the unreliable individual septic systems currently in use in the unsewered parts of the Hamlet of Alplaus.

10.     The Town Board will meet on April 4, 2007 at 7:30 in the evening or as soon thereafter as the matter can be reached, at the Glenville Municipal Center, 18 Glenridge Road, Glenville, NY to hear all persons interested in this improvement project and the increase of the maximum amount to be expended for the establishment of Extension No. 1 to Alplaus Sewer District 1 in the Hamlet of Alplaus.

                WHEREAS, Robert Mortensen has submitted a zoning map amendment application to rezone a 2.8-acre parcel on Amsterdam Road (tax map # 29.-4-36.1) from “Professional/Residential” to “Multi-Family Residential” for the purpose of constructing a two building, 16-unit apartment complex; and

                WHEREAS, this proposed zoning map amendment constitutes an “Unlisted Action” in accordance with 6 NYCRR Part 617 (State Environmental Quality Review Act {SEQRA}); and  

                WHEREAS, the Glenville Town Board has assumed SEQRA Lead Agency in this instance; and   

                WHEREAS, both the Glenville Environmental Conservation Commission and the Planning & Zoning Commission recommended that the Town Board find no significant adverse environmental impact associated with this proposed zoning map amendment, and that the Board issue a SEQRA “Negative Declaration;”

                NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby determines that the proposed zoning map amendment by Robert Mortensen will not result in a significant adverse environmental impact; and  

                BE IT FURTHER RESOLVED, that the Glenville Town Board hereby issues a SEQRA “Negative Declaration” (attached) for this application, based on the following findings:

·       This action involves a zoning map amendment.  Consequently, there will be no physical alteration to the landscape as a direct result of this amendment.  Potential physical/environmental impacts associated with the apartment proposal will be addressed during the pending SEQRA and site plan review process for this specific project.

·       This is a reasonable proposal, given the fact that the property in question fronts a State highway and lies directly across from an industrial park and adjacent to a roofing contractor business.  A small apartment complex at this location constitutes a suitable transition between the industrial/commercial nature of property to the north and west and Maalwyck Park to the south.

·       This action will not significantly impact air quality, ground water or surface water quality, archeological resources, recreational facilities, etc.  Further, this proposal will not create a hazard to human health, and it will not result in a major change in either the quantity or type of energy to be used.

·       This proposal will not create a material conflict with any adopted Town plans or goals.  In fact, this action will clearly advance one of the objectives of the Town’s Comprehensive Plan, which states … “Encourage a mix of housing types that meets the needs of all residents, in particular, young families and senior citizens.”

·       This proposal is reasonably consistent with various goals and objectives of the Town of Glenville Comprehensive Plan which call for a mixing of housing types and provision of housing for a variety of demographic and income groups.

·       Land uses in the vicinity of the Mortensen property include industrial directly across Amsterdam Road, commercial adjacent to the west, residential to the east, and a public park adjacent to the south. Given this existing pattern of land use, development of an apartment complex on the Mortensen property is reasonable, and it represents an appropriate transition use between the commercial and industrial-type uses to the north and west and Maalwyck Park to the south.

·       The development of an apartment complex on this property should not negatively affect nearby property values.  Given that the development of multi-family on this site would result in less intense development than the commercial/industrial uses to the north and west, and would be reasonably compatible with a public park to the south and residential to the east, adjacent property values should not be impacted by a small-scale apartment complex on the project site.

·       This proposal is compatible with various other provisions of the Town of Glenville Zoning Ordinance, including the purpose of the Multi-Family Residential zoning district, which states that multi-family districts are meant to “provide for a form of housing, other than conventional single-family housing, in those areas where multi-family development already exists, or in areas where infrastructure and services are readily available and can accommodate dense residential growth.”  With public water and sewer both being available at this site, and given the site’s location on a State highway, where traffic volumes tend to discourage traditional single-family home development, the Mortensen property is well-suited for multi-family development

                Councilman Bailey – “This is something that I know I’ve worked on since I have been on the Board and I am glad to see it happen.  I appreciate the support that I have had from the other Board members on this.  I think it is a step forward in how the Town will operate.  I think we are going to be one of the best operating towns in the County very shortly. I am proud of Glenville.”

                Councilman Rosenberg – “I look forward to Tony coming on.  We have a great Town here.  Our town is grown quite a bit over the years and I think he is going to be a welcomed addition.”

                Supervisor Quinn – “For those of you who aren’t aware of his background.  He’s got some experiences in addition to his master degree in public administration and he’s coming to us from the NYS Department of Labor where he is the director of the Division of Safety and Health over there.  He has had a variety of positions over there to deal with the multitude of activities that go on in that arena and he has had private sector management experience for about twenty (20) years, NYS Emergency Management Office where he was Deputy Director Chief of Staff for the SEMO.

                He is also the former Chairman of the Town of North Greenbush Planning Board.  He is also the former Chairman of the Town of North Greenbush Zoning Board so he has had some obvious local experiences.

                One of the key things, I think I can speak for all of our Board members, is that we are in effect reactivating the position of Chief Operating Officer.  If you will picture in your mines eye a 16 million dollar operation with fourteen departments and no COO or CEO, so you have got fourteen departments reporting to a Board of Directors who are obviously part-time and therefore to improve the synchronization, integration, communication, coordination activities that is what we are doing with this position and Mr. Germano has obviously met the expectations of this Board.”

                Anthony Germano – “I don’t have any remarks prepared as I normally do.  I am going to talk from the heart and talk about my sincere pleasure and appreciation for the confidence this Board put into their vote this evening.  The appointment is what I think is a very unique and a very challenging position.  Believe me I can’t wait to get here on April 5th.

                My commitment to you is now to take that direction and to re-direct it back into the Town.  I will work as proactively and openly as we need to with the Board.  My commitment to the employees and I understand there are about twenty here tonight, is that I want you to know one thing about me I’m an expert at nothing, I’m a resource person.  My commitment to you is to help you where ever I can to do the best possible job that you can.  The bottom line, of course, is for the residents, those that live and work in the Town, “providing”, as Roger said, I appreciated your comments and I appreciated what your committed to for the upcoming meetings and the openness but to provide the best possible services that we can for the Town.

                Joan Menhinick – “While we all support tax relief for middle class taxpayers the confidential provision in the Governor’s proposed STAR legislation will impose costly requirements to towns.

                These restrictions will require the assessor to maintain two different assessment rolls, one for public scrutiny and one for the town to use for the preparation of tax bills.  Tax receivers and collectors will also need two different sets of books, one for public access without the itemized tax information and the other for the accurate collection of taxes.

                Telephone disclosure of detail school information will no longer be possible because we have no way to verify the identity of the caller.  No receipts or bills can be sent to third parties, banks or mortgage companies without a signed authorization from the tax payer.  Tax service organizations like First American will not be able to receive a complete file of taxes with software that includes the restricted information.  We will not be able to provide estimated school tax liability for new owners or realtors.  Tax receivers will need extensive modification to their tax collection software programs so that restricted information will not be available on public access computers or reports in the office.  Assessors will have to change the STAR value for every property each year resulting in volumes of extra work.

                Because unauthorized disclosure of such information shall be deemed a violation of Section 805a of the General Municipal Law penalties will be imposed on the responsible official.  Our constituents will need to furnish a picture ID to identify themselves as the owner of the property.  With some amended legislation we will now be able to release the tax liability on a property and the assessment and rates, so anyone with a calculator will be able to compute the income of the homeowner.  The exemptions of our most vulnerable taxpayers, senior citizens have been public information for years.”

                Supervisor Quinn – “In effect all the towns in the state, any of the taxing bodies and so forth and their state associations are working to get the things you just read to us, which really is besides tripling the work and doubling the bookkeeping and restricting communications, erratically improving the costs if it passes so we would have another unfunded mandate as far as we know plus not only us but anybody in our town is going to be impacted one way or another even though it is saying the quote “Middle Class”.  Do I have it right?

                Joan Menhinick – “Yes, this resolution was drafted by the attorneys for the Association of Towns and we are all encouraged to pass it.”

RESOLUTION NO. 96-2007

                WHEREAS, Governor Spitzer proposed real property tax reform in the Executive Budget for years 2007-2008 by providing relief from school district taxes, known as “middle class STAR”, and

                WHEREAS such proposal is welcome and needed, and

                WHEREAS, such proposal contains provisions of confidentiality that will impose costly requirements of altering assessment and real property tax collection programs, and of additional personnel, and dislocation and confusion in furnishing tax collection records, and

                WHEREAS, such needed program of tax relief can be implemented through a direct credit against State income taxes,

                NOW THEREFORE, BE IT RESOLVED that Governor Spitzer and the Legislature are urged to amend the “Middle Class STAR” proposal by eliminating the costly confidentiality provisions, or in the alternative that the program be revised by providing a credit against the State income tax.
