Absent: None
Supervisor Quinn called the meeting to order at 8:00 PM. Supervisor Quinn gave the Invocation and led us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Supervisor Quinn – “The first item on our agenda tonight is a public hearing to consider a contract for the fire protection services to be furnished to the Fire Protection District established in the Town of Glenville and known as “Fire Protection District No. 4”.
Supervisor Quinn opened the public hearing at 8:07 pm.
No one wished to speak; Supervisor Quinn closed the public hearing at 8:08pm.

WHEREAS, the Town must levy said sum against the taxable real estate, and direct the extension of such taxes against each such parcel,

1. The Town Board of the Town of Glenville does hereby levy the sum of $12,604,765.47 certified to it by the County Legislature as said Town's contribution to the taxes of the County of Schenectady for the fiscal year beginning January 1, 2007.
2. The taxes due the County of Schenectady shall be extended against each parcel of taxable real estate at a rate to be established by the County of Schenectady per $1000 of taxable assessed value.

WHEREAS, Freedom Park is a non profit organization made up of unpaid volunteers, and
WHEREAS, Freedom Park expenses consist of paying performers and a sound technician as well as maintaining the sound system, and
WHEREAS, each year Freedom Park strives to provide a diversity of programming that will serve a variety of audiences from preschoolers to senior citizens at the Wednesday night performances from the end of June through the end of August, and
WHEREAS, acts include big band, country, popular, Polish, Celtic, German, jazz, Dixieland and rhythm and blues, and
WHEREAS, admission to all performances are free, and
WHEREAS, most of the funding for Freedom Park comes from contributions made by individuals and families in the area, and
WHEREAS, the Village of Scotia contributes, each year, along with maintaining the physical plant, and
WHEREAS, the Town Board of the Town of Glenville is desirous of continuing its support to Freedom Park by giving of its fair share,

WHEREAS the Town of Glenville is desirous of obtaining any grants which may be beneficial to the Town and its residents; and
WHEREAS Susan M. Lombardi, on behalf of Community Development Resources, LLC, 51 Pashley Road, Glenville, New York, has agreed to provide assistance to the Town of Glenville as a consultant and independent contractor in the Town’s efforts to obtain grants,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby retains Susan Lombardi, on behalf of Community Development Resources, LLC, 51 Pashley Road, Glenville, New York, commencing January 1, 2007 and terminating December 31, 2007; and
BE IT FURTHER RESOLVED that the Town agrees to pay the contractor the sum of $31,800, which will be entirely recouped from grants secured, where allowed during the fiscal year 2007; and
BE IT FURTHER RESOLVED that Frank X. Quinn, Supervisor of the Town of Glenville, is authorized to sign said agreement on behalf of the Town.

WHEREAS, the Vehicle Usage Policy of the Town of Glenville is contained in the Town of Glenville Employee Personnel Manual at Section II-K,
NOW, THEREFORE, BE IT RESOLVED that the Town of Glenville Employee Personnel Manual be amended so that the Vehicle Usage Policy reads as follows:
K. VEHICLE USAGE POLICY
1. Police Department Vehicles.
A vehicle usage policy has been developed for the Police Department. A copy of this policy is on file with the Town Clerk and Chief of Police.
2. Other Town Vehicles
Certain job titles require that incumbents drive a town vehicle in order to conduct town business. These job titles include the following:

Purpose:
Vehicles which have been purchased by the Town of Glenville are intended for use by town employees in the performance of their official duties, and are not to be used for personal transportation without prior approval of their Department Head/Supervisor. In situations where the performance of official duties require that the employee be on call and available at times other than the normal work day, it may be financially advantageous and in the best interest of the Town to allow the
employee to use a Town vehicle for travel between his/her official domicile and the job site in order to ensure a rapid response in emergency situations and /or to provide effective service..
In situations where an employee is required to use a Town vehicle for travel between her/his official domicile and the job site, the Town will consider the associated costs as compensation and withhold all appropriate taxes according to federal and state income tax codes.
Policy:
Where appropriate all town vehicles will be clearly identified as such with a clearly visible Town Seal.
Town vehicles may not be operated by anyone other than town employees.
Vehicles purchased by the Town are intended for use by Town employees in the performance of their official duties, and are not intended to be used for personal transportation, without prior approval of their Department Head/Supervisor.
The only exception to the prohibition against using a Town vehicle personal use is in a situation where an employee’s official duties requires him/her to be on call and available at times other than the normal work day. In such cases, the employee may be allowed to use a Town vehicle for travel between her/his official domicile and the job site in order to ensure a rapid response in emergency situations and/or effective service.
The Department Head/ Supervisor will give written permission on an annual basis to those Town employees who are authorized to drive Town vehicles. The Department Head/Supervisor has the authority to withdraw permission at any time.
The Department Head/ Supervisor will give written permission to those Town employees authorized to use Town vehicles for travel between their official domiciles and their job sites.
The written permission granted by the Department Head/Supervisor in the preceding two paragraphs will include:
1. The name of the authorized employee.
2. Those job responsibilities which require the employee to have a Town vehicle available at times other than the normal work day.
The list of authorized employees will be maintained in the office of the Department Head/ Supervisor and will be available for public inspection during normal business hours.
Each employee who is authorized to use a Town vehicle for travel between his official domiciles and his/hers job sites will:
1. Sign a statement indicating that he/she understands the Town’s policy on the use of Town vehicles for personal transportation.
2. Maintain a daily log detailing his/her use including mileage and need for maintenance and repairs.
3. Submit to their Department Head/Supervisor a copy of his/her daily log for each calendar month by the fifteenth day of the following month to allow for necessary record keeping.
The Town Comptroller will maintain copies of the daily logs submitted by each employee and will report to the Town Board on an annual basis:
1. Aggregate use by each authorized employee.
2. Data needed to meet federal and state tax codes.
While operating a Town vehicle, employees will
1. Possess a valid operator’s license.
2. Obey all vehicular traffic laws.
3. Use, and require all passengers to use, seat belts.
4. Refrain from any use or activity which could be construed to be political in nature.
5. Refrain from the consumption of all alcoholic beverages.
6. Operate the vehicle in a safe and courteous manner.
Incidental personal use of a Town vehicle by a Town employee on personal time during the normal work day that does not increase the overall use of the vehicle is considered de minimus use under the IRS code and does not constitute a violation of this policy.
Repairs made to vehicles shall be done in conformance with the Town’s procurement purchasing policy.

WHEREAS the contract agreement for fire protection services to Fire Protection District No. 4 of the Town of Glenville has been prepared by the Village of Scotia and submitted to this board for approval; and
WHEREAS this agreement is for a one (1) year period with a cost of Three Hundred Sixteen Thousand, Four Hundred Seventy dollars ($316,470.00) for the period between January 1, 2007 and December 31, 2007; and
WHEREAS this Town Board did call for a public hearing thereon; and
WHEREAS in lieu of the formation of a volunteer fire district for the territorial boundaries of the protection district, it is determined that it is in the best interest of the residents of said Fire Protection District No. 4 to provide such protection services,
NOW, THEREFORE BE IT RESOLVED by the Town Board of the Town of Glenville, as representatives of the Fire Protection District No. 4, that said agreement be and it hereby is approved and the signatures of the respective Town Board Members affixed thereto.

WHEREAS, Richard D. LeClair, Commissioner of Public Works has informed the Town Board that the highway garage at 375 Vley Rd., Glenville is in need of repair; and
WHEREAS, the Town Board of the Town of Glenville authorized the Commissioner to go out to bid with Resolution 234-2006 dated December 6, 2006; and
WHEREAS, the bid opening was held December 27, 2006 at the Town Clerk’s Office; and
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to contract with Weather Guard Roofing, 2880 Curry Road, Schenectady, NY for the furnish of all materials, labor and equipment to deliver, place and install the replacement roof on the Town Highway Garage located at 375 Vley Rd., Glenville, NY in a sum not to exceed $35,700 plus $6.00 per sq. ft. for steel pans; and
BE IT FURTHER RESOLVED, that the funding for such contract shall be out of the 2006 Renovation budget line 01.00.5132.4109.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville does hereby authorize the transfer of this surplus through the 2007 town outside general fund balance to two 2007 budget line items: 02.00.3120.1000 in the amount of $12,000.00 for personal services in replacement personnel and promotions; and 02.00.3120.1003 in the amount of $12,000.00 for police overtime to be used to provide courtroom security..

WHEREAS, the Town of Glenville and the Village of Scotia are desirous of furthering inter-municipal cooperation between the two municipalities,
NOW, THEREFORE, be it resolved that the Town Supervisor is hereby authorized to enter into an agreement with the Village of Scotia permitting the Village’s use of the Town’s salt shed and bucket loader, located at the Town highway garage, 375 Vley Road, Glenville, New York.

WHEREAS, the Town of Glenville prior to 2007 has authorized work and expended approximately $172,168 for Alplaus Sewer District 1 and Sewer District 1 extension 1 capital project preparation, and
WHEREAS, the Bids exceeded the authorized funds to continue the Alplaus Sewer District 1 and Sewer District 1 Extension 1 capital project; and
WHEREAS, the Town Board wishes to charge the affected Alplaus residents for this charge over the two years of 2007 and 2008 instead of the initial tax levy of the full $172,168 for the Sewer District 1 and Sewer District 1 Extension 1 capital project; and
WHEREAS, the County Finance Department has been advised of the Town Boards intention to spread this cost over two years, and is considering its options on the request,
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby authorizes the inter fund borrowing from the Sewer 1 fund up to $86,084 for the capital projects close out until the tax billing or subsequent capital funding can be issued to replace the due to and due from borrowing. The finance charge will reflect the interest income that the funds otherwise would have earned; and
BE IT FURTHER RESOLVED, that the Glenville Town Board hereby authorizes an $86,084 reduction to the 2007 tax levy for sewer District 1 and sewer District 1 Extension 1 from the initial levy of $203,333 to the revised levy of $117,249.
