REGULAR MEETING OF THE TOWN BOARD
TOWN OF GLENVILLE

Present: Deputy Supervisor Robert E. Bailey, Councilman Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico
Absent: Supervisor Frank X. Quinn and Councilman Mark A. Quinn
Deputy Supervisor Bailey called the meeting to order at 8:00 PM and Councilwoman DiGiandomenico gave the invocation, which was followed by the Pledge of Allegiance.
Deputy Supervisor Bailey asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for except for Supervisor Quinn and Councilman Quinn who were out of town.
Town Council Reports:
Councilwoman DiGiandomenico announced that the new signage had been installed at the Town Municipal Center to give better directions to the public in gaining access to the individual departments.
Councilman Rosenberg gave an update on the status of the re-evaluation process.
Deputy Supervisor Bailey – “The Schenectady County Health Department will be holding a rabies clinic at the Duanesburg Fire Hall on Route 7 on Saturday, August 19th.
We have received bids on the Rector Road water line project, which is good news for the people up in that area. Bid evaluation is underway and should be completed within the next day or so.
Acting on behalf of Supervisor Quinn, I would like to make the following announcements.
Hopefully everybody has received a copy of the town newsletter. I think it does a pretty good job updating the residents on the many initiatives that the town has underway and it also requests input from town residents to tell us what we need to hear.
Just a reminder that this is the last meeting in the summer schedule, our next meeting will be on the regular winter schedule and that is when we have meetings twice a month, the first and third Wednesdays of each month at 8:00 pm. We hold work sessions on the Wednesdays prior to the regular meeting so that we are better prepared for the regular meeting, and those are held at 7:30 pm.
We are trying to set up a special meeting for Monday, August 21st at 5:00 pm and that is to act on a highway paving bond resolution.”
Deputy Supervisor Bailey – “Item no. 5 on the agenda is a public hearing to consider proposed amendments to the Town’s Vehicle and Traffic Law, Chapter 255.”
Deputy Supervisor Bailey opened the public hearing at 8:07 pm.
No one wished to speak; Deputy Supervisor Bailey closed the pubic hearing at 8:08 pm.
The following people exercised the Privilege of the Floor:
Virginia Graney, Efficiency in Government Committee – “I am here tonight representing the Efficiency in Government Committee along with Gloria Zampini and Michele Wilcock.
The Town of Glenville Efficiency in Government Committee meets on the first Monday of each month.
As for the mission statement of EIG in resolution no.57-2003, adopted by the Glenville Town Board February 19th, 2003, this Committee desires to investigate current situations and make recommendations to the Town Board regarding policy, procedure and equitable use of taxpayer dollars in reference to expenditures in management of town government and those in its’ employ.
It is the desire of this Committee to inform the Town Board of the conclusions of investigative research and make recommendations periodically upon completion of same. It is also the desire of this Committee that the periodic reports be reviewed by the Town Board that any recommendation be considered and a subsequent determination be acted upon by the Town Board in a timely manner.
The Efficiency in Government Committee further requests that it be notified in writing as to the determination and implementation or rejection set forth by the governing body of any and all reports and recommendations presented to the Glenville Town Board.
With this in mind we respectfully request that the following report be reviewed, the recommendation be considered and we wait notice of the determination.
After extensive research into current IRS ruling, obtaining fuel reports on town owned vehicles, insurance premiums and listings of department vehicles designations and including personal meetings between EIG members and Highway Superintendent/Commissioner of Public Works Richard LeClair, Deputy Highway Superintendent/Deputy Commissioner of Public Works Jeffery Gemmette, Senior Account Clerk Typist Tammy Stocker, Comptroller George Phillips, Sicilia & Associates CPA firm, the EIG Committee has ascertained that the use of town vehicles is extremely costly and that certain procedures must be followed to ensure proper usage.
With the escalating cost of gasoline and oil, substantial maintenance expense per vehicle, ever increasing insurance premiums and the unequivocal need for highway and town maintenance vehicles, we question the purpose of specific departments being issued vehicles that are taken home by tow employees.
By receipt of the Town “take-home” vehicle policy through the Department of Human Services on March 7, 2006, we cite the following procedures:
“All Town Vehicles will be clearly identified as such, and will display the Town seal (on) the front doors.”
“Each employee who is authorized to use a Town vehicle for travel between his official domiciles and his job sites will:
1. Annually sign a statement indicating that she understands the Town’s policy on the use of Town vehicles for personal transportation.
2. Maintain a daily log detailing his (use) for public transportation including mileage, maintenance and repairs.
3. Submit to the office of the Town Comptroller a copy of her daily log for each calendar month by the fifteenth day of the following month to allow for the calculation and withholding of the appropriate taxes.
4. Submit to the Town Supervisor a copy of her personal automobile insurance policy indicating that she has sufficient insurance to indemnify the Town of Glenville in the event that there is an accident while traveling between her official domicile and the job site.”
The EIG Committee has discovered that this policy has not been enforced and that the office of the Comptroller has not received daily logs as stipulated from any town employee.
The Town is currently in violation of not complying with town policy, therefore, EIG recommendation #01-06-A is as follows:
1). Eliminate the use of non-mandatory Town vehicles and substitute employee private vehicles for use needed in their daily work.
A. Reimbursement would be at the IRS approved amount per mile for gas, oil, repair and maintenance (currently $ .445). Mileage to and from the home to designated office is considered commuting and is not reimbursable as per the IRS.
B. Reimbursement would be made on a monthly basis for the previous month only if a completed log (suggested format attached) were submitted to the Office of the Comptroller by the 15th day of the month immediately following the month of usage.
2). Implement and enforce the procedure already in place and require the daily use of logs by all Town employees in all departments who are issued Town owned take-home vehicles.
3). Display Town insignia on all vehicles.

RESOLUTION NO. 169-2006

WHEREAS, a vacancy currently exists in the position of Police Lieutenant; and
WHEREAS, the Police Chief has reviewed the qualifications of the eligible candidate, and in recognition of his twenty-one years of service with the Town of Glenville Police Department and, more recently, his exemplary service as Acting Deputy Chief,
NOW, THEREFORE, BE IT RESOLVED, that this Town Board does hereby appoint Acting Deputy Chief Richard E. Conley to the position of Police Lieutenant with the Glenville Police Department on a provisional basis, subject to Schenectady County Civil Service Rules and Regulations, with an effective date of August 21st, 2006, at the pay rate of $72,000 per annum; and
BE IT FURTHER RESOLVED, that the position of Police Lieutenant will not be represented by the Glenville P.B.A. The Town Board hereby authorizes the Supervisor to execute an agreement with the Glenville P.B.A. and Richard E. Conley acknowledging this fact and setting forth the rights, benefits and other terms and conditions of employment for the position of Police Lieutenant, contained in Attachment A to this resolution.

RESOLUTION NO. 170-2006

WHEREAS, a vacancy exists in the position of Deputy Town Clerk in the Town Clerk’s Office; and
WHEREAS, Town Clerk Linda C. Neals recommends that a part-time Deputy Clerk be hired; and
WHEREAS, monies for this position were properly allocated in the 2006 Town of Glenville budget,
NOW, THEREFORE, BE IT RESOLVED that Ms. Judy Davis, 1148 Spearhead Drive, Glenville, NY be and hereby is appointed to the position of Deputy Town Clerk, part-time, effective September 5, 2006; and
BE IT FURTHER RESOLVED, that the pay rate for this position shall be $16.35/hour, with no other benefits, to be charged to account number 01.00.1410.1000.

RESOLUTION NO. 172-2006

WHEREAS, Richard D. LeClair, Commissioner of Public Works has informed the Town Board that they will be unable to properly conduct the annual loose leaf program in a timely and efficient manner without purchasing a new leaf collector; and
WHEREAS, it is the intention of the Commissioner of Public Works to expand the scope of the loose leaf program this year to include county roads; and
WHEREAS, included in the Highway Department’s five year plan was the purchase of two new leaf collectors in the 2006 fiscal year and the disposal of at least one old machine; and
WHEREAS, in good faith the Commissioner of Public Works is recommending purchasing only one new machine at this time and retaining and maintaining the older machine as a spare in case of break downs,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to advertise for bids on the purchase of one leaf collector; and
BE IT FURTHER RESOLVED, that all bids must be received in the Town Clerk’s Office, 18 Glenridge Road, Glenville, New York by no later than 10:00 AM, on September 5, 2006 and opened on September 5, 2006 at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York at 10:10 AM; and
BE IT FURTHER RESOLVED, that the funding for such purchase shall be out of the 2006 Equipment budget line 04.00.5130.2000.
