Present:        Supervisor Frank X. Quinn, Councilmen Robert E. Bailey and Mark A. Quinn

Absent: Councilman Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico

                Supervisor Quinn called the meeting to order at 8:00 PM and Councilman Bailey gave the invocation, which was followed by the Pledge of Allegiance.

                Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll.  Everyone was present and accounted for except for Councilman Rosenberg and Councilwoman DiGiandomenico who were out of town.

Town Council Reports:

                Councilman Quinn – “I met with Traffic Safety last week and a Mr. Stan Kivort, who owns much of the land around Maritime Drive and down towards the Academy in Alplaus, visited us and brought some of his concerns to our attention.  We tried our best to reconfigure the signs down there to redirect traffic and keep certain types of vehicles away from Mohawk Avenue but in doing so I think we may have unwittingly created a new drag strip.

                The Traffic Safety Committee is going to visit the area soon in order to address that situation.

                I also met with the Park Planning Committee just after our last meeting.  We took a look at the draft plan for the Indian Meadows playground reconstruction and that should be going out to bid shortly.

                I am very saddened to report that Dick McClane who was a twenty plus year member of the Park Planning Committee and two time Chair as well recently passed away.”  (Everyone present participated in a moment of silence)

                Councilman Bailey – “The Supervisor and I attended the training session back in June on incident command response.  It is part of the NIMS training curriculum, NIMS (National Incident Management System).  It’s intended to train public officials and emergency responders in a standardized approach to responding to emergencies such as flooding.

                I had suggested that we consider meeting with the Commissioner of Public Works regarding some highway paving issues that he had brought to my attention.

                We gave him three options as to how to pull that meeting together and get the information across.  He is going to be sending us a letter that details the issues he wants to bring to our attention.  I think that this is the fastest way to do it and get it all documented properly, so check your mail because that will be arriving shortly.”

                The following people exercised the Privilege of the Floor:

                Peter Miranda – “I have been a resident for about twenty years and one of the things that we have access to is Indian Meadows Park through some vacant property that’s down near the end of Woodruff Drive.

                Over the years I have seen development along Route 50 and one of the things that have caught my attention is that there is some property for sale along 50 which actually may at sometime allow access to Indian Meadows from Route 50.

                When I try to give people directions to Indian Meadows that are not from the Town it is a very difficult park to access.

                Mr. Reginald Scott owns some property in that area called Lewis Place and it is now for sale.  I realize that budgets are tight but the opportunity is here.  The Lewis building is for sale and I believe it is possible to get property access to go all the way back to the park from that section.  It might be an interesting idea to consider at some point.”

                No one else wished to speak during Privilege of the Floor.

Supervisor’s Comments to the Board:

                Supervisor Quinn updated the board with the following information:

                I would like to share with you some things that have gone on in the past period of time since our last Town Council Meeting in June as well as some upcoming things that we will be involved in.

                On the 27th of June I attended the Local Government Council meeting in Amsterdam sponsored by the Capital District Planning regarding economic growth in Luther Forest.

                Also on the 27th of June I attended a meeting with some folks from the Navy up in Saratoga Springs concerning the properties that they have on Route 5.  They have a building that is now vacant that is right there on Route 5 that use to be their recruiting headquarters.  That building is now vacant and no longer in use and the only other building they have is around in the back which is the Commissary and that is in use.  I was trying to find out what the plans were for that and after a bunch of phone calls we found out that that building has in fact been turned over to GSA, the property owner, and GSA has started the process of making it excess.  We will be notified when it is our turn to put in any interest we have on it.  It first goes to the Federal Registry, which is now advertised, the second goes to homeless people to see if they have any use for the facility and then it is thrown open for other interests.

                The 28th besides the famous rainfall and flooding conditions in the Town we operated our emergency operation center and thanks to our police and fire folks primarily but the other folks that were involved the Town basically, while we have some problems and some water that flooded in certain places including down where our main water wells are we are functional and operational and we will be meeting with the FEMA people to get their debrief as well as our debrief across the County and we will be submitting expenses to see if we can be reimbursed under FEMA for that.

                On July 6th, I had some meetings with reference to our Fire Protection District No. 4.  I met with some of the Fire Commissioners from Thomas Corners Fire Department and Beukendaal Fire Department about plans for that in the future.  This is the year starting in July we have to open up our negotiations about Fire District No. 4.  I was trying to get some of their thoughts and ideas on that.

                We’ve had some initial discussions with the Village also since we are dealing with two veterans tonight you know that thing comes up for bid but we are looking at alternatives and options for Fire District No. 4.

                I also had some communications and discussions with ESAM (Empire State Aeroscience Museum) about their plans, development things that are proposed for their property that is adjacent to ESAM and some back bills that were due us and they assure us will be paid in the short future.

                July 7, 8 and 9 the Canal Fest was on and so we are off the ground.  Friday night was a social for all of the players from Lock 7 – 12 and then on Saturday and Sunday we had our festivities down at Maalywck Park.

                I would say from my observations on those days the hit of it all was the loggers that put on a demonstration and a show.  Some people took a helicopter ride and some people did some other kinds of things that were there.

                The Canal Fest is up and running and it will grow each year.

                On the 12th of July I met with one of our developers Howard Carr referenced some issues and things in common interest that we have.  He is the developer for the adjacent property here going west out of this building.

                The 13th through the 18th was on vacation.

                Upcoming on the 20th in my role as our representative to the Intermunicipal Watershed, I have got to go to a court hearing and do a testimonial over there about a violator and what needs to go on.

                On the 26th I have a meeting scheduled in the morning around 10:30 with a developer who is also an owner for now for the K-Mart property, both the K-Mart and the old Grand Union property.  He is trying to understand where we are at with our master planning.

                On the 28th we have another meeting with FEMA, the Schenectady County Emergency Management Office of FEMA and the various Town and City representatives will do a debrief and a catch up on what lessons were learned.

                The 31st, in the morning, I have a meeting with the Center for Economic Development, which involves the towns in the surrounding four counties and we will get further along on what is going on with the raw materials in planning, what is the data, what is the data telling us so far and what kind of municipal planning needs to take place if scenario one, scenario two or scenario three, the three options come about here.

                Please turn in any goals that you have.  I have received some but I don’t have them all.”

RESOLUTION NO. 152-2006

                WHEREAS, the insurance for the Town of Glenville is due to be put out through a competitive bid process; and

                WHEREAS it is in the best interest of the Town of Glenville, as in the past, to hire an insurance consultant to oversee the whole process;

                NOW, THEREFORE, BE IT RESOLVED that the Town Board authorizes the hiring of Mr. Patrick M. DiCesare, Certified Insurance Counselor, 55 Swaggertown Road, Glenville, NY, as an independent insurance consultant to oversee the insurance bid process including reviewing the insurance specification of the Town, updating them if advisable, reviewing the bids received and recommending the best bid to the Town at a cost not to exceed three thousand six hundred dollars ($3,600),

                NOW, THEREFORE, BE IT FURTHER RESOLVED that the Town Board authorizes the costs charged and fund balance appropriated to the allocated insurance charge codes (4300) based on the original budgets on a pro rata share basis as follows:

                WHEREAS, by application dated May 16, 2006 and pursuant to Local Law No. 3 of 1974, Glenville Police Benevolent Association / Fund Raiser Car Show has applied for a permit to conduct Outdoor Amusement/Entertainment at the Schenectady County Airport on Saturday, August 19, 2006, with rain date Sunday, August 20, 2006; and

                WHEREAS, said application did include permission of the owner of the property on which said Amusement/Entertainment will be conducted, and the necessary insurance coverage; and

                WHEREAS, said application has been referred to the Chief of Police, Town of Glenville and the respective Fire Chief of the area in which said entertainment would be conducted and the Schenectady County Environmental Health Department, as required by Article II, Section C of said Local Law No. 3,

                NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Glenville that said application of the Glenville Police Benevolent Association be and it hereby is approved, and

                BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and directed to issue the required permit subject to all stipulations cited by the Chief of Police, the Thomas Corners Fire Chief and the Schenectady County Environmental Health Department.

"CRUISE OUT 2006,14th Annual Car Show & Swap Meet” has applied for a permit to conduct Outdoor Amusement/Entertainment at the Schenectady County Airport on Sunday, September 3, 2006, with rain date Monday, September 4, 2006; and

                WHEREAS, said application did include permission of the owner of the property on which said Amusement/Entertainment will be conducted, and the necessary insurance coverage; and

                WHEREAS, I am introducing a Local Law to amend the Town’s Vehicle and Traffic Law No. 1 of the year 1981; and

                WHEREAS, a duly scheduled public hearing must be held in order to change such a law,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville will meet at the Glenville Municipal Center on Wednesday, August 16, 2006 at 8:00 P.M., or as soon thereafter as can be reached, at which time and place will hear all persons interested in a proposed local law to amend Local Law No. 1 of the year 1981, Vehicle and Traffic Law; and

                BE IT FURTHER RESOLVED that the Town Clerk be, and she hereby is directed to prepare the proper notice of said hearing in accordance with law as follows:

RESOLUTION NO. 158-2006

                WHEREAS, Richard D. LeClair, Commissioner of Public Works has recommended that the Town purchase a complete color television inspection system [crawler camera] for sewer line inspection and preventative maintenance programs; and

                WHEREAS, that television inspection system would also be instrumental in the highway’s maintenance program of culvert and storm sewer pipes; and

                WHEREAS, the funding for the purchase would be provided from Woodhaven Sewer #6 Capital Project, Woodhaven Operating Expense, Sewer #9 Operating Expense, and Highway Equipment Expense; and

                WHEREAS, the Town Board adopted resolution no. 150-2006 authorizing the Commissioner to bid; and

                WHEREAS, only one bid was received from Joe Johnson Equipment Inc., 62 LaGrange Avenue, Rochester, NY 14613 in the sum of $59,035.00,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to purchase one complete color television inspection system [crawler camera] in the sum not to exceed $60,000 from Joe Johnson Equipment Inc., 62 LaGrange Avenue, Rochester, NY 14613; and

RESOLUTION NO. 159-2006

                WHEREAS, Richard D. LeClair, Commissioner of Public Works has informed the Town Board that they will be unable to properly maintain and repair town roads and water break road cuts in a timely and efficient manner without purchasing a new tandem asphalt roller; and

                WHEREAS, included in the Highway Department’s five year plan was the purchase of one new asphalt roller in 2006; and

                WHEREAS, the highway department recently sold surplus equipment at an auction and obtained $16,582.42 in unallocated revenue; and

                WHEREAS, Town Board resolution 141-2006 authorized the Commissioner to bid and authorized the budget amendments for said purchase; and

                WHEREAS, three bids were received with Contractors Sales Company Inc., P.O. Box 12010, Albany, NY 12212 being the lowest bid that conformed to the specifications in the sum of $17,158;

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to purchase one 2006 Tandem Asphalt Roller CC900 G in a sum not to exceed $17,200; and

        BE IT FURTHER RESOLVED, that the funding for such purchase shall be out of the 2006 Equipment budget line 04.00.5130.2000.

RESOLUTION NO. 160-2006

                WHEREAS, residents of the Town of Glenville residing in the vicinity of Woodcrest Drive, Woodhaven Drive, Glen Hill Drive, Elmwood Drive, Oakwood Drive and Governor Drive areas have informally petitioned this Board to investigate the feasibility of providing sewer service to such areas; and

                WHEREAS, the Board has received a proposal from Kestner Engineers P.C. to provide a conceptual report of the feasibility of same, including the route such sewer line would take, properties to be served, estimated costs and funding availability; and

                WHEREAS, Kestner Engineers P.C. has provided an Engineering Services proposal in the amount of $4,000.00; and

                WHEREAS, at a workshop meeting of this Board held on June 14, 2006, the proposal was reviewed and discussed; and

                WHEREAS, the Board believes it is in the public interest to proceed with such conceptual study; and

                WHEREAS, Kestner Engineers has worked with the Town since the late 1970’s on sewer projects including the Woodhaven area and the recently concluded Woodhaven Sewer Pump Station, has submitted a proposal meeting requirements at a maximum cost of $4,000.00, and has received positive recommendations from Town employees and staff directly involved with creation, design, operation and maintenance of the town’s sewer system,

                NOW, THEREFORE, BE IT RESOLVED that Kestner Engineers is hereby awarded the contract to provide a conceptual report of the feasibility of providing sewer services to Woodcrest Drive, Woodhaven Drive, Glen Hill Drive, Elmwood Drive, Oakwood Drive and Governor Drive areas, at a cost not to exceed $4,000.00 and the Town Supervisor with the aid of the Town Attorney and staff of the Department of Public Works, is authorized and directed to formalize such contract under such terms and conditions as are in the interests of the Town of Glenville.

                WHEREAS, Glenville Police Chief Michael Ranalli recommends that the command structure of the Glenville Police Department be altered to include two Lieutenant positions,

                NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville does hereby authorize the creation of two Lieutenant positions within the Glenville Police department, and further authorizes the Supervisor to execute such paperwork as is necessary with the Schenectady County Civil Service Commission for such positions to be created.

                WHEREAS, since that date, due to clerical error, adjustments are required in order to bring the warrant up to date,

                BE IT STILL FURTHER RESOLVED that the corrected warrant for Water District #11 is. $1,777,105.69

RESOLUTION NO. 165-2006

                WHEREAS, the Town of Glenville Water District No. 11 has been negotiating with the Clifton Park Water Authority for the sale of water from the Glenville Water District to the Clifton Park Water Authority; and

                WHEREAS, the parties have reached an agreement for the sale of bulk water for a period of ten (10) years at the initial rate of $2.75 per thousand gallons, such rate to be adjusted over the term of the agreement in the same percentage as the water district’s residential rate.

                NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board acting as commissioners of Water District No. 11 of the Town of Glenville hereby authorizes the Supervisor of the Town of Glenville to enter into an agreement for the sale of bulk water to the Clifton Park Water Authority as aforesaid.

                BE IT RESOLVED, that the Town Board of the Town of Glenville hereby adjourns into Executive Session in order to discuss PBA Contract matters.

Absent: Councilman Rosenberg and Councilwoman DiGiandomenico
Abstention:             None

                Supervisor Quinn adjourned this portion of the meeting at 8:45 p.m. and moved into Executive Session.

                The time being 10:00 pm Supervisor Quinn reconvened the meeting.

        Motion to adjourn was moved by Councilman Quinn and Seconded by Councilman Bailey.

                The Town of Glenville Town Board Meeting was adjourned at 10:01 PM.
