Present: Supervisor Frank X. Quinn, Councilmen Robert E. Bailey, Mark A. Quinn, Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico
Absent: None
Supervisor Quinn called the meeting to order at 8:00 PM and gave the invocation, which was followed by the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Council Reports:
Councilman Bailey – “I would like to give an update on the water plant.
We may have made some progress on understanding the cause and the impact of the cracking that has been an issue in the clear well tanks. It sounds like we are moving ahead there.”
Councilwoman DiGiandomenico – “This is an update to the former Payless Gas Station on Rte. 50. It is being converted into a small grassy area with flowers and it will serve as an entrance into the town.
The town is leasing the area for one dollar annually for the next twenty years.
The removal of the pavement and work recently completed was at a cost of $8,750, which was split between the town and Price Chopper. We hope the town residents will enjoy the improvements as they drive by.
If anyone has a park bench that they are not using anymore and would like to donate it please contact James Macfarland at the Town Municipal Center. We will welcome all contributions.
I have also had several inquiries as to the construction signs that are on Rte. 50, one just prior to the new car wash; these are entrances that will be used by the Schenectady Airport to improve the runways. The State has awarded the County Airport five-million dollars ($5,000,000) towards the completion of this job and it should be started fairly soon.”
Councilman Rosenberg – “The Board of Assessment Review is about one-third of the way through the grievance process now. They had a little over seven-hundred filed and they have reviewed about two-hundred and eighty-six (286) so far. They are meeting just about every night.
The new development on Swaggertown Road or off Swaggertown Road is moving ahead. This is the developer that came to us for temporary permission to put the sewer line in from Rte. 50 through Oakhill Drive.”
Supervisor Quinn – “My understanding is that the Assessment Review Committee, the number you mentioned, is actually about six (6) percent of all of the assessments that went out. It is pretty difficult although it has been ten years since we did a full town re-val that is in line with what it was in the past.”
The following people exercised the Privilege of the Floor:
Tamara Williams – “In April of 2004 I began noticing an odor in the air at my home on Woodcrest Drive. The problem originates from failing septic systems in that area.
I contacted the town engineer and he instructed me that the process is that I have to petition, so I did that. I brought the petition in and it was my understanding that there was some sort of discussion between the highway department and the engineering and I did come to one meeting here on a Monday. I spoke to people and they decided that what I really needed to do was petition all of the rest of Woodhaven that is not on the sewer line which includes part of Woodhaven, Governor Drive, Oakhill, Glenhill, part of Maplewood and all of Woodcrest and in addition Glenridge Road from the top of the hill down, which I did.
At this point I have 77 people that have signed saying yes they want the feasibility study to determine how much it is going to cost to get sewers in there. I needed 62, I have my 51%. It was my understanding that tonight you were going to have a resolution before you to vote on that feasibility study. I found out today that that didn’t happen.
I am very frustrated with the lack of direction that I have received in completing this project.
I know a lot of residents in this area are having septic issues and I know that the engineering department has confirmed this and yet two years into this I’m not getting anywhere. I have the signatures and if I wasn’t doing something correctly then somebody should be telling me, I feel like somebody just keeps dropping the ball.
That is my issue; I really would like to get the feasibility study done. I need numbers, I need figures.
So, I ask you please to either give me some advice and direction or help me figure out what I need to do to get this project going.”
Valerie Hess – “I purchased my property back in October ’01. We have a major water problem going on in the Sutherland Drive area. I know of six residents that are having a problem. My own property is pumping over 100 gallons an hour. When I first purchased the property they had a tire and a standing sump pump and they had a hose running out the window. I now have two full pits, two sumps, a backup sump pump that runs off of the town water and I also have a generator for when we are out of power for an extended period of time. The property that I own is approximately 191’ long, 50’ of that by approximately 10’ is standing water, and it is a marsh land.
It is not just my residence, like I said it is on both sides of the road which also leads us to believe then that there is water running under the road. If this water continues as it is right now, it’s going to what we feel create a problem on the road with the school buses and the car driving up and down if there were something going on, I believe that the overall picture that this would be a major liability on the town’s part, on our part. With this water we are creating sink holes.
The highway has been out on several occasions. They have checked for water main breaks in several different spots.
I can definitely take care of my residence. I am worried about the neighborhood as a whole.”
David Besozzi – “I am here for the same issue. Just to let you know that for Valerie it really is an acute issue, I’d say that her property is probably the worst effected on the street.
I have been living there probably about 5 years longer and there is definitely a high water table issue. I would have to say that things are different.
The first 5 years that I lived in the house the holes in the basement were dry, there was never any water in the holes and the pumps that were there were the original pumps and it appeared that they were never used, it wasn’t an issue. It has been the last 2½ years, it has gotten bad.
I’d like to just say it’s high water table, it’s the weather, global warming whatever, but I suspect that there is something else going on; the displacement issue is something I think that’s worth looking into because they were dry for years.
This year has been the worst, by December the holes were completely full of water and normally for the last two years I only had to pump in the spring time. I have been pumping water almost 24 hours a day since December; I have gone through three pumps. I am still pumping right now, constantly.
Some of the neighbors that have always had dry basements are now noticing water seeping through the walls. I don’t know what the solution is. I understand that as a home owner we are responsible for our homes, but it would be nice if there was some place to pump the water to, rather than in the road, or at least get it to where the culverts already exist.
Hopefully you could take a look at it and see what is going on.”
Supervisor Quinn – “I’m sure we’ll continue to see if there is or isn’t a problem. What can or cannot be done. Whether we partner or whether it turns out to be the town and/or the home owners but it sounds like it is an ongoing development. Let’s see if there is a proposed solution.”

Supervisor’s Comments to the Board:
Supervisor Quinn updated the board with the following information:
“A series of things, since a lot of people, we all know but maybe people in the audience don’t know that we only meet on the third Wednesday of the month in June, July and August with our worksession on the second Wednesday of these months.
On the 18th of May the Village, Town, City and County met about sharing services and equipment. The legal issues have been solved so right now our highway department and department of public works as well as all of the others are looking at cooperative that we can do not only about equipment but about services of people. So that is underway and ongoing right now. Why do each of us buy the same piece of equipment and is there some roads that we could swap for services and so forth and so on.
On the 30th of May we had the meeting with Schenectady County Board Members and the County Legislature to begin getting us involved in the Schenectady County wide youth summer program. They have money set aside for youth employment in certain categories. They are encouraging us; we’ve turned it over to our Director of Human Services.
On June 5th, we had a joint recognition ceremony that involved swearing in and introductions of the new police chief, Chief Ranalli; our new judge, Judge Moran and we had recognition for our retiring Deputy Chief Macherone.
Later that day we had a meeting with officials of the Clifton Park Water Authority and we are in the phase of finalizing the contract with the Town of Glenville to be selling some water to the Clifton Park Water Authority.
On the 6th of June, at the Senior Center, the NYSDOT representatives were there and conducted a public information session on the plans that they have for the expansion of the two overpasses on Glenridge Road. The idea is not to increase the height but to increase the width.
On the 12th of June we had a meeting here with representatives from the NY Development Corp. to discuss their involving plans (Patriot Square) related to the developing of the condos, the professional businesses and offices behind the Town Municipal Center. They are in process of putting their applications before our Planning and Zoning Committee and GECC.
On the 16th of June we met at the Government Supply Agency (GSA) in the Industrial Park and the purpose of this meeting was to update each other on where they are at and what the plans are as they understand them on the ground about the proposed turnover of the fifty some acres of property down there. Nothing new came out of the meeting we were just sharing ideas.
On the 19th of June the initial meeting of our Open Space Committee was held. It was an orientation to the mission, the tasks and objectives and outcomes of things that we have charged that committee with. They were going public for the first time.
At that meeting there was a representative from the Land Conservatory describing their programs and activities that are taking place in the capital area.
There was a survey that was passed out at that meeting seeking public input so part of the whole evening was questions and answers. The survey will also be included in our upcoming newsletter. We are seeking as much input as we can get from the citizens in our town on what they see as important matters, priority matters as far as planning and discussing open space in the future for our town.
The Board of Assessment Review is busy with the re-evaluation as Councilman Rosenberg mentioned earlier.
I’ll be going on the 27th of June to a meeting of the Capital Region Local Government Council. It is a council of mayors and supervisors from seven of the area counties and what happens is sharing of information for example the Capital District Planning Council will be giving a briefing at the one that is coming up on the 27th . We discuss different kinds of issues, share ideas, what has worked for you that might be able to work for us? This one is going to be over in Amsterdam.
Canalfest to be held on July 8th & 9th, the Town is hosting events at Maalywck Park, fishing contest and a lumberjack show, etc.
Councilman Rosenberg – “The condos that are going to go in behind us, have we had any update at all on that road permission as far as FAA?”
Supervisor Quinn – “No, as all of us may or may not be aware of what Councilman Rosenberg is asking is the County has a say here as well as the Federal Aviation Administration on whether the access road that will run through here can go all the way down and come out on Route 50 near the air museum. As of today I have seen or heard nothing new either to help or hinder that process.”
Supervisor Quinn moved ahead with the agenda items.
RESOLUTION NO. 141-2006

WHEREAS, Richard D. LeClair, Commissioner of Public Works has informed the Town Board that they will be unable to properly maintain and repair town roads and water break road cuts in a timely and efficient manner without purchasing a new tandem asphalt roller; and
WHEREAS, included in the Highway Department’s five year plan was the purchase of one new asphalt roller in 2006; and
WHEREAS, the highway department recently sold surplus equipment at a recent auction and obtained $16,582.42 in unallocated revenue; and
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to advertise for bids on the purchase of one tandem asphalt roller; and
BE IT FURTHER RESOLVED, that all bids must be received in the Town Clerk’s Office, 18 Glenridge Road, Glenville, New York by no later than 10:00 AM, on July 10, 2006 and opened on July 10, 2006 at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York at 10:10 AM, and
BE IT FURTHER RESOLVED, that the funding for such purchase shall be out of the 2006 Equipment budget line 04.00.5130.2000.
BE IT FURTHER RESOLVED, that the following transfer shall be done to support this resolution.

WHEREAS, such warrant for Water District #11 totals $1,531,874.62 including water rents receivables and Special Contracts and Sewer totals $246,564.93,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby accepts such roll.

RESOLUTION NO. 143-2006

WHEREAS, Rick Conley was appointed to the position of Deputy Police Chief (temporary) on April 17th, 2006, in order to provide supervision for the department in the absence of a Police Chief; and
WHEREAS, Police Chief Michael Ranalli recommends that Deputy Chief Conley continue in that position until such time that a department reorganization can occur; and
WHEREAS, the functions of a Deputy Chief of Police are needed both during the absence of the Chief and to provide for day to day departmental needs,
NOW, THEREFORE, BE IT RESOLVED, that Rick Conley’s temporary appointment as Deputy Police Chief is hereby extended for the period from June 5, 2006, through August 31st, 2006, at the existing pay rate of $76,317 per annum; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville wishes to thank and commend Deputy Chief Conley for exemplary service to the department and the town while performing multiple functions and roles for the past two months.

WHEREAS, the Chamber of Schenectady County is coordinating
a community event, the 2006 Lock 7-12 Canalfest; and
WHEREAS, the Town of Glenville is a participant in many aspects of Canalfest, including staff support, use of Maalwyck Park, and financial support; and
WHEREAS, it is in the best interests of both the Chamber and the Town of Glenville to formalize their Canalfest relationship through an agreement,
NOW, THEREFORE, BE IT RESOLVED, that the Supervisor of the Town of Glenville is hereby authorized to execute an agreement (attached) with the Chamber of Schenectady County for the purpose of conducting the 2006 Lock 7-12 Canalfest.

WHEREAS, by application dated March 30, 2006 and pursuant to Local Law No. 3 of 1974, the Ladies Auxiliary of the Alplaus Volunteer Fire Company No. 1 Inc., [Paddling for a Cure] has applied for a permit to conduct Outdoor Amusement/Entertainment at the Burnt Hills Rowing Association Maritime Road in Alplaus on July 16, 2006, Sunday from 6 AM to 3 PM: and
WHEREAS, said application did include permission of the owner of the property on which said Amusement/Entertainment will be conducted, and the necessary insurance coverage; and
WHEREAS, said application has been referred to the Deputy Chief of Police, Town of Glenville and the respective Fire Chief of the area in which said entertainment will be conducted and the Schenectady County Environmental Health Department, as required by Article II, Section C of said Local Law No. 3,
NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Glenville that said application of the Ladies Auxiliary of the Alplaus Volunteer Fire Company No. 1, “Paddling for a Cure” be and it hereby is approved; and

NOW, THEREFORE, BE IT RESOLVED, that this Town Board acting on behalf of Sewer District Number 7, Sewer District Number 9 and Water District Number 11 of the Town of Glenville does hereby approve the outside user agreements enumerated above and does hereby authorize the Supervisor to execute the agreements on behalf of the Town Board as commissioners of said districts.

WHEREAS, Richard D. LeClair, Commissioner of Public Works has recommended that the Town purchase a crawler camera for sewer line inspection and preventative maintenance programs; and
WHEREAS, that camera would also be instrumental in the highway’s maintenance program of culvert and storm sewer pipes; and
WHEREAS, the funding for the camera would be provided from Woodhaven Sewer #6 Capital Project; and
WHEREAS, the Town Board adopted resolution no. 228-2004 to purchase the camera but never moved forward in the purchasing,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to advertise for bids on the purchase of one crawler camera; and
BE IT FURTHER RESOLVED, that all bids must be received in the Town Clerk’s Office, 18 Glenridge Road, Glenville, New York by no later than 10:00 AM, on July 10, 2006 and opened on July 10, 2006 at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York at 10:20 AM, and
BE IT FURTHER RESOLVED, that this purchase shall be funded from the Woodhaven Sewer #6 Capital Project 77.00.8130.4500.
