REGULAR MEETING OF THE TOWN BOARD
TOWN OF GLENVILLE
MAY 3, 2006
AT THE GLENVILLE MUNICIPAL CENTER

Present:        Supervisor Frank X. Quinn, Councilmen Robert E. Bailey, Mark A. Quinn, Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico

Absent: None

                Supervisor Quinn called the meeting to order at 8:00 PM. Councilman Rosenberg gave the invocation and lead us in the Pledge of Allegiance.

                Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll.  Everyone was present and accounted for.

Town Council Reports:

                Councilwoman DiGiandomenico made the following comments:

                Announced that the Annual Indian Kill Open House Fishing Day would be held on May 13, 2006 and the upcoming 2nd Annual Canalfest will be held on July 8th and 9th.

                Councilman Rosenberg made the following comments:

                Informed everyone that the letters were mailed from the Assessor’s Department notifying the residents of the results from the informal hearings that were held on the re-evaluations.

                The Planning Department is working on the following: Glenridge Road improvement project; Schenectady County Brownfield Sites and the new site for CVS.

                Councilman Bailey made the following comments:

                Water Treatment Plant addition – ahead of schedule
                Attended the BH/BL Baseball Opening Day celebration

                The following people exercised the privilege of the floor:

                Bob VanVorst – Strongly opposed to any “Big Box Store” on the Piotrowski property on Freeman’s Bridge Road.

                Neil Turner – Reminded the Board that the Freeman’s Bridge Road Master Plan Survey showed that the majority of people want more green space in the town.

                Ray Germain – Asked the board to please consider consolidation of services.

                No one else wished to speak;  Supervisor Quinn closed the privilege of the floor.

Supervisor’s Comments to the Board:

                Supervisor Quinn updated the board with the following information:

                4/26 – attended a meeting with Supersteel’s CEO regarding the status of their operations
                4/27 – met with Scotia’s Deputy Mayor to discuss F.D. #4 Contract and boundary issues.
                4/28 – attended the Highway Staff meeting
                5/02 – attended a meeting with DOT to discuss the Glenridge Road overpasses
                5/04 – meeting with Town and Village officials, the water treatment study group and Delaware Engineering.
                5/04 – announced the Corporate Olympics competition to be held this weekend
                5/04 – meeting with the Woodhaven Association, Senior Center at 7:00 pm
                5/11 – meeting with the Local Government Council
                5/11 – public hearing to be held at the Schenectady County Community College at 7:00 pm to discuss cable TV service
                5/13 – Indian Kill Fishing Day
                A joint meeting with the Town Board and the Village Board to discuss combined services – date and time to be determined

                Supervisor Quinn moved ahead with the agenda items.

RESOLUTION NO. 119-2006

                WHEREAS, by application dated April 12, 2006 and pursuant to Local Law No. 3 of 1974, Empire State Aerosciences Museum, “Wings, Wheels and Tracks Military Vehicle Show” has applied for a permit to conduct Outdoor Amusement/Entertainment at the Schenectady County Airport on Saturday, May 20, 2006, 9:00 am-5:00 pm and Sunday May 21, 2006, 9:00 am – 3:00 pm.; and

                WHEREAS, said application did include permission of the owner of the property on which said Amusement/Entertainment will be conducted, and the necessary insurance coverage; and

                WHEREAS, said application has been referred to the Chief of Police, Town of Glenville and the respective Fire Chief of the area in which said entertainment would be conducted and the Schenectady County Environmental Health Department, as required by Article II, Section C of said Local Law No. 3,

                NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Glenville that said application of the Empire State Aerosciences Museum, be and it hereby is approved, and

                BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and directed to issue the required permit subject to all stipulations cited by the Chief of Police, the Thomas Corners Fire Chief and the Schenectady County Environmental Health Department.

RESOLUTION NO. 120-2006

                WHEREAS, by application dated February 2, 2006 and pursuant to Local Law No. 3 of 1974, Schenectady County Environmental Advisory Council has applied for a permit to conduct Outdoor Amusement/Entertainment at the Indian Kill Nature Preserve on Hetcheltown Road, May 13, 2006 and

                WHEREAS, said application did include permission of the owner of the property on which said Amusement/Entertainment will be conducted, and the necessary insurance coverage; and

                WHEREAS, said application has been referred to the Chief of Police, Town of Glenville and the respective Fire Chief of the area in which said entertainment will be conducted and the Schenectady County Environmental Health Department, as required by Article II, Section C of said Local Law No. 3,

                NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Glenville that said application of the Schenectady County Environmental Advisory Council be and it hereby is approved, and

                BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is authorized and directed to issue the required permit subject to all stipulations cited by the Chief of Police, the Alplaus Fire Chief and the Schenectady County Environmental Health Department.

RESOLUTION NO. 121-2006

                WHEREAS the Town of Glenville received quotes on state contract #PT55666 for Dell personal computers and for Dell data backup hardware and software; and

                WHEREAS the Town budgeted to buy 12 personal computers and the data backup hardware and software in 2006,

                NOW, THEREFORE, BE IT RESOLVED that the Glenville Town Board hereby authorizes the purchase of 12 personal computers for $10,922.40 and a PowerVault 110T tape backup device and Veritas software for $5,320.15 from Dell with appropriations for these payments to be taken from budget line item 01.00.1680.2000; and

                BE IT FURTHER RESOLVED the Town Board authorizes the sales, disposal, or redeployment of the replaced personal computers with the proceeds of any sales to be credited to miscellaneous income for the town general fund.

RESOLUTION NO. 122-2006

                WHEREAS,        the Department of Public Works advertised for bids for one New 2006 Tandem Diesel Powered Cab & Chassis with Dump Body, Snow Plow and Wing equipment;

                WHEREAS, only one bid was received and opened on April 24, 2006;

                NOW, THEEFORE, BE IT RESOLVED, that the Town Board of the Town of Glenville hereby accepts and approves the bid not to exceed $144,000 for one new 2006 Tandem Diesel Powered Cab & Chassis with Dump Body, Snow Plow and Wing equipment from Albany Truck Sales, 90 Harts Lane, Albany, NY  12204

                BE IT FURTHER RESOLVED, that the funding for such purchase shall be with a New York designator lessor with this years semi-annual payment total not to exceed $28,600 from 04.00.9785.6000 and $3,003 from 04.00.9785.7000; and

                BE IT FURTHER RESOLVED, that the following budgetary transfer is essential to make this years total payment from the 2006 Highway Budget

RESOLUTION NO. 123-2006

                WHEREAS, a vacancy will exist in the position of Town Justice in the Town of Glenville due to the retirement of Dennis M. Englert on May 1, 2006; and

                WHEREAS, the Town Board is empowered to fill a vacancy in the office of Town Justice until such time that an election can next be held,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville does hereby appoint Richard H. Moran, 306 S. Ten Broeck Street, Scotia, N.Y. to the position of Town Justice, through December 31, 2006 at the proscribed pay rate of $16,503 per annum.

RESOLUTION NO. 125-2006

                WHEREAS, the Town of Glenville has a contract with Nextel Partners for cell phones; and

                WHEREAS, after discussion with Nextel, an opportunity to save the town money by changing our current billing plan to the Nextel plan available under a State Contract without any additional run-out time exists,

                NOW, THEREFORE, BE IT RESOLVED, that Frank X. Quinn, Town Supervisor of the Town of Glenville is authorized to enter into an agreement for cell phone service pursuant to the Nextel State contract number PS60701, effective immediately.

RESOLUTION NO. 126-2006

                WHEREAS, we have been advised by Wells Communication that our antenna, line and connectors on Waters Road are no longer working and cannot be repaired; and

                WHEREAS, this antenna is needed to run the Police Department radio system; and

                WHEREAS, another municipality has kindly allowed us (for a short while) to share their frequency until this repair is done,

                NOW, THEREFORE, BE IT RESOLVED that the Deputy Chief of Police be authorized to have Wells Communication of Troy, New York replace the antenna, line and connectors at our site on Waters Road at a cost of $5,762.00 with appropriations for this payment to be taken from budget line items 02.00.3120.2000 - $3,487.00 for parts and 02.00.3120.4500 - $2,275.00 for labor.

                BE IT RESOLVED, that the Town Board of the Town of Glenville hereby adjourns into Executive Session in order to discuss personnel issues in the Police Department.

                Supervisor Quinn adjourned this portion of the meeting at 8:50 p.m. and moved into Executive Session.

                The time being 10:05 pm Supervisor Quinn reconvened the meeting.

        Motion to adjourn was moved by Councilman Rosenberg and Seconded by Councilman Bailey.

                The Town of Glenville Town Board Meeting was adjourned at 10:06 PM.
