Supervisor Quinn called the meeting to order at 8:00 PM. Councilman Quinn gave the invocation and lead us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Supervisor Quinn presented the “Recognition of Service” plaques to Peter V. Russo, former Town Councilman, Andimo Coppola, former Highway Superintendent and Donald Hess, former member of the Glenville Environmental Conservation Commission and the Zoning Board of Appeals
Town Council Reports:
Councilman Quinn – “Last night the Park Planning Commission was kind enough to invite the board, the citizens and the press to an overview of their “Master Plan” which covered primarily Maalwyck Park and Indian Meadows Park and lesser properties as well.
We were fortunate enough to listen to several representatives from our sports associations which not only use those facilities but have done a wonderful job maintaining them in both cash and labor. Also Mark Storti from the Kiwanis Club who was kind enough to pledge $75,000 to our future effort, that was both as you know a pledge and a challenge for the Town to match that and I hope we have sufficient funds to do so.
It was a very good give and take. We talked about the 1.8 million plus to succeed in this effort and one of the things that I would like to mention is that the contribution from Kiwanis on can serve as a challenge to all of us whether it is businesses or community service groups to match or at least make an effort to engage in a private/public partnership to achieve that effort.”
Councilman Bailey – “We received a letter from Mark Kestner announcing that the N.Y.S. Health Department has approved the plans and specs for the water treatment plant addition.
I mentioned at our last meeting that the Engineering Department has been looking at changing or revising the fees for commercial and residential septic installation and I would like to put that on the agenda for our next work session.”
Councilwoman DiGiandomenico – “I would like to read a letter that Jamie MacFarland received from the Burnt Hills/Ballston Lake Central Schools:
Dear Mr. MacFarland:
On behalf of the Burnt Hills/Ballston Lake School District we would like to thank you and the Town Board for your generous donation of our State Championship sign that had been placed in our town. We are very blessed with many talented student athletes and coaches and their accomplishments will always be remembered by those signs within our town.
Again many thanks and hopefully we will be able to keep our streak going.

At our last work session I brought up the subject how to make the Glenville Town Hall user friendly so in the past week and a half I have been brain storming with some of the town employees in an effort to see if we can accomplish this.
I met with residents as they came into town hall, surveyed them for their opinions and have come up with ideas such as signs, directories, etc. As a starting point we have installed some signs by the police department and the court area to see how useful they are and how they will fit into the scheme of things. Hopefully you will see our results in the very near future.”
Supervisor Quinn – “Item number 6 on the agenda is a public hearing on the proposed local law to provide for the codification of the Local Law Ordinances and certain resolutions of the Town of Glenville into a Municipal Code to be designated the “Code of the Town of Glenville”.
Supervisor Quinn opened the public hearing at 8:15 pm.
Jason Taylor, 477 Amsterdam Road – “One thing that kind of bothers me and my friends is for years the confiscation of our skateboards; we would be out on the streets, I don’t skateboard anymore but many of my friends would appreciate the harassment to stop.”

Supervisor Quinn – “Item number 7 on the agenda is a public hearing on the petition to establish a drainage district in the Willow Brook Subdivision area.”

Supervisor’s Comments:
Supervisor Quinn – “This past week our Comptroller did a good job and released to the Office of the State Comptroller our annual audit data. The data has gone forth ahead of schedule and he needs to be congratulated for doing that. We now have the data for the close out of 2005. There will certainly be some adjustments that will come in the process of human events but we have the basic document completed so we congratulate you George.
On Monday night of this week several of us were at the Alplaus Citizens Association meeting and we had a meeting with any and all citizens over there that were interested in the proposed sewer district that is being brought to light and so I would say about 50 or 60 people attended that meeting. Mark Kestner did a wonderful job as well as the other staff and we heard from the citizens and first we started out with an orientation and where we have been and where we’re at and what’s the status on the project, from the actual engineering itself to some of the specifics of the work. It was then thrown open for a general question and answer period. A lot of the folks in the audience participated in that, put forth
questions and we provided the answers. We took some good notes on some future things that they thought were important and we said we would certainly work on.
At the later half which was really as much if not all of the major part of the meeting, Mark Kestner had set up three work stations that had the actual plans so that they could go and look at their own house and share with the engineering staff that Mark brought with him what kinds of things are important to them about installing these lines from their homes out into the main water/sewer district pipelines.
We learned a lot, the engineers learned a lot and I think the folks did too. Based on the comments of the President of the Association they seemed to get something out of it. Good working relationship, we’ll continue certainly to work on that.
Yesterday we had a meeting over at the Schenectady County Airport with the County Manager. We went over the master plan for the airport itself and got a prospective on how it fits to what we are trying to do and how our master plan, their master plan fits or doesn’t fit plus some of the other things that we had questions about so we would know what was going on.
Yesterday we had a meeting here with the Mayor from the Village the Superintendent from the Scotia-Glenville School District and our engineering firm regarding the sidewalk project down at the Scotia-Glenville School area. That was an update of what’s the status, where are we at, where do we want to go from here. The public hearing has been held now what is next. We have identified two or three major items that the engineering is going to go forth and get some additional information and data for us and they will come back together once they provide us with that. Then we will decide what the next step will be on that whole sidewalk project.
Today I had a meeting along with some of the others here, Councilwoman DiGiandomenico attended as well. Congressman McNulty’s office was here and Charlie Diamond and we went over some things about the status and the attempts to move things on the GSA property down in the Industrial Park. We had a very useful conversation and we will see what results come of it. By talking to the regional manager from GSA whose offices are over in Boston, we had a conference call there and see what’s going on and see if we can’t move along the closing of the properties that they have that they are no longer using.
The Congressman’s Office says they are very interested and Charlie Diamond assured us that he will work and this will be in the center of his desk for days to come.
On this Friday, March 3rd we will have the meeting to update the group that has been working on the Scotia-Glenville water/sewer research project. Our engineers have agreed to come. Three or four representatives from the Village government as well as our people will also be here. We will get the current status; this is a look/see at the alternatives and what some of the feasibilities are really and they have been working on this project and now that we are in and on board with the new board we will see where we are on that project.
Monday, March 6th at a site to be determined we will be meeting the Schenectady County Chamber, which was set up by Charlie Steiner who is the president of the Chamber of Commerce, and the meetings purpose is for us to meet and discuss what the current activities and the future planned activities for the Military Affairs Committee that is vitally interested in things in our town that have to do with military. The Air Guard obviously is one and there are other activities planned and we need to know what they are.
There is an ongoing working relationship. We continue to pursue the Fire Training Center and the relationship between the Consortium and our town. We are doing legal research on that one to make sure we understand the relationships and the town’s participation. That is an ongoing project.
I received a phone call today from the Schenectady County Legislature, their Chief of Staff; they have an interest in following up on what we were involved in last night on the park issues to see how the county can fit in and work on the proposed planning for our parks. We can’t say what for sure, they are no details yet but we will have a meeting in the near future and I will let all of you know when that is scheduled.
The re-evaluation notices are due out today and so all of our citizens will be getting their notices in the mail. The notice has not only what the current assessed evaluation is but what the proposed evaluation will be and there are instructions there in the procedures they can follow if they wish to get more information and/or challenge the assessments.
There will be informal hearings, they make appointments and they are being conducted at 160 Saratoga Road (Terwilliger Barn), so they make an appointment, they go done there and talk it over, bring data, learn what they can or can’t do with the group. There will be as you all know a formal hearing that will be coming up later in the April time frame so we can get the rolls finally set.
Those are the formal opportunities for people if they want to to challenge the assessments.
The Planning Department is moving forward in the sense of the activities related to the Open Space Committee. We passed a resolution and now we’re getting down to the implementation of that committee, it’s mission and of course what it’s activities and membership should be.
Those of us on the board are going to recommend who we think should be on it. We have a list of people who volunteered to be on it and so we will continue to move on that project.
The negotiations with the unions are under way. First is with PBA and so our attorney who is working that project for us and with us has been in contact and we are moving on that project.
I’ll be having a meeting and if any of you would like to join please do, with the Scotia-Glenville, Burnt Hills/Ballston Lake Supervisors and the subject matter for the meeting is the utilization of the SRO Officers and the DARE Officers for the 2006-2007 school year.”

RESOLUTION NO. 82-2006

WHEREAS a vacancy currently exists in the departments’ Detective Section as a result of the retirement of Detective Greg Restina on 1/13/06, and
WHEREAS the 2006 Police Budget does provide for the funding for this position in its staffing, and
WHEREAS an Interview Committee did meet and conducted interviews with police officers of this department for this position,
NOW, THEREFORE, BE IT RESOLVED that this Town Board does hereby authorize the Deputy Chief of Police to appoint Officer Michael Petroski of the Glenville Police Department to the position of Detective with an effective date to be determined by the Deputy Chief of Police, and
BE IT FURTHER RESOLVED that the compensation be as set forth in the current P.B.A. Contract for the position of Detective at $58,593.00.

WHEREAS a vacancy currently exists in the position for Police Sergeant as a result of the retirement of Sergeant Alan Craver on 3/06/06, and
WHEREAS the 2006 Police Budget does provide for the funding for this position in its staffing, and
WHEREAS an Interview Committee did meet and conducted interviews with police officers of this department who have successfully completed and are eligible candidates for this position on the Civil Service list provided by the Schenectady County Civil Service Commission,
NOW, THEREFORE, BE IT RESOLVED that this Town Board does hereby authorize the Deputy Chief of Police to promote Officer Edward Casey of the Glenville Police Department to the position of Police Sergeant on a provisional basis subject to Schenectady County Civil Service Rules and Regulations with an effective date to be determined by the official retirement date of Sergeant Alan Craver, and
BE IT FURTHER RESOLVED that his compensation be as set forth in the current P.B.A. Contract for Police Sergeant at $61,909.00.

RESOLUTION NO. 84-2006

WHEREAS the County of Schenectady is participating in the New York State Special Traffic Options Program for driving while intoxicated, and
WHEREAS the STOP-DWI Steering Committee, and the Schenectady County Legislature, in the formulation of the County STOP-DWI Plan have agreed to support heightened law enforcement of the DWI laws,
NOW, THEREFORE BE IT RESOLVED that this agreement is entered into and executed by the County of Schenectady and the Town of Glenville as a municipality desirous of reducing the tragic loss of life and personal injury which results from drunk driving within the County. This will be achieved in part, through the participation and cooperation of the law enforcement agencies of the parties to this agreement, acting collectively to implement the enforcement of the County STOP-DWI Plan, and
BE IT FURTHER RESOLVED the County’s and the Town of Glenville’s liability shall not exceed that amount identified by the duly endorsed plan, or the plan as amended and the County and the Town of Glenville shall not be required to fund the program in an amount greater than received in fine revenues for the period of this agreement, and
BE IT FURTHER RESOLVED that this contract shall be effective from January 1, 2006 to December 31, 2006. Each participating party retains the right to withdraw from the STOP-DWI Program at any time. Such withdrawal must, however, be made by vote and written notice from the governing body of the participating agency.

WHEREAS, Jan Warner, 31 Sacandaga Road, Scotia resigned from the Assessment Board of Review,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby appoints Michele Wilcock, 511 Sacandaga Road, Glenville to serve on the Assessment Board of Review in the Town of Glenville, Schenectady County, New York, commencing immediately and expiring September 30, 2008; and
BE IT FURTHER RESOLVED that the Board of Assessment Review be reimbursed as follows: $100.00 per person per day for Grievance Day and $25.00 per person per hour for sessions following Grievance Day, with the Chairman of the Board of Review receiving an additional $50.00 for his/hers services.

WHEREAS a written petition has been presented to and filed with the Town Clerk of the Town of Glenville by Princetown Developers, LLC, requesting that the Town Board of the Town of Glenville establish a drainage district in the Town of Glenville with said district to include the real property as described on the Schenectady County Real Property Tax Service Agency maps as section, block and lots 16.13-5-10, 16.13-5-11, 16.13-5-12, 16.13-5-13, 16.13-5-14, 16.13-5-15, 16.17-1-24, 16.13-5-17, 16.13-5-18, 16.13-5-19, 16.13-5-20, 16.13-5-21, 15.20-5-1, 15.20-5-2, 15.20-5-3, 15.20-5-4, 15.20-5-5, 15.20-5-6, 15.20-5-7, 15.20-5-8, 15.20-5-9, 15.20-5-10, 15.20-5-11, 15.20-5-12, 15.20-5-13, 15.20-5-14, 15.20-5-15, 16.13-5-22, 16.13-5-23,

WHEREAS a public hearing on the petition to establish the drainage district was held on the 1st day of March, 2006, during which all persons interested in the establishment of the drainage district were heard,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville determines and finds as follows:
a) The petition is signed and acknowledged as required by law and is otherwise sufficient.
b) All the property and property owners within the proposed drainage district are benefited thereby.
c) All the property and property owners benefited are included within the limits of the proposed drainage district.
d) It is in the public interest to grant, in whole, the relief sought which is the establishment of the drainage district,

BE IT STILL FURTHER RESOLVED that the establishment of Drainage District No. 7, also known as Willow Brook Subdivision, is hereby approved with the property included therein be the same as the parcel section, block and lot numbers as set forth above.

RESOLUTION NO. 87-2006

WHEREAS, the Town of Glenville passed a resolution 63-2006 on 1/18/06 determining that the building at 1644 Rector Road tax map ID 14.-1-34 is unsafe and dangerous and presents a clear and imminent danger to the life, safety and health of any person who may be in it or near it, and duly served notice upon the persons and in the manner set forth in Sections 9-5, 9-6, and 9-7 of the Code of the Town of Glenville, New York and
WHEREAS, the cost of maintaining/securing the building has been determined to be $1,702.18 using highway staffing and material purchases; and
NOW, THEREFORE, BE IT RESOLVED, that the highway department be authorized to secure the building at 1644 Rector Road tax map ID 14.-1-34 at a cost not to exceed $1,702.18, and
BE IT FURTHER RESOLVED, that the maintenance securing costs of $1,702.18
Be attached and levied on the property at 1644 Rector Road tax map ID 14.-1-34, and
BE IT STILL FURTHER RESOLVED, the following budgetary transfer is approved.

RESOLUTION NO. 88-2006

WHEREAS, upon the resignation of Police Chief Dan Boyle on January 30th, 2006, Deputy Chief Dominick Macherone has assumed the duties and responsibilities of Chief of Police for the Town of Glenville; and
WHEREAS, it is the intention of the Town Board to recognize and compensate Deputy Chief Macherone for performing the duties of Police Chief in a professional and responsible manner,
NOW, THEREFORE, BE IT RESOLVED that effective 3/1/06, Deputy Chief Macherone will be compensated at the rate of $85,000 per annum; and
BE IT FURTHER RESOLVED that the higher compensation rate shall continue until such time that the position of Chief of Police in the Town of Glenville is filled, or until a further resolution of this board, after which Deputy Chief Macherone’s pay rate will return to the level that would otherwise be in place if this pay rate adjustment did not occur.

Councilman Bailey – “This is a situation where we need for the benefit of the residents on Rector Road; we need to get the water project moving. The work was to be funded by issuing bonded debt. The process of issuing the bonds took longer than we thought so we need to be able to address our expenses to date and that is what this fund transfer is.
It will cover fees and costs associated with Rector Road water extension including the preliminary phase work, obtaining easements, mapping, ground control, test borings and the basic design phase work of preparing plans and specifications as well as bidding an award.”
RESOLUTION NO. 89-2006

WHEREAS, the Town of Glenville has authorized work by Kestner Engineers, P.C. on Water District #11 Extension #33 (Rector Rd.) of $103,131; and
WHEREAS, the Town issuance of bond debt for Water District #11 Extension #33 will be delayed by several months to comply with public notice requirements,
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby authorizes the inter fund borrowing from the Water Town District #11 fund up to $103,131 for the capital project of Water District #11 Extension #33 until the bond debt can be issued this year to replace the due to and due from borrowing. The finance charge will reflect the interest income that the funds otherwise would have earned.
