“SPECIAL” ORGANIZATIONAL MEETING OF THE TOWN BOARD
TOWN OF GLENVILLE
JANUARY 4, 2006
AT THE GLENVILLE MUNICIPAL CENTER

Present:        Supervisor Frank X. Quinn, Councilmen, Robert E. Bailey, Mark A. Quinn, Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico

Absent: None

                Supervisor Quinn called the meeting to order at 7:30 PM.   Supervisor Quinn gave the Invocation and led us in the Pledge of Allegiance.

                Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll.  Everyone was present and accounted for.


Supervisor announces the following appointments:

        a).     Deputy Supervisor – Robert E. Bailey
        b)      Commissioner of Public Works, Richard D. LeClair
        c).     Deputy Highway Superintendent, Jeffrey Gemmette, per recommendation of Highway Superintendent.
        d)      Deputy Commissioner of Public Works, Jeffrey Gemmette
        e).     “The Town Clerks announcement on Ethics.”

Town Clerk, Linda C. Neals: “I would like to notify each one of the Town Board Members of their obligations to maintain the confidentiality pursuant to the Town Code of Ethics.”

                BE IT RESOLVED that the Town Board of the Town of Glenville hereby ratifies the appointments of Richard D. LeClair to the position of Commissioner of Public Works of the Town of Glenville.

                Councilman Quinn – “I just wanted to mention that I am amenable to every one of these times with the exception of this meeting.  I will respect the will of the Board however my personal preference would be to keep the Town Board meeting at 7:30 pm and if anything I would move in the opposite direction and match them up to our present work sessions which are at 7:00 pm.”

RESOLUTION NO. 3-2006

                BE IT RESOLVED, that the regular meetings of the Town Board of the Town of Glenville shall be held on the first and third Wednesday of the month during the year 2006, excepting the months of June, July and August when the said regular meetings shall be held only on the third Wednesday of those respective months, and

                BE IT FURTHER RESOLVED, that the Town Board will meet in a work session on the second and the fourth Wednesday of each month on an as needed basis; and

                BE IT FURTHER RESOLVED, that all regular meetings shall convene at 8:00 P.M., prevailing time and unless otherwise designated, within sufficient time, shall be held at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York, and

                BE IT STILL FURTHER RESOLVED, that the following Boards and Committees will meet as follows:

                BE IT RESOLVED, that all town officers and employees, including members of the Planning and Zoning Commission and members of the Board of Appeals, when necessary to use their own automobile in the performance of their respective duties and responsibilities and upon submission and approval of an itemized account of the mileage traveled, shall be entitled to reimbursement at the rate of 44.5 cents per mile for the year 2006.

                WHEREAS, the Town Board of the Town of Glenville has authorized Glenville’s participation in the Schenectady County Cable Consortium Council for the purpose of intermunicipal cooperation in negotiating various municipalities cable franchise agreements, and

                WHEREAS, the Town of Glenville needs to designate a representative and an alternate to this council,

                NOW, THEREFORE, BE IT RESOLVED, that Frank X. Quinn, 1886 Ridge Road, Glenville, Town Supervisor, is hereby designated as Glenville’s representative and James MacFarland, Director of Human Services, is hereby designated as Glenville’s alternate for the period of January 1, 2006 through December 31, 2006.

RESOLUTION NO. 27-2006

                WHEREAS, the Board of Representatives of the County of Schenectady has issued a Certificate to the Chief Financial Officer of the Town Certifying that the contribution of the Town of Glenville to the taxes of the County of Schenectady for the fiscal year beginning January 1, 2006 is $12,598,038.10; and

                WHEREAS, the Town must levy said sum against the taxable real estate, and direct the extension of such taxes against each such parcel,

                NOW, THEREFORE, BE IT RESOLVED

                1.  The Town Board of the Town of Glenville does hereby levy the sum of $12,598,038.10 certified to it by the County Legislature as said Town's contribution to the taxes of the County of Schenectady for the fiscal year beginning January 1, 2006.

                2.  The taxes due the County of Schenectady shall be extended against each parcel of taxable real estate at a rate to be established by the County of Schenectady per $1000 of taxable assessed value.

                3.  The Supervisor is hereby directed to execute and deliver a certificate to the Board of Representatives of the County of Schenectady certifying that the levy has been made and the extension of taxes directed in accordance with law.

                Supervisor Quinn – “The next resolution is a resolution establishing salaries, the annual salaries for employees who are not members of a recognized bargaining unit.

                I would like to amend the wording in this.  First of all I will read what the wording really is, “It is hereby resolved that the annual salaries of the employees who are not members of a recognized bargaining unit” and then it proceeds to list all of those folks and you would commonly refer to those folks as management in the organization.  I would like to amend this resolution so that it reads:

                It is hereby resolved that the annual salaries of the employees who are not members of the recognized bargaining unit in the Town of Glenville commencing January 1, 2006 shall be as follows:

                Councilman Quinn seconded the motion to amend.

                Supervisor Quinn – “For those of you who are not aware of it, we have decided that as a point of caution that first of all we are going to hold these management salaries at the 2005 level so that there are no increases in these salaries.  We are doing this for two reasons, one we have got to get the final numbers and the close-out for the past year so that we are not making any moves on salaries increases for the management folks until we know for sure what the real numbers are and how we close out this year and what we really have to work with in 2006.

                The second consideration is, we have all three of our contracts with our unions up for negotiations this year and before we go making salary adjustments for anybody we’ve got to determine what the impact of that would be.  We are engaging in that process as the year progresses here and so we are just holding tight.  This does not preclude raises happening at some other time it is just until we get a handle on it, until we know what we are really dealing with we are going to hold off on this until we know what we really have to work with.”

                WHEREAS proper accounting practices require that a contract be entered into between the Town of Glenville and the County of Schenectady before the Town of Glenville contributes to the Indian Kill Open House and Fishing Day,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the payment not to exceed the sum of One Hundred Dollars ($100.00) to the County of Schenectady to support the Indian Kill Open House and Fishing Day, which will take place in May, 2006, and in exchange for which the County of Schenectady will organize, coordinate and run the Indian Kill Open House and Fishing Day at which event Glenville youths fifteen years of age or younger will have the opportunity to catch trout, learn about trout habitats and stream biology; and

                WHEREAS, Freedom Park, which is located within the Village of Scotia, New York, and

                WHEREAS, Freedom Park is a non profit organization made up of unpaid volunteers, and

                WHEREAS, Freedom Park expenses consist of paying performers and a sound technician as well as maintaining the sound system, and

                WHEREAS, each year Freedom Park strives to provide a diversity of programming that will serve a variety of audiences from preschoolers to senior citizens at the Wednesday night performances from the end of June through the end of August, and

                WHEREAS, acts include big band, country, popular, Polish, Celtic, German, jazz, Dixieland and rhythm and blues, and

                WHEREAS, admission to all performances are free, and

                WHEREAS, most of the funding for Freedom Park comes from contributions made by individuals and families in the area, and

                WHEREAS, the Village of Scotia contributes, each year, along with maintaining the physical plant, and

                WHEREAS, the Town Board of the Town of Glenville is desirous of continuing its support to Freedom Park by giving of its fair share,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the payment, not to exceed the sum of Two Thousand Two Hundred Fifty Dollars ($2250.00), for the support for the 2006 Summer Concert Series in Freedom Park, Village of Scotia, New York, and

                WHEREAS Catholic Family and Community Services of Schenectady and Catholic Charities of the Diocese of Albany are desirous of providing a nutrition program for the citizens over the age of 50 to the Town and its' senior residents,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves the attached contract between the Town of Glenville and Catholic Family and Community Services of Schenectady and Catholic Charities of the Diocese of Albany and authorizes payment of a contribution, not to exceed the sum of Five Thousand Dollars ($5,000), for the provision of a nutrition program for the citizens over the age of 50 at the Glenville Senior Center; and

                WHEREAS it appears to be in the best interest of the residents of the Town of Glenville for the Town to enter into a contract with the Scotia-Glenville Senior Citizens Recreation and Related Concerns, Inc.,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves the attached contract with the Scotia-Glenville Senior Citizens Recreation and Related Concerns, Inc. for its use of the Glenville Senior Center; and

                WHEREAS, the withdrawal of the Scotia Glenville School District has necessitated a relocation of the program from the Glenville YMCA to the offices of Community Human Services (CHS), 543 Saratoga Road, Glenville ; and

                WHEREAS, the Burnt Hills-Ballston Lake School District and the town of Ballston are continuing to contribute to this program at previous levels,

                NOW, THEREFORE, BE IT RESOLVED that the Supervisor of the town of Glenville is hereby authorized to enter into agreement with Community Human Services, 543 Saratoga Road, Glenville, NY for the purpose of providing an after school program, “School’s Out”; and

RESOLUTION NO. 44-2006

                WHEREAS a vacancy currently exists in the position for Police Sergeant as a result of the retirement of Sergeant Gilford L. Powers, and

                WHEREAS the 2006 Police Budget does provide for the funding for this position in its staffing, and

                WHEREAS an Interview Committee did meet and conducted interviews with police officers of this department who have successfully completed and are eligible candidates for this position on the Civil Service list provided by the Schenectady County Civil Service Commission,

                NOW, THEREFORE, BE IT RESOLVED that this Town Board does hereby authorize the Chief of Police to promote a member of the department to the position of Police Sergeant on a provisional basis subject to Schenectady County Civil Service Rules and Regulations with an effective date to be determined by the Chief of Police, and

                BE IT FURTHER RESOLVED that his compensation be as set forth in the current P.B.A. Contract for Police Sergeant.

RESOLUTION NO. 45-2006

                WHEREAS, five vacancies currently exists in the police department as a result of the retirement of officers of the department, and

                WHEREAS, two additional vacancies are expected by the end of January 2006 resulting from the retirement of two more department members, and

                WHEREAS, the 2006 Police Budget does provide for the funding of all these positions in its staffing, and

                WHEREAS, the Basic Course for Police Officers will start on January 18, 2006, and

                WHEREAS, the Town Board did authorize the Chief of Police to canvass and to conduct backgrounds investigations, interviews and all pertinent pre-employment processing work with prospective candidates to allow for the hiring of three officers, and

                WHEREAS, the Police Chief hereby concurs with the recommendations forwarded to him by our Detective Section,

                NOW, THEREFORE, BE IT RESOLVED, the Town Board does hereby authorize the Chief of Police to hire three candidates for the position of Police Officer with an effective date to be determined in meeting the immediate needs of the department and/or the Basic Course for Police Officers, and

                BE IT FURTER RESOLVED, that the compensation for said officer be as set forth in the current P.B.A. Contract.

                WHEREAS a vacancy currently exists in the departments’ Detective Section as a result of the retirement of Detective David Kownack, and

                WHEREAS the 2006 Police Budget does provide for the funding for this position in its staffing, and

                WHEREAS an Interview Committee did meet and conducted interviews with police officers of this department for this position,  

                NOW, THEREFORE, BE IT RESOLVED that this Town Board does hereby authorize the Chief of Police to appoint a member of the Glenville Police Department to the position of Detective with an effective date to be determined by the Chief of Police, and

                BE IT FURTHER RESOLVED that the compensation be as set forth in the current P.B.A. Contract for the position of Detective.
