Present: Supervisor Frank X. Quinn, Councilmen Mark A. Quinn, Edward F. Rosenberg and Councilwoman Valerie M. DiGiandomenico
Absent: Councilman Robert E. Bailey
Supervisor Quinn called the meeting to order at 8:00 PM. gave the invocation and lead us in the Pledge of Allegiance.
Supervisor Quinn asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for except for Councilman Bailey.
Town Council Reports:
Councilman Rosenberg – “I have a report from the Planning Department. They have completed parts two and three of the full environmental assessment form for the proposed Public Safety Training Facility and that’s going to be before us soon regarding a decision on whether it will be a positive declaration or a negative declaration.
The Planning Department has prepared some zoning text amendment applications and SEQRA documentation to add commercial and non-for-profit recreational use as a site plan review use in a suburban residential zoning district to accommodate a pending expansion of the Greater Glenville Family YMCA.
They also prepared an application, a SEQRA documentation for the proposed amendments to Freemans Bridge Road Master Plan. They presented those proposed amendments to GECC; they in turn recommended the revisions. They basically did a negative declaration on it. The PZC will review the proposed amendments at their December 11th meeting. The Planning Department has met a couple of times with NYSDOT about the Lowe’s project to go over the Freemans Bridge Road Master Plan
as it applies to Freemans Bridge Road.
There is another meeting scheduled and I will be attending along with Supervisor Quinn and other Town representatives over in Schenectady on Monday December 11th to speak with DOT about some changes that we might want to do as they pertain to Freemans Bridge Road that Lowe’s is proposing.
There is a four lot sub-division on Dawson Road that went through.”
Councilwoman DiGiandomenico – “The Efficiency in Government Committee has an opening. If anyone is interested please contact me before the end of the year.”
Councilman Quinn – “Regarding the Park Planning Commission; we met last week and very exciting news the first phase of the Indian Meadows improvement plan is nearing completion. If you get a chance please visit the newly installed playground and
there will be a grand opening this spring.
There is a three story climbing and sliding apparatus that you must see. There is also additional equipment that is being installed near the pavilion. To my knowledge there is just a bit of grading and mulching that needs to be done.
Secondly, our new sub committee, the Park Development Committee, which consists of business leaders and youth sports league leaders, has met with us twice. They are currently reviewing our financial plan and helping us to create new partnerships with the private sector in order to not only enhance our funding stream but also increase park awareness.”
Supervisor Quinn - “Item No.5 is a presentation of the “Annual Green Corners One Room School” by Adrienne Karis. We always look forward to the presentation by Mrs Karis.”

The following people exercised the Privilege of the Floor:
Henri Plant – “What this is really is my Christmas Wish List. I expect you people to play Santa.
It is really amazing that our earth here that we live on has been called the water planet but it is also terrible to think that only about 1% of all of that water is potable. This puts our aquifer right out there as a rare and precious gem of a natural resource and it deserves increased protection. It is really a unique aquifer in effect that it exists but it is also unique in the fact that we don’t have to rely on rain water to refurnish it. We have the rain water and the
dam systems that help to do that.
I think the intermunicipal watershed rules have to be reviewed and they have to be strengthened at least the fines have to be increased for people who are doing things that are detrimental to the aquifer.
They should be increased to the point that it becomes prohibitive for anybody who would even think about doing things that would even remotely hint of a threat to the aquifer.
There also should be a project to determine what goes on over our recharge area. What are the activities that are going on over the recharge areas? We should have an inventory of the activities and monitor them.
We also need a water quality policeman to do that monitoring and I think it would be best to have one and do it on a regional basis.
We need to have a rule that says “no” to any development over the recharge area providing that we must also have some kind of means to compensate the property owners so that they can make up for their loses.
In addition I think some sort of an aquifer protection fund must be established.”
Supervisor’s Comments:
Supervisor Quinn shared the following information:
On November 22nd I participated in one of the monthly meetings of the Center for Economic Growth, which is the local government counsel of all the mayors and supervisors of the municipalities. We reviewed current events of development, economic development especially, in the region and discussed again and added and collected more information on the plant that is due to be going in to Luther Park. What we are trying to do and we are waiting for some case studies, they have looked at other towns and other cities that have experienced these things and we’ve got that information and right now they are putting together what’s the data of the impact on infrastructure, not only the obvious, the water, the sewers and those kinds of things, but also on school districts, municipal governments and so forth. They are due out with a report hopefully by the first of the year and you will all get a copy as soon as I do.
On the 28th we had a meeting here of the Technical Committee, Intermunicipal Watershed Board, and what is on their plate right now the Technical Committee is to come up with a proposed local town ordinance, for all of the towns in Schenectady County, as well as the City, to increase the penalties and the fines for violating any of the Watershed Rules. We expect to have the draft this month so that we can take some of the actions, not only to meet Henry’s Christmas list but we have many
of the exact same items on the agenda. If all goes well we have a law, because right now it’s a toothless tiger that would do the fines that I am asking like a thousand dollars a day if you are threatening the aquifer and if you do something you have to take it back out. If you put debris in there or you build something that shouldn’t be there they have to not only pay the fine but they would also have to remove whatever it was that they put there.
On the 30th I went to a meeting up at the Burnt-Hills/Ballston Lake School District with local community leaders and school district leaders regarding an orientation on the proposed chip plant for Luther Forest.
I also visited and called the Health Department about the folks that were here at our last meeting about the folks on the South Holmes property. The answer that I got time after time is the property is not in violation of any current laws. While it is a problem and while the citizens have a problem there is no local law or County law that can be enforced that anybody can give us to work with. The property is owned, the taxes are paid and they keep it up to a minimum standard and the short of the owners or the neighbors going to civil court or the owners taking action on their own there’s nothing that we can find in any of the codes.
On December 14th here at Town Hall there’s a meeting with the Regional Director responsible for the GSA property status. That is at 1:30 pm.
On the 13th is our regular work session and one of the items on there will be the quarterly review and analysis of our funds and where we are so that by the end of the year when we make any year-end adjustments you are all up to speed prior to the year-end meeting.

WHEREAS the Town of Glenville was awarded funding through NYS Empire Development under the Build Now NY program for redevelopment of the Scotia-Glenville Industrial Park, and
WHEREAS the grant award budget includes the engagement of planning consultants for various activities under the Build Now NY program, and
WHEREAS the Town of Glenville has conducted a competitive bid process and is desirous of entering into a contract with Clough Harbor & Associates, LLP located at III Winners Circle, Albany, New York 12205 as planning consultants for the Scotia-Glenville Industrial Park project, and
WHEREAS the Town of Glenville will be reimbursed under Build Now NY grant funding and Schenectady County IDA matching funds for services provided by CLA in relation to the awarded project, with associated costs not to exceed $150,000,
NOW, THEREFORE, BE IT RESOLVED that Frank X. Quinn, Town Supervisor, is authorized to act on behalf of the Town of Glenville in all matters related to the execution of this contract conditioned upon the approval of an extension of the grant by the State of New York and subject to approval of the final contract by the Town Attorney.

BE IT RESOLVED, that the Town Board of the Town of Glenville will meet at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York on December 27, 2006 at 7:30 P.M., for the purpose of conducting any year-end business to come before said board, which meeting shall be a “SPECIAL SESSION” of the Board and open to the public.

NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby rejects all bids received and opened on November 6, 2006 for the repair to the Town Highway Garage roof; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Commissioner of Public Works to re-advertise for bids for the roof repair on the Town Highway Garage; and
BE IT FURTHER RESOLVED, that all bids must be received in the Town Clerk’s Office, 18 Glenridge Road, Glenville, New York by no later than 10:00 AM, on December 27, 2006 and opened on December 27, 2006 at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York at 10:20 AM; and
BE IT STILL FURTHER RESOLVED, that the following funding for said project will be 01.00.5132.4109 Renovations.

RESOLUTION NO. 235-2006

WHEREAS, there has been an agreement between FCC and Nextel for reassigning of frequency in the 800 band; and
WHEREAS, the Town of Glenville does falls under these parameters and Motorola has reviewed the system here and compiled a report advising us of all the changes necessary for re-banding and the cost. Under the same agreement the Town of Glenville has included the time incurred by both Lt. Conley and Attorney Dickson. This money will be reimbursed to the Town of Glenville by Nextel; and
WHEREAS, there is no direct cost to the Town of Glenville, all fees for both equipment and labor will be paid by Nextel directly to the vendor, Motorola,
NOW, THEREFORE, BE IT RESOLVED, that Lt. Conley is hereby authorized to enter into an agreement with both Motorola and Nextel to handle the re-banding of our 800 MHz Radio System at no cost to the Town of Glenville.

RESOLUTION NO. 239-2006

WHEREAS, the Town of Glenville requested bids for lines of general property casualty insurance with the understanding that the winning bidder would also win the renewal of workers compensation and Marshall and Sterling won the bid, and
WHEREAS, the bid for the lines of general property casualty for the Town is under budget approximately $58,119 exclusive of the to be added on new water plant upgrade/old plant retrofit casualty insurance costs, and
WHEREAS, the renewal of workers compensation for the Town is under budget approximately $16,175 with the inclusion of the Fire Fighters workers compensation coverage flow through costs of approximately $100,652, and
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Glenville Town Board authorizes the purchase of services from Marshall and Sterling of general property casualty insurance of $198,770 and workers compensation of $277,007.

Supervisor Quinn – “If anyone is interested please get those nominations in because it is very helpful if we can get them included in our re-organization meeting on January 3rd.”
