This Town Board Meeting convened at 6:00 p.m. to conduct budget reviews with invited department heads.
At 7:00 p.m. a motion was made Councilman Russo and Seconded by Councilman Denney to adjourn into Executive Session to discuss potential litigation.

Supervisor Mosher called the meeting to order at 7:30 PM. Supervisor Mosher gave the Invocation and Ed Baker was asked to lead us in the Pledge of Allegiance.
Supervisor Mosher asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for except for Councilman Mark A. Quinn, due to illness.
Town Councilmen Reports:
Councilman Russo – “Campaigning and working on the budget is pretty much where my time has been spent.”
Councilman Denney – “Working very hard on the budget.”
Councilman Bailey – “Working hard on the budget.”
Presentation: Fire Chief Kasko and Trustee Kastberg presented the quarterly report to the Town Board regarding Fire Protection District #4.
Chief Kasko – “Thank you for the opportunity to present the quarterly report of the Scotia Fire Department. I have provided a lot of background information in your packets and I will briefly summarize the report.
Emergency response activities calls to date at the beginning of October were 1,079, 838 of those calls we in the Village of Scotia and 171 were in District No. 4, 72 were in the Industrial Parks and 44 were mutual aid.
All apparatus and equipment is in service. One note I would like to make the tower ladder and ground ladders were expected this year by National Testing. Everything passed with some minor recommendations.
Under Special Operations, one thing I wanted to bring up is two campaigns we did, one with Channel 6 News on the new tot finder stickers and one with Fox 23 News on fire safety and fire escape plans in the home.
On the new generator for the Fire Department, it has been installed and is operational.
Training – This summer we did a joint water rescue drill with Niskayuna Fire District One. Another thing we participated in was four of our members attended a workshop, School Emergency Workshop, for teachers knowing what to do. We were invited to attend to provide our input to the teachers and interact with them during the training session and it was very successful. There was a lot of faculty from the Scotia-Glenville School District there, so it was a very productive training session for all of us.
We have three new volunteer firefighters that are enrolled in the firefighter course at this time plus one additional firefighter that attended training this summer in the southern part of the state.
This month we conducted a drill in the Corporation Park, a mass casualty incident and we were able to exercise a number of skills like auto extrication, car fires, triage and incident management.
Under training, volunteer firefighter C.J. Keller attended state women’s weekend in Montour Falls in September.
At this months Village Board Meeting the Fire Department received a one thousand dollar ($1,000) grant from Factory Mutual in support of arson investigation. This grant is to go towards helping us to buy some basic equipment to help in investigating fires.
The over time stats are attached. We did a first aid class for Super Steel and it was very successful. We did first aid, CPR, AED, ran them through some scenarios and there are forming an initial emergency response team for within their facility.
Our Annual Fund Drive is underway.”
Councilman Denney – “The overtime item that you presented to us, what is ’05 recovered hours?”
Chief Kasko – “These are hours that we recovered for example when training through Homeland Defense Grant money. So we do in service training with the career firefighters and some of that training has been done through grants through Homeland Defense.”
Councilman Denney – “So are those in addition to the green (shown on chart) ’05 hours or inclusive?”
Chief Kasko – “Inclusive”
Councilman Denney – “So if you netted those out that would be… you didn’t put the ’04 so I am assuming there is some of that recovered hours in there too.”
Chief Kasko – “There were some, very minor.”
Councilman Denney – “It was a very good report. I noticed that there was a lot more information and I guess more soft information too some of the photos and that sort of thing and that is good to see. I think the reports are really coming around nice and they are very helpful.”
Councilman Bailey – “Do you have a program for exercising the new generator in periodic load tests, like once a month or something like that, to make sure it runs.”
Chief Kasko – “Yes we do. It has an automatic start and we are running a standard operating guide for it with a check list when it has been checked for periodic maintenance.”
Supervisor Mosher – “Item No. 6 is a public hearing to consider any objections, which may be made to the Assessment Roll for Water District No. 11 and Extensions No. 1 through 31.”

Discussion…
Attorney Mastro – “This is the final culmination of this Town Boards approval of the entire lengthy and sometimes tiresome approval process. The comptroller had an opportunity to review all of the submitted data. They have reviewed and made recommendations to each of these two resolutions and they have given us their top self blessing.
The original resolution that had been approved by the Comptroller’s Office some months ago was broken down into two separate resolutions and as you know we are not only doing an extension to the Alplaus Sewer District but we are also doing improvements to the existing district, so at the request of the Comptroller we have two resolutions. One approving the extension and one approving the improvements to the existing district and those are resolutions no. 210 and 211, which follow.
Once the Board has adopted these resolutions these will be submitted to the Comptroller and the Comptroller’s Office is in process of already reviewing and hopefully approving the overall project. They have assured us that they are continuing to work through their process and they will just add this to their list of documents that they need to see before final approval.
In advance of tonight’s meeting we had provided them copies of these resolutions and we have their blessing.”

EXTENSION NO 1 OF ALPLAUS SEWER DISTRICT NO. 1
WHEREAS, a written petition has been presented to and filed with the Town Clerk of the Town of Glenville requesting an extension of Alplaus Sewer District No. 1; and
WHEREAS, that the extension consists of the real property described in the list of parcels attached to the petition, consisting of 139 parcels identified on the Schenectady County real property tax service agency tax maps by the section, block and lot numbers included therewith; and
WHEREAS, a certified copy of the Order of the Town Board calling for the hearing on the petition was duly published in the Daily Gazette, the official newspaper of the Town of Glenville on September 12, 2005, and a certified copy of the Order calling the public hearing was posted upon the bulletin board in the Municipal Center in the Town of Glenville on September 8, 2005; and
WHEREAS, a public hearing was held, pursuant to Resolution No. 185-2005, at the Glenville Municipal Center at 18 Glenridge Road, Glenville, New York, on September 21, 2005 at 7:30 in the evening, and the petitioners having appeared in support of the application for the sewer district extension and the improvements, and all persons interested in said extension were heard and proof having been presented concerning the same; and
WHEREAS, the Town Attorney of the Town of Glenville has examined the petition and affirmed to the Town Board that the petition is signed and acknowledged, as required by law and is otherwise sufficient; and
WHEREAS, the Assessor of the Town of Glenville has certified to the Town Board that the petition is signed by the owners of taxable real property situate in the proposed district or extension owning in the aggregate at least one-half of the assessed valuation of all of the taxable real property of the proposed district or extension and by resident owners owning taxable real property aggregating at least one-half of the assessed valuation of all the taxable real property of the proposed district or extension and all such property owners are benefited thereby; and
WHEREAS, it is in the public interest to grant the relief requested in the petition; and
WHEREAS, the petition for the extension and the improvements was accompanied by a Map, Plan and Report prepared by Kestner Engineers, P.C., dated July, 2003, which shows the boundaries of the proposed extension; and
WHEREAS, the Town Board has given due deliberation to the hearing and the testimony and the proof presented and has determined to approve the extension requested in the petitions;
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby finds and determines that the petition is signed and acknowledged or proved as required by law and is otherwise sufficient and complies with the applicable provisions of the Town Law of the State of New York; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby finds and determines that all of the property and property owners within the proposed extension of Alplaus Sewer District No. 1 are benefited thereby; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby finds and determines that all of the property and property owners benefited are included within the limits of the proposed extension and that no property or property owners or interested persons benefited by the extension have been excluded therefrom; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby finds and determines that the extension and expenditure for which permission is sought is in the public interest and will not constitute an undue burden on the property which will bear the cost thereof; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby finds and determines that the cost of the proposed improvements is to be assessed in whole or in part against the benefited area and that all real property to be assessed will be benefited by the proposed improvements and that no benefited property has been excluded; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby approves the extension of the Alplaus Sewer District No. 1, as set forth in the petition and Map, Plan and Report submitted by Kestner Engineers, P.C., subject to the review, approval and Order of the Comptroller of the State of New York approving the proposed extension of Alplaus Sewer District No. 1; and
BE IT FURTHER RESOLVED that the maximum amount proposed to be expended for the improvements to this extension to Alplaus Sewer District No. 1 is $1,466,466.00; and
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville does hereby confirm that the Application for permission of the State Comptroller was prepared at the direction of the Town Board of the Town of Glenville and that the Town Board believed the contents of said Application to be accurate, and hereby directs the Town Clerk to file a certified copy of this Resolution, along with such other appropriate documents as are necessary, with the Comptroller of the State of New~York for approval and Order.

WHEREAS, that the District consists of the real property described in the list of parcels attached to the petition, consisting of 66 parcels identified on the Schenectady County real property tax service agency tax maps by the section, block and lot numbers included therewith; and
WHEREAS, a certified copy of the Order of the Town Board calling for the hearing on the petition was duly published in the Daily Gazette, the official newspaper of the Town of Glenville on September 12, 2005, and a certified copy of the Order calling the public hearing was posted upon the bulletin board in the Municipal Center in the Town of Glenville on September 8, 2005; and

Councilman Denney – “The purpose of the proposed moratorium, which we talked about in quite a bit of detail and I missed the hearing a couple of weeks ago but I understand that most of the folks that attended were supportive is to essentially stop the clock, enable us to buy some time to get moving with the open space planning process. My expectation is that by the end of January of next year we’ll have an open space committee formed, they will have a formal charge and we probably will be in a position to consider possible extension of this but my desire would be to try and narrow the scope of it if we are going to consider an extension we need to stop the clock and buy some time and so that is the purpose of this
resolution.”
Councilman Bailey – “This is a relatively brief moratorium. It ends on January 31st and the Town has a lot of work to do in this period of time to achieve our goals.”
RESOLUTION NO. 212-2005

WHEREAS, the Town of Glenville has proposed a local law (Local Law #3 of 2005) that would establish a moratorium on all new residential subdivision applications involving lands currently zoned “Rural Residential and Agricultural” (RA); and
WHEREAS, the moratorium is in response to the loss of open space (i.e. agricultural land, scenic vistas, wooded areas, etc.) which is occurring rapidly as a result of a robust housing market and the decreasing availability of suitable land for residential development in the eastern portion of Glenville; and
WHEREAS, the loss of open space is most notable in the western portion of Glenville, where development is presently sparse, and where a combination of poor soils, hilly terrain, and the absence of public water has, until recently, kept housing development in check; and
WHEREAS, per the Town of Glenville Comprehensive Plan, rural areas and features of Glenville, particularly those in western Glenville, should be preserved, in part by limiting suburban style development to areas east of Sacandaga Road and Swaggertown Road; and
WHEREAS, the proposed moratorium would allow the Town an opportunity to conduct an open space inventory and to initiate an open space plan to address the loss of open space; and
WHEREAS, in order to ensure that the implementation of an open space plan will not be compromised by additional residential subdivision and development in the rural areas of Glenville, a moratorium on new residential subdivisions in the RA-zoned portions of town is beneficial; and
WHEREAS, per Municipal Home Rule Law, the Town of Glenville Town Board held a public hearing on proposed Local Law #3 of 2005 on October 5, 2005; and
WHEREAS, in accordance with 6 NYCRR (State Environmental Quality Review Act {SEQRA}) - Part 617.5, moratoria are considered Type II actions, and consequently, are not subject to review under SEQRA;
NOW THEREFORE, BE IT RESOLVED, that the Town of Glenville Town Board hereby adopts Local Law #3 of 2005, establishing a moratorium on the submission of any new residential subdivision applications involving lands presently zoned “Rural Residential and Agricultural,” with said moratorium to expire at 11:59 p.m. on January 31, 2006, as follows:

§ 186-1. Background
The combination of a robust housing market and the decreasing availability of suitable land for residential development in the eastern portion of Glenville have resulted in the rural areas of Glenville being targeted for subdivision approval and subsequent housing development. Rapid and/or poorly designed housing development in the rural western portion of Glenville, in particular, conflicts with various provisions of the Town of Glenville Comprehensive Plan, which in general call for the preservation of rural areas and features of Glenville.
The Comprehensive Plan also calls for the preservation of traditional centers, including the hamlet of West Glenville, by encouraging compatible development. Large-lot, sprawling, contemporary housing development on the fringes of the hamlet of West Glenville is incompatible with the character of the hamlet.
The Town of Glenville is about to embark on the preparation of an open space plan to address the continuing loss of agricultural land, scenic views, and open space due to housing development. The open space plan will apply to all areas of Glenville, but the rural western portion of town will be subject to a great deal of focus, per the policies of the Comprehensive Plan.
§ 186-2. Intent.
The intent of this local law is to temporarily prohibit the submission of new residential subdivision applications on any and all lands currently zoned “Rural Residential and Agricultural” (RA) in the Town of Glenville. This temporary halt of new subdivision applications will allow the Town of Glenville to conduct an inventory and ranking of its open spaces and to initiate work on an open space plan.
§ 186-3. Applicability
This moratorium local law applies to the submission of all new subdivision applications involving lands presently zoned “Rural Residential and Agricultural” within the Town of Glenville.
§ 186-4 Existing Subdivision Applications Exempted
Subdivision applications involving RA-zoned lands currently under review are exempt from this moratorium local law. For the purpose of this local law, “under review” means that the subdivision application has been declared complete by the Town of Glenville Planning Department and has been reviewed at least one time by the Glenville Environmental Conservation Commission (GECC), regardless of the outcome of the GECC’s review.
§ 186-5. Duration
This moratorium local law shall remain in effect until 11:59 p.m. on January 31, 2006.
§ 186-6. Appeals
A. Town Board Authority to Waive the Moratorium Local Law
The Town of Glenville Town Board shall have the authority to vary or waive the application of any provision of this local law upon determination, in its reasoned legislative discretion, that such variance or waiver is required to alleviate an economic or personal hardship and/or to eliminate the impairment of vested rights, provided such variance or waiver is consistent with the health, safety, morals, and general welfare of the Town.
B. Appeals Process
The owner of the parcel in which a subdivision application is being sought must file eight (8) copies of a written request for a variance or waiver to the Glenville Town Clerk’s office, no later than nine calendar days prior to the next Town Board meeting. Such written request shall clearly identify the provision or provisions for which a waiver is being sought, and it shall address the economic or personal hardship being imposed upon the landowner by the moratorium, and/or how vested rights have been negated by the moratorium.
Upon receipt of a complete and timely variance/waiver application, the Town Clerk will place the application on the next Town Board’s meeting agenda for consideration by the Board. The Town Board shall render its decision on the waiver request within 15 calendar days of the Board’s meeting.
§ 186-7. Severability
The invalidity of any work, section, clause, paragraph, sentence, part or provisions of this local law shall not effect the validity of any other part of this local law.
§ 186-8. Effect on Other Local Laws and Ordinances
All local laws and ordinances or parts thereof in conflict with the provisions of this local law are hereby superseded to the extent necessary to give this local law full force and effect during the effective period.
§ 186-9. Effective Date
This local law shall take effect immediately upon it being filed in the office of the Secretary of State of the State of New York.

Susan Lombardi – “This grant was reviewed by the Board so that we could enter into and agreement with Schenectady County to create a “Blueway Trail”, which is really a map and brochure which would highlight all of the businesses, enmities, parks and attractions in our town and in the surrounding area along the Mohawk River. At this point Schenectady County Planning and our Planners (Kevin and Mike) and I have been working on this project for about one year with the County with some input from other municipalities. We are ready to send a draft copy to a printer to insert some photos and some design expertise.
We will show you what sorts of amenities are being pointed out in the “Blueway Trail Map”; there will be photos and proper credit due to the different agencies who were involved on the brochure.
As per the agreement that we came to in 2002 we will pay for the printing, the grant did go through us, we will be reimbursed through the state on a voucher basis.”
RESOLUTION NO. 213-2005

WHEREAS grant funding has been awarded by the Department of State in the amount of $12,000 to the Town of Glenville in conjunction with Schenectady County for the design and production of a “Schenectady County Blueway Trail” map and brochure,
WHEREAS the Town of Glenville and the County is desirous of applying these funds in the amount not to exceed ($2,000) two thousand dollars for initial design and printing costs for said map and brochure to be distributed throughout the community, and
WHEREAS the Town Board of the Town of Glenville approves of the expenditure for this purpose,
NOW THEREFORE BE IT RESOLVED, that the Town of Glenville will purchase the necessary printing services and be reimbursed for said expenses as per the terms of the grant agreement.

WHEREAS, it is the intent of this resolution to keep Halloween a safe day for the children trick or treating in Glenville,
NOW, THEREFORE, BE IT RESOLVED that the date and time Halloween is to be celebrated within the Town of Glenville is from 2:00 PM to 8:00 PM on Monday, October 31, 2005; and

WHEREAS, for the past twenty-three years the Town Board of the Town of Glenville has supported the Alplaus Run-Around, and
WHEREAS, this same event has been scheduled for Saturday, October 29, 2005 from 10:00 a.m., and 10:30 a.m. to 12:00 Noon,
NOW, THEREFORE, BE IT RESOLVED that once again the Town Board of the Town of Glenville, hereby agrees to support the Twenty-fifth Annual Alplaus Run-Around located within the Hamlet of Alplaus, New York.

WHEREAS, the Tentative Budget has been filed with the Town Clerk; and
WHEREAS, pursuant to Section 108 of the Town Law, a public hearing must be held by the board upon said Preliminary Budget, on or before the Thursday immediately following the General Election,
NOW, THEREFORE, BE IT RESOLVED that the Tentative Budget is hereby amended to establish the elected officials’ salaries at:
Supervisor ...........................................$ 14,094.00
Town Council Members (four)..............…$ 6,350.00 [each]
Town Clerk...........................................$ 53,800.00
Town Highway Superintendent................$ 65,857.00
BE IT FURTHER RESOLVED, that the Tentative Budget as amended be adopted as the Preliminary Budget for 2006; and
BE IT FURTHER RESOLVED by the Town Board of the Town of Glenville that a public hearing upon said preliminary budget shall be held at the Glenville Municipal Center, 18 Glenridge Road, in said Town on November 2, 2005 at 7:30 P.M., or as soon thereafter as can be reached; and
BE IT FURTHER RESOLVED that the Town Clerk be and she hereby is directed to prepare the proper notice of said public hearing and to publish and post said notice in accordance with said Section 108 of the Town Law; and
BE IT STILL FURTHER RESOLVED that the Town Clerk be and she hereby is directed to have twenty-five (25) copies produced of the Preliminary Budget for public distribution and another (25-50) if and when the need arises.
