Present: Supervisor Clarence W. Mosher, Councilmen, Peter V. Russo, Mark A. Quinn, Robert E. Bailey and James E. Denney
Absent: None
Supervisor Mosher called the meeting to order at 7:30 PM. Councilman Denney gave the Invocation and Jean Paparella was asked to lead us in the Pledge of Allegiance.
Supervisor Mosher asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Council Reports:
Councilman Russo – “The contract that NYSDOT has given to the town, for the apposition of property for our Fire and Public Safety Training Center, hopefully to be built on that site. The Town Attorney has the contract for review.
The town has received some money from the Office of Real Property. I’d like to read a portion of the letter that was received from them – “I am pleased to inform you that the Town of Glenville has met the high standards and is eligible for a maintenance aid payment based on the 2004 Final Assessment Roll. The amount that we will be receiving is $22,638.”
Councilman Denney – “The Efficiency in Government Committee has provided me with a report and a recommendation regarding the development of a Compensation and Benefit Statements for all the town employees. I will get copies for the board and I plan on introducing that for some initial discussion at our work session next week.”
Councilman Quinn – “With regard to the Traffic Safety Committee we have discussed the long overdue Glenridge Road project and I know we are finally making some progress in terms of getting that completed. Next time the Traffic Safety Committee meets I hope to have an update on that and give you a comprehensive version.”
Councilman Bailey – “One of the items on the agenda tonight deals with a water line installation on Van Voast Lane and Sacandaga Road. Looking to the very near future we will also be talking about a District No. 11 extension down on Barhydt Road and Wagner Road. The bids have been received for that and evaluated and we will be discussing that in the future.”
Supervisor Mosher – “It is my pleasure this evening to present a proclamation honoring the Rotary Service Club for 100 years in existence.”
The Supervisor invited the following rotarians to join him up front:

PROCLAMATION
TOWN OF GLENVILLE, NEW YORK
WHEREAS, Rotary International, founded on February 23, 1905, in Chicago, Illinois, USA, is the world’s first and one of the largest non-profit service organizations; and
WHEREAS, in 166 countries there are nearly 32,000 Rotary clubs comprised of professional and business leaders totaling over 1.2 million Rotary club members; and
WHEREAS, the Rotary motto “Service Above Self” inspires members to provide humanitarian service, encourage high ethical standards, and promote good will and peace in the world; and
WHEREAS, Rotary finances club projects and sponsors volunteers with community expertise to provide medical supplies, health care, clean water, food production, job training, and education to millions in need, particularly in developing countries; and
WHEREAS, Rotary in 1985, launched Polio Plus and spearheaded efforts with the World Health Organization, U.S Centers for Disease Control and Prevention, and UNICEF to immunize the children of the world against polio; and
WHEREAS, polio cases have dropped by 99 percent since 1988 and the world stands on the threshold of eradicating the disease; and
WHEREAS, Rotary is the world’s largest privately-funded source of international scholarships, and promotes international understanding through scholarships, exchange programs and humanitarian grants; and
WHEREAS, more than 35,000 students from 110 countries have studied abroad since 1947 as Rotary Ambassadorial Scholars; and
WHEREAS, Rotary’s Group Study Exchange program has helped more than 46,000 young professionals explore their career fields in other countries; and
WHEREAS, 8,000 secondary-school students each year experience life in another country through Rotary’s Youth Exchange Program; and
WHEREAS there are over 200 Rotary club members in three Rotary clubs in the Town of Glenville sponsoring service projects to address such critical issues as poverty, health, hunger, illiteracy, and the environment in the local communities and abroad, and
WHEREAS, Rotary Clubs have greatly contributed to the quality of life in the Glenville community through service projects, community-wide special events, and by providing a constant example of civic pride and civic responsibility through volunteerism,
NOW, THEREFORE, the Town Board of the Town of Glenville does hereby proclaim February 23, 2005, as Rotary International Day in the Town of Glenville, and encourages all citizens to join the Board in recognizing Rotary International for 100 years of service to improving the human condition in our local communities and around the world.

Supervisor’s Comments:
Supervisor Mosher – “I’d like to read a letter that the Town Board received from David Bradley, Chairman of the Police Chief Search Committee.”
The Police Chief Search Committee was appointed by the Town Board to recommend to the Board the best qualified candidate for the position of Chief. The seven volunteers who served on the Committee represented over 125 years of law enforcement experience. The Committee strived to complete its work in a professional manner, maintaining high ethical standards and working to maintain the integrity of the process. We followed the guidance provided by the two participating Board members, Supervisor Mosher and Councilman Quinn. We instituted a search for candidates through appropriate means, conducted interviews of the best qualified candidates, and deliberated considering all the information available to the Committee. The process was conducted in a fair and objective manner. As a result of the rigorous
examination, the Committee came to a consensus to recommend one candidate as the best qualified to the Board.
The Town Board chose to reject that candidate and to pursue an alternative selection process. It is clearly recognized that the Town Board, as duly elected officials, has that right, and ultimately the body that selects the new Chief.
I am disappointed the Town Board chose to reject the recommended candidate, but also that the Board further did not seek out advice from the Committee with regard to the additional candidates. It is unfortunate to see the Board not avail themselves of such high caliber law enforcement experts when they willingly volunteered to assist.
The Police Chief Search Committee performed its work with integrity and professionalism. I was proud to serve as Chair and humbled by the level of competence this group represented.

RESOLUTION NO. 60-2005

WHEREAS the Town of Glenville received a quote on state contract
#PT55666 for Dell personal computers; and
WHEREAS the Town budgeted to buy 12 personal computers in 2005,
NOW, THEREFORE, BE IT RESOLVED that the Glenville Town Board hereby authorizes the purchase of 12 personal computers for $13,758 from Dell with appropriations for this payment to be taken from budget line item 01.00.1680.2000; and
BE IT FURTHER RESOLVED the Town Board authorizes the sales, disposal, or redeployment of the replaced personal computers with the proceeds of any sales to be credited to miscellaneous income for the town general fund.

NOW, THEREFORE, BE IT RESOLVED that Clarence W. Mosher, Town Supervisor is hereby authorized to sign a contract with NYSDOT to proceed with the transfer of the property designated for the Fire Training Facility; and
BE IT FURTHER RESOLVED, that the Town Board of the Town of Glenville authorizes payment to be made in the amount of $6,960.00 (10% of the selling price).

RESOLUTION NO. 62-2005

WHEREAS, Chris Myers, on behalf of Concord Development, has submitted a zoning map amendment application to rezone three parcels totaling 8.9+ acres from “Suburban Residential” to “Multi-Family Residential” for the purpose of constructing a townhouse development on 12.6+ acres of land on Maple Avenue; and
WHEREAS, the parcels to be rezoned are identified as tax map # 23-2-18, 23-2-15.12, and 23-2-16, but 23-2-16 will not to be developed as part of this proposal, as this is the Yates Cemetery Plot; and
WHEREAS, two parcels (tax map #23-2-17 and 23-2-15.11) within the project area are already zoned multi-family and will not need to be rezoned to advance the townhouse project; and
WHEREAS, the Glenville Town Board, as SEQRA Lead Agency, has issued a SEQRA “Negative Declaration” for this action;
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby approves the proposed zoning map amendment by Chris Myers, on behalf of Concord Development, to rezone three parcels along Maple Avenue totaling 8.9+ acres from “Suburban Residential to “Multi-Family Residential”; and
BE IT FURTHER RESOLVED, that the approval of this zoning map amendment application is based on the following findings:
· This proposal is reasonably consistent with the Town of Glenville Comprehensive Plan, which calls for “Hamlet Residential”-type development of this area due to the presence of both public water and public sewer, and thus, the ability to support higher density development.
· The proposed use is reasonably compatible with neighboring land uses which consist primarily of multi-family development immediately north and south of the project site, and railroad tracks immediately west. Townhouses are a form of single-family development with an appearance that approximates multi-family.
· The rezoning of this parcel for a townhouse development project should not negatively affect nearby property values. Given the setting of the project site along a busy county road (Maple Avenue), and bordered by railroad tracks to the west, and existing multi-family to the north and south, the introduction of townhouse units - which is a form of single-family development - is appropriate in both scale and use. There really aren’t any adjacent land uses whose value could be compromised as a result of a townhouse project at this location.
· Given the factors noted above, one can conclude that the character of the neighborhood will be preserved following the zoning amendment.
· While considering neighborhood impacts and the character of the area, it should be noted that the Town Board was not supportive of the original driveway location proposed for this project, which was a few hundred feet south of the Maple Avenue/Alplaus Avenue intersection. The Board was concerned about traffic impacts and traffic safety if the driveway were to be located as originally proposed; essentially an “off-set” intersection with Alplaus Avenue. The applicant has since revised his preliminary development plan so as to line up his driveway across from Alplaus Avenue, where either a traffic signal or round-a-bout will be constructed. This improvement
will result in fewer back-ups of traffic on Alplaus Avenue, with presumably less frequent queuing of vehicles over the railroad tracks on Alplaus Avenue. This configuration also addresses a long-standing need for a traffic control device at the intersection of Maple Avenue and Alplaus Avenue, and
BE IT FURTHER RESOLVED, that approval of this zoning map amendment is conditioned upon the applicant receiving site plan approval for a project substantially the same as the current submission, not to exceed 55 units, from the Planning and Zoning Commission; and

Councilman Quinn – “I have been fortunate to interview Dan Boyle, not once but twice for this position. On both occasions his leadership, management, imperative and forth rightness was obvious to me.
Dan Boyle has devoted over twenty-nine (29) years of his life to law enforcement. He came up through the ranks of the Syracuse Police Department and he ultimately directed the entire operation of this five hundred (500) officer department. Since then Dan has also served with distinction as the Chief of Police in East Syracuse and as the Commissioner of Public Safety in Schenectady, where he not only over saw the operations of one hundred and seventy (170) police officers but also one hundred and twenty-one (121) fire personnel.
I am extremely pleased that we were able to attract such a high caliber professional to the Town of Glenville.
With that it is my privilege to urge this Board to ratify Dan Boyle’s appointment as our new Chief of Police.”
Supervisor Mosher – “I have a statement to make.
I address my comments to the members of the Town Board who have chosen not to include the Supervisor in the process of selecting our next Police Chief.
Since you have deliberately chosen not to include me in the selection process, I feel that my voting on this resolution would only serve to dignify and endorse a process that I find deplorable and disgraceful.
This has been a shameful process, without even the common courtesy of the Town Board informing the Supervisor of its actions.
Without any reflection upon this candidate, I feel that I must abstain.”
RESOLUTION NO. 63-2005

WHEREAS, after thirty-four years of service within the Town of Glenville Police Department Jack G. Purdy retired from the position of Police Chief effective January 15, 2005; and
WHEREAS, the Town Board of the Town of Glenville advertised the vacant position of police chief and received numerous applications from a large pool of qualified candidates; and
WHEREAS, both a Police Chief Search Committee and the Glenville Town Board have interviewed the same set of finalists for this position,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the Supervisor to appoint Daniel B. Boyle of 21 Fabian Lane, Syracuse, NY 13209 to the position of Chief of Police with an effective date of March 1, 2005; and
BE IT FURTHER RESOLVED, that the compensation for the aforementioned position will be a salary of $85,000 per year.

NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville does hereby re-establish the Public Safety Committee with the following mission statement:
Foster cooperation between emergency medical services, fire protection services and law enforcement services in order to ensure the highest level of public safety to the citizens of the Town of Glenville
BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville hereby reappoints/appoints the following members to the Public Safety Committee, with terms commencing immediately and ending on December 31, 2005

WHEREAS this position has been planned and budgeted for 2005 in the appropriate department,

WHEREAS the amount budgeted for 2005 for this contract is $7,500.00, the increased amount reflective of the increased costs of providing the senior transportation program (gasoline, insurance),
NOW, THEREFORE, BE IT RESOLVED that the consideration to be paid by the Town of Glenville to the Scotia-Glenville Senior Citizens Recreation and Related Concerns, Inc. for its programs for the calendar year shall be the sum of $7,500.00; and
BE IT FURTHER RESOLVED that Clarence W. Mosher, Supervisor of the Town of Glenville, is hereby authorized to sign the attached contract on behalf of the Town of Glenville.

WHEREAS, on June 16, 2004, the Town Board of the Town of Glenville found and determined that it was in the public interest to provide for the improvement to Water District No. 11 Distribution System in the area of Van Voast Lane and Sacandaga Road; and
WHEREAS, the contract for the general construction of Water District No. 11 High Pressure Water Line Contract 2-04 was put to bid with the bids being opened on January 12, 2005; and
WHEREAS, the bids have been reviewed by Andimo Coppola, Commissioner of Public Works and Mark Kestner, the town designated engineer, and both of whom recommend awarding the contract to the low bidder: TKC Construction, Inc., 1166 Route 9 Thousand Oaks Park, Gansevoort, NY; and
WHEREAS, the cost of the improvements will be paid from surplus funds remaining from the Capital Project for Water District 11, 24” water line and water treatment plant upgrade,
NOW THEREFORE BE IT RESOLVED that the Town Board of the Town of Glenville hereby accepts the bid of TKC Construction, Inc., 1166 Route 9 Thousand Oaks Park, Gansevoort, NY, 12831, and awards it the contract for the general construction of Water District No. 11 High Pressure Water Line Contract 2-04 as set forth in the bid specifications at a cost not to exceed $260,586.00, and
BE IT STILL FURTHER RESOLVED that Clarence W. Mosher, Supervisor of the Town of Glenville, is authorized to sign all documents necessary to complete this contract and the project.

WHEREAS Andimo Coppola, Commissioner of Public Works has negotiated with Kestner Engineers, P.C., for it to perform the engineering work involved in the Water District No. 11 Distribution System in the area of Van Voast Lane and Sacandaga Road; and
WHEREAS the proposed agreement with Kestner Engineers, P.C., has been reviewed by Andimo Coppola, Commissioner of Public Works, and Arkley L. Mastro, Jr., Town Attorney and approved by them; and
WHEREAS the cost of the improvements will be paid from surplus funds remaining from the Capital Project for Water District 11, 24” water line and water treatment plant upgrade,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves the attached agreement between the Town of Glenville and Kestner Engineers, P.C., and retains said firm to perform the engineering work described therein for the improvement to Water District No. 11 Distribution System in the area of Van Voast Lane and Sacandaga Road, said work to include, but is not limited to, the design phase, mapping, borings, layout, bidding and award of the bids, and construction administration at a cost not to exceed $38,040.00; and
BE IT FURTHER RESOLVED that Clarence W. Mosher, Supervisor of the Town of Glenville, is authorized to sign said agreement on behalf of the Town.

RESOLUTION NO. 70-2005

WHEREAS, there is funding available under a competitive grant process through the NYS Department of State to provide funding for the 2004-2005 Quality Communities Program; and
WHEREAS, the Town of Glenville is desirous of filing an application under this program which provides funding to eligible local governments to “enhance the opportunities and incentives for innovative community planning and development of implementation tools and strategies that link environmental protection, economic prosperity and community well-being”; and
WHEREAS, the Town of Glenville is applying for funding to offset staff, consultant and other related costs associated with the development of an Open Space Plan in collaboration with the County of Schenectady,
NOW, THEREFORE, BE IT RESOLVED, that the Town of Glenville approves of the submission of an application for funding offered by the NYS Department of State under the auspices of the Quality Communities Program; and
BE IT STILL FURTHER RESOLVED that Clarence Mosher, Town Supervisor, is authorized to act on behalf of the Town of Glenville in all matters related to this grant submission and financial assistance, and is authorized to sign, certify and file the application for funding.

James MacFarland – “The two most recent pieces of information that lead to this alternate resolution tonight: BH/BL Baseball Club in really taking a hard look at their overall finances and the remainder of monies left in their bond was getting a little nervous as to the total expenditure for this particular work, however it needs to be done. The final piece of information that we just got on Monday afternoon at a public works meeting was that it appears that most of this work will be able to be done in this year by our Town Highway, Public Works/Water Department in some combination thereof.
With that the ball club is very eager to work with our town work forces to get things done they would realize a pretty significant savings on the project in doing that and have sent a letter of endorsement of bid rejection for that reason.
They were certainly in favor of accepting the bid as really the only way to get this done and were willing to pay the freight so to speak but now that another alternative way to do it at a more affordable way has serviced they really are in agreement that this would be the best way to go.
As such from here we would just have to make sure that the work does get done this year.”
Councilman Denney – “We received a letter from Fred Mastrianni who is the President of the BH/BL Junior Baseball Commission, where basically he thanks the Town, staff and the Town Board for their efforts on behalf of the park over the years and that they support us effectively rejecting all of these bids.
I also want to commend Councilman Russo for his efforts. Basically he is the one who stuck his nose into a place that it didn’t belong and as a result saved the baseball commission in BH/BL a significant amount of money and that is going to allow them to hopefully leverage that into some other projects.”
RESOLUTION NO. 71-2005

WHEREAS, the Town of Glenville entertained bids for improvements to the Indian Meadows Park Baseball Fields; and
WHEREAS, after careful consideration of the bids, the BH-BL Junior Baseball Commission has recommended that the bids not be accepted due to concerns about this expense versus the remaining project monies; and
WHEREAS, the Town’s Public Works Department has reviewed the planned improvements and has committed to performing most of the work in 2005,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville does hereby reject any and all bids received by January 4, 2005 for improvements to the baseball fields at Indian Meadows Park; and
BE IT FURTHER RESOLVED, that the Director of Human Services is directed to execute the release of the bid bonds and to convey the Board’s appreciation for their interest in performing work for the Town of Glenville.

Attorney Mastro, Jr. - “This was a stipulation entered into between Civil Service Employees Association and the Town of Glenville which grieved the hiring of a position in the public works department.
It is a grievance that was filed on behalf of Matthew Levielle where Mr. Levielle believed he should have been appointed to a position. The matter has been resolved by having Mr. Levielle be appointed to a position that will open up in that same department at the same salary that he would have received had he originally gotten the appointment and it results in a cost savings to the Town of about $3,000.”
