Present: Supervisor Clarence W. Mosher, Councilmen, Peter V. Russo, Mark A. Quinn, Robert E. Bailey and James E. Denney
Absent: None
Supervisor Mosher called the meeting to order at 7:30 PM. Councilman Quinn gave the Invocation and Jack Ewing was asked to lead us in the Pledge of Allegiance.
Supervisor Mosher asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Councilmen Reports:
Councilman Russo – “I made the announcement last Wednesday at our work session that we got the final approval for the land transfer from NYSDOT to our group in trying to build the fire safety training center. Maybe within a few weeks we will have the transfer of the title of the property to the Town.”
Supervisor Mosher – “Thank you for all of your hard work on that.”
Councilman Denney – “Councilman Russo and myself attended the Efficiency in Government Committee meeting where we had a presentation from two gentlemen to get the committee up to speed on some aspects of management and union negotiations and it was a very productive session and maybe in a future work session we can talk about that in a little bit more detail.”
Councilman Quinn – “Just a note with regard to the Public Safety Committee, the Supervisor and I have been working on redefining a broader mission for that committee and it will be reauthorized in the not too distant future.”
Councilman Bailey – “A few weeks ago we voted to replace the badly worn carpet in the offices of the Municipal Center and that work will be starting the week of February 11th and 12th. The Highway Department personnel are doing a lot of the relocation effort to try and keep the cost down.
This is the season for water line breaks and I am sure you have all heard about the troubles over in Troy, Glenville has had a couple of them ourselves. The Water Department was kind enough to invite me out Sunday evening to watch the repair of a break near the intersection of Swaggertown and Baldwin Roads. It was cold, it was dark and it was wet. I thought that they were doing a wonderful job. They were closing the job and clearing the site around 10:30 p.m. after they had been there since around noon time. We had to close Swaggertown Road with roadblocks north of the site and one individual chose to ignore the roadblock and used his vehicle to blow the barrels out of the way and it shows you some of the things
that our employees in the highway department have to deal with.”
Supervisor Mosher – “Item No. 5 is a public hearing to discuss the Town’s proposed agency plans for Section 8 Choice Voucher Program.
Supervisor Mosher opened the public hearing at 7:40 p.m.
Supervisor Mosher asked Joseph Mastrianni to give a short presentation.
Joseph Mastrianni – “Each year we prepare a plan, this year we have an annual plan and a five-year plan. Nothing will change we are going to operate the program the same way that we have for twenty-nine years. We certify peoples incomes, we inspect their housing when it passes we start their subsides and we do that each year, sometimes we do it more than once a year, but that is essentially what the program is. It helps pay rents for disabled, elderly and other low income families.
The Federal Government provides about $265,000 each year for the subsidies and for the administration of the program, there are no town funds involved. We have a combined waiting list between Scotia and Glenville, which makes sense and it works pretty well.
September 1st we had 26 people on the waiting list, today we have 53 people or families. There has been a substantial growth in the demand for the program. Thirty-eight of those families are Glenville and Scotia residents, they will get preference, the other people will never see subsides because we always give preference to Glenville and Scotia folks. Fifteen of those people are disabled or elderly on the waiting list. The number of families that we can help is now sixty families, we are helping fifty-eight so the program is pretty fully utilized. Of the fifty families in the program, roughly half are either elderly or disabled, so this program is really helpful to people who don’t really have a
choice and are really the worst case scenario in terms of affordable housing.
Turn over each runs about eleven or twelve families, but if you take the elderly and disabled out because they stay and you just work with the remaining families a little over a third of those families turn over each year. In that sense the program is serving the purpose of a temporary fix and people come in, stay and when their incomes go up or they don’t need the program any longer they leave. That is pretty much the way the program operates except for the elderly and the disabled.
HUD has changed how they give us money and how much money they give. We are getting less money in 2005 then we have in the past. We monitor each month and we project to the end of the fiscal year, which now is the calendar year, where we are going to be because we have to end this year (2005) in the black, which will probably mean that we will not be able to help as many families.
That is the program and we like the program.”

Supervisor’s Comments:
Supervisor Mosher – “Letters of recognition are always appreciated, it is the staff that provides services to the residents of this town and we like to recognize them by reading these letters. I have two letters this evening; they both have to do with the police department.
Dear Mr. Mosher:
I want to take the time in advising what a fine and concerned police officer you have in your police department.
I met William Marchewka on 1-11-05 at Price Chopper on Route 50. I have a heart condition and can not breathe well when it is very cold. He knew I had a problem and was very considerate and insisted on helping me with my groceries. He was not sure if I required medical assistance and followed me to my car to make sure I was okay.
People complain about the police department, I on the other hand truly appreciate the police.
Thank you for being there for me.
The second letter is from Deputy Chief Macherone to Officer Paul Zullo of the Scotia Police Department.
Dear Officer Zullo:
I am writing to acknowledge and thank you for the letter you sent in recognition and appreciation of the professional work provided by Officers Tracey Nethaway and Timothy Mell on January 1, in an investigation of a case involving a member of your family.
We take great pride in the training and development of our officers to provide the best possible service in our community and to our residents.
We are pleased that the actions of these officers in the investigation of your complainant met with your approval and embody those professional qualities we strive for.
In closing please be advised that this communication will be brought to the attention of Officers Nethaway and Mell. If we may be of any assistance to you in the future please do not hesitate to contact us.
RESOLUTION NO. 51-2005

WHEREAS the Town of Glenville operates a Section 8 Housing Choice Voucher Program funded by the U.S. Department of Housing and Urban Development; and
WHEREAS the Town of Glenville is required by the U. S. Department of Housing and Urban Development to prepare and adopt a written Annual and Five-Year Plan that establishes local policies for administration of the Section 8 Housing Choice Voucher Program in accordance with regulations of the U.S. Department of Housing and Urban Development; and
WHEREAS the Town Board of the Town of Glenville has caused a written Annual Plan for 2005 and a Five-Year Plan for 2005-2009 to be prepared establishing local policies for administration of the Section 8 Housing Choice Voucher Program in accordance with regulations of the U.S. Department of Housing and Urban Development, and has reviewed such written plan,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby adopts the Annual Plan for 2005 and the Five-Year Plan for 2005-2009 for operation of the Town of Glenville Section 8 Housing Choice Voucher Program.

RESOLUTION NO. 52-2005

WHEREAS the County of Schenectady is participating in the New York State Special Traffic Options Program for driving while intoxicated; and
WHEREAS the STOP-DWI Steering Committee, and the Schenectady County Legislature, in the formulation of the County STOP-DWI Plan have agreed to support heightened law enforcement of the DWI laws,
NOW, THEREFORE, BE IT RESOLVED that this agreement is entered into and executed by the County of Schenectady and the Town of Glenville as a municipality desirous of reducing the tragic loss of life and personal injury which results from drunk driving within the County. This will be achieved in part, through the participation and cooperation of the law enforcement agencies of the parties to this agreement, acting collectively to implement the enforcement of the County STOP-DWI Plan; and
BE IT FURTHER RESOLVED that this contract shall be effective from January 1, 2005 to December 31, 2005. Each participating party retains the right to withdraw from the STOP-DWI Program at any time. Such withdrawal must, however, be made by vote and written notice from the governing body of the participating agency.

RESOLUTION NO. 53-2005

WHEREAS, the Town of Glenville received a grant for an Inventory and Planning Project, and
WHEREAS, in order to accomplish such a project, the grant established part-time positions for Inventory Clerks, and
WHEREAS, the grant was completed in 1995 and fulfilled all the requirements that the Town Board desired to have accomplished, and
WHEREAS, in order to maintain the destruction of obsolete records per "Records Retention and Disposition Schedule" published by the State of New York, and
WHEREAS, all 2004 departmental records, files, reports and other miscellaneous material must be indexed and filed within the archives of the municipality,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby reappoints the following individual as a Part-time Clerk, working not more than 15 hours per week, for approximately five weeks in order to help.

Attorney Huff – “The lead agency, which in this particular case is the Town Board, are required to make determination as to what the proposed change in the current zoning to what is being anticipated, what if any impact this is going to have on the environment. Basically this Board is making a determination that is a negative impact on it, therefore making it a negative declaration.
It is a separate action that must be taken and voted on in addition to whatever the Board may do with respect to the rezoning.”
RESOLUTION NO. 54-2005

WHEREAS, Chris Myers, on behalf of Concord Development, has submitted a zoning map amendment application to rezone three parcels totaling 8.9+ acres from “Suburban Residential” to “Multi-Family Residential” for the purpose of constructing a townhouse development on 12.6+ acres of land on Maple Avenue; and
WHEREAS, the parcels to be rezoned are identified as tax map # 23-2-18, 23-2-15.12, and 23-2-16, but 23-2-16 will not to be developed as part of this proposal, as this is the Yates Cemetery Plot; and
WHEREAS, two parcels (tax map #23-2-17 and 23-2-15.11) within the project area are already zoned multi-family and will not need to be rezoned to advance the townhouse project; and
WHEREAS, this proposed zoning map amendment constitutes an “Unlisted Action” in accordance with 6 NYCRR Part 617 (State Environmental Quality Review Act {SEQRA}); and
WHEREAS, the Glenville Town Board has assumed SEQRA Lead Agency in this instance; and
WHEREAS, both the Glenville Environmental Conservation Commission and the Planning & Zoning Commission recommended that the Town Board find no significant adverse environmental impact associated with this proposed zoning map amendment, and that the Board issue a SEQRA “Negative Declaration;”
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby determines that the proposed zoning map amendment by Chris Myers, on behalf of Concord Development, will not result in a significant adverse environmental impact; and
BE IT FURTHER RESOLVED, that the Glenville Town Board hereby issues a SEQRA “Negative Declaration” (attached) for this application, based on the following findings:
· This proposal is reasonably consistent with the Town of Glenville Comprehensive Plan, which calls for “Hamlet Residential”-type development of this area due to the presence of both public water and sewer, and thus, the ability to support higher density development.
· This action involves a zoning map amendment. Consequently, there will be no physical alteration to the landscape as a direct result of this amendment. Potential physical/environmental impacts associated with the proposed townhouse project will be addressed during the site plan review process.
· A portion of the project site is already zoned multi-family, in recognition of existing multi-family uses. The extension of the multi-family zoning district in this area is logical given the location of the project site along a heavily-traveled county highway (Maple Avenue) to the east, railroad tracks to the west, and multi-family to the north and south.
· This action will not significantly impact air quality, ground water or surface water quality, archeological resources, recreational facilities, etc. Further, this proposal will not create a hazard to human health, and it will not result in a major change in either the quantity or type of energy to be used.

RESOLUTION NO. 55-2005

WHEREAS, a vacancy of a Public Safety Dispatcher will exist in the Communications Section resulting from the termination of a probationary employee; and
WHEREAS, this vacancy will become effective February 4, 2005 and will reduce our staffing in our Communications Section to eleven dispatchers; and
WHEREAS, the authorized and budgeted staffing in the Communications Section is twelve Public Safety Dispatchers for 2005,
NOW, THEREFORE BE IT RESOLVED, that this Town Board does hereby agree to allow the Deputy Chief to form an Interview Committee to conduct interviews of candidates from the Schenectady County Civil Service list and also of lateral transfer and provisional candidates who have applied for this position, and
BE IT FURTHER RESOLVED, any recommendation of the Interview Committee to hire will be forwarded to the Town Board for approval at a future date.

RESOLUTION NO. 56-2005

WHEREAS, the position of Executive Secretary I has been budgeted in the 2005 Police Department Budget; and
WHEREAS, the Schenectady County Civil Service Commission has approved the title change from Senior Account Clerk Typist to Executive Secretary I; and
WHEREAS, the Chief of Police has recommended that Donna J. Moran, Account Clerk/Typist in the Police Department be promoted to the position of Executive Secretary I,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby promotes Donna J. Moran, 306 S. Ten Broeck Street, Scotia, to the position of Executive Secretary I in the Police Department effective February 2, 2005, at an annual salary of $38,006 pro-rated for the remainder of 2005 in accordance with the CSEA/Town of Glenville 03-05 Agreement, and
BE IT FURTHER RESOLVED that the position of Account Clerk Typist be removed from the Police Department.

WHEREAS, the position of Glenville Zoning Board of Appeals Recording Secretary is currently vacant due to the recent resignation of Terri Petricca from that position; and
WHEREAS, Jill Walsh, who resides at 4 Pine Street, Glenville, NY, is interested in filling the Recording Secretary position; and
WHEREAS, this is a budgeted position that pays $90 per meeting, plus $10/hour pro-rated for meetings that exceed 2 ½ hours in length,
NOW, THEREFORE, BE IT RESOLVED, that the Glenville Town Board hereby appoints Jill Walsh to the position of Glenville Zoning Board of Appeals Recording Secretary, effective January 24, 2005.
