TOWN OF GLENVILLE

Present:        Supervisor Clarence W. Mosher, Councilmen, Peter V. Russo, Mark A. Quinn, Robert E. Bailey and James E. Denney

Absent: None

                Supervisor Mosher called the meeting to order at 7:30 PM.   Supervisor Mosher gave the Invocation and Victoria Spagnoli was asked to lead us in the Pledge of Allegiance.

                Supervisor Mosher asked the Town Clerk, Linda C. Neals, to call the roll.  Everyone was present and accounted for.

                Supervisor Mosher congratulated Councilman James W. Denney on his election to the Town Board.


Supervisor announces the following appointments:

        a).     Deputy Supervisor – Peter V. Russo
        b)      Commissioner of Public Works, Andimo Coppola
        c).     Deputy Highway Superintendent, Jeffrey Gemmette, per recommendation of Highway Superintendent.
        d)      Deputy Commissioner of Public Works, Jeffrey Gemmette
        e).     “The Town Clerks announcement on Ethics.”

Town Clerk, Linda C. Neals: “I would like to notify each one of the Town Board Members of their obligations to maintain the confidentiality pursuant to the Town Code of Ethics.”

                Supervisor Mosher – “We reinstituted council-liaisons last year and there have been some minor changes:

                Councilman Bailey – Engineering Department, GECC, Highway Department, Justice Department, OSHA, Water and Sewer Department and Zoning Board of Appeals.

                Councilman Denney – Building Department, Efficiency in Government, Human Services Department, Park Planning Committee, Planning Department, Senior and Youth Services and the Village of Scotia.

                Councilman Quinn – DARE, Municipal Housing Authority, Planning and Zoning, Police Department, Public Safety Committee and the Traffic Safety Committee.

                Councilman Russo – Assessors Department, Assessment Board of Review, Board of Ethics, Berkley Square Committee, Fire Services, Receiver of Taxes and the Town Clerk’s Office

                Supervisor Mosher – Comptroller, Beautification Committee, Cable Consortium Committee, Freedom Park, GEDC, Water and Sewer Service Committee and the Watershed Protection Board.

RESOLUTION NO.01-2005

                BE IT RESOLVED that the Town Board of the Town of Glenville hereby ratifies the appointments of Andimo A. Coppola to the position of Commissioner of Public Works, Roger S. Peugh to the position of Building Inspector and Paul Borisenko to the position of Deputy Building Inspector of the Town of Glenville.

RESOLUTION NO. 02-2005

                BE IT RESOLVED, that the regular meetings of the Town Board of the Town of Glenville shall be held on the first and third Wednesday of the month during the year 2005, excepting the months of June, July and August when the said regular meetings shall be held only on the third Wednesday of those respective months, and

                BE IT FURTHER RESOLVED, that the Town Board will meet in a work session on the fourth Wednesday of each month on an as needed basis; and

                BE IT FURTHER RESOLVED, that all regular meetings shall convene at 7:30 P.M., prevailing time and unless otherwise designated, within sufficient time, shall be held at the Glenville Municipal Center, 18 Glenridge Road, Glenville, New York, and

                BE IT STILL FURTHER RESOLVED, that the following Boards and Committees will meet as follows:

        Planning & Zoning Commission Agenda Meeting  -  1st Monday of the month at 7:00 p.m.  (large meeting room)

                BE IT RESOLVED, that all town officers and employees, including members of the Planning and Zoning Commission and members of the Board of Appeals, when necessary to use their own automobile in the performance of their respective duties and responsibilities and upon submission and approval of an itemized account of the mileage traveled, shall be entitled to reimbursement at the rate of 40.5 cents per mile for the year 2005.

                NOW, THEREFORE, BE IT RESOLVED that Ms. Patricia Pietrusza, 49 Heritage Parkway, Glenville be reappointed to the Zoning Board of Appeals for a term of five (5) years, commencing January 1, 2005 and terminating December 31, 2009; and

                WHEREAS, Henry M. Schrader, 2161 West Glenville Road resigned from the Assessment Board of Review,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby appoints Francis Murphy, 1734 North Road, Amsterdam to serve on the Assessment Board of Review in the Town of Glenville, Schenectady County, New York, commencing January 1, 2005 and expiring September 30, 2006; and

                BE IT FURTHER RESOLVED that the Board of Assessment Review be reimbursed as follows:  $100.00 per person per day for Grievance Day and $25.00 per person per hour for sessions following Grievance Day, with the Chairman of the Board of Review receiving an additional $50.00 for his/hers services.

                BE IT RESOLVED, that the Town Board of the Town of Glenville confirms the appointments of, William Conley, 1122 Spearhead Drive, Glenville, New York 12302 and Donald R. Cooper, 862 Sacandaga Road, Glenville, New York 12302, as Voting Machine Programmers for the Election Year 2005, as provided by Paragraph 3, Section 3-302 of the New York State Election Law; and

                BE IT FURTHER RESOLVED that the Town Board of the Town of Glenville, hereby sets the rate for programming voting machines at Fifty Dollars ($50.00) per machine, per individual each time an election is held during the year 2005.

and

                BE IT FURTHER RESOLVED, that all inspectors/poll clerks shall also be compensated in the amount of $10.00 for attending instructions by the Election Commissioners on each occasion and shall be reimbursed at the rate of 40.5 cents per mile for driving their own automobile to and from such instructions, as provided by Section 3-420 of the Election Law.

                WHEREAS, the Town must levy said sum against the taxable real estate, and direct the extension of such taxes against each such parcel,

                NOW, THEREFORE, BE IT RESOLVED

                1.  The Town Board of the Town of Glenville does hereby levy the sum of $12,187,040.96 certified to it by the County Legislature as said Town's contribution to the taxes of the County of Schenectady for the fiscal year beginning January 1, 2005.

                2.  The taxes due the County of Schenectady shall be extended against each parcel of taxable real estate at a rate to be established by the County of Schenectady per $1000 of taxable assessed value.

                WHEREAS proper accounting practices require that a contract be entered into between the Town of Glenville and the County of Schenectady before the Town of Glenville contributes to the Indian Kill Open House and Fishing Day,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby authorizes the payment not to exceed the sum of One Hundred Dollars ($100.00) to the County of Schenectady to support the Indian Kill Open House and Fishing Day, which will take place in May, 2005, and in exchange for which the County of Schenectady will organize, coordinate and run the Indian Kill Open House and Fishing Day at which event Glenville youths fifteen years of age or younger will have the opportunity to catch trout, learn about trout habitats and stream biology; and

                WHEREAS, Freedom Park expenses consist of paying performers and a sound technician as well as maintaining the sound system, and

                WHEREAS, each year Freedom Park strives to provide a diversity of programming that will serve a variety of audiences from preschoolers to senior citizens at the Wednesday night performances from the end of June through the end of August, and

                WHEREAS, acts include big band, country, popular, Polish, Celtic, German, jazz, Dixieland and rhythm and blues, and

                WHEREAS, admission to all performances are free, and

                WHEREAS, most of the funding for Freedom Park comes from contributions made by individuals and families in the area, and

                WHEREAS, the Village of Scotia contributes, each year, along with maintaining the physical plant, and

                WHEREAS, the Town Board of the Town of Glenville is desirous of continuing its support to Freedom Park by giving of its fair share,

                WHEREAS Catholic Family and Community Services of Schenectady and Catholic Charities of the Diocese of Albany are desirous of providing a nutrition program for the citizens over the age of 50 to the Town and its' senior residents,

                NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville hereby approves the attached contract between the Town of Glenville and Catholic Family and Community Services of Schenectady and Catholic Charities of the Diocese of Albany and authorizes payment of a contribution, not to exceed the sum of Five Thousand Dollars ($5,000), for the provision of a nutrition program for the citizens over the age of 50 at the Glenville Senior Center; and

                WHEREAS it appears to be in the best interest of the residents of the Town of Glenville for the Town to enter into a contract with the Scotia-Glenville Senior Citizens Recreation and Related Concerns, Inc.,

                WHEREAS the municipalities and schools involved (Scotia, Glenville, Ballston, Scotia-Glenville and Burnt Hills-Ballston Lake) have agreed to jointly fund this program; and

                WHEREAS the Town of Glenville has budgeted monies specifically for this purpose; and

                WHEREAS Town Attorney, Arkley L. Mastro, Jr. and Director of Human Services, James MacFarland reviewed the agreement between the five municipal entities and the Parkside YMCA,

                NOW, THEREFORE, BE IT RESOLVED that the Supervisor of the Town of Glenville is hereby authorized to enter into agreement with the Parkside YMCA, a not for profit corporation, with offices at 127 Droms Road, Glenville, NY, for the purpose of providing a full-year after school program for the greater Glenville area; and

                WHEREAS, the Town has a revenue expectation to cover the cost of Drainage District #7 and has no properties officially in the district and the tax levy needs to be decreased by $2,000;

                NOW, THEREFORE, BE IT RESOLVED that the Glenville Town Board hereby authorizes the increase in the following 2005 Budget lines:

Expense:
15.00.3410.4000 by $16,863 Fire Protection District #4 Contract (expense paid to Scotia)

Revenue:
35.07.2401.0000 by $2,000 Drainage District #7 Income (payments for maintenance services)

                WHEREAS, the Glenville Housing Authority consists of five (5) members; and

                WHEREAS, the term of Mr. Jonathan Pearson, IV expired on December 31, 2004,

                NOW, THEREFORE, BE IT RESOLVED that Mr. Jonathan Pearson IV, 17 Via Marie, Glenville be reappointed to the Glenville Housing Authority for a term of five (5) years, commencing January 1, 2005 and terminating December 31, 2009.
