Supervisor Mosher called the meeting to order at 7:30 PM. Councilman Russo gave the Invocation and James Trapini was asked to lead us in the Pledge of Allegiance.
Supervisor Mosher asked the Town Clerk, Linda C. Neals, to call the roll. Everyone was present and accounted for.
Town Council Reports:
Councilman Russo – “Over the past two weeks I have attended ten (10) of the twelve (12) department reviews on the 2005 budget. In reviewing the department budgets the majority of the expense is in personnel and related costs. Insurance, retirement and health insurance, approximately seventy percent (70%) of each budget is allocated for these expenses.
On Wednesday, September 29th, I attended the Schenectady County’s Office of Emergency Management’s seminar on “Incident Command System” with Councilman Quinn.
Then again on the Glenville Fire Training Facility, we have been staging talks with Patrick Carroll, who is Director of Traffic Safety for Schenectady County. They are looking for a site for their unique project called Safety Central. It is a one-of-a-kind project devoted to training a number of different venues and ties into exactly what we are trying to achieve with the fire training.
Yesterday, Sue Lombardi and I met with David Hennesey and Ed Baker of SCCC to discuss joining forces with the college on their training programs geared for first alert teams.
On Saturday, from 1:00 to 4:00 pm, the East Glenville Fire District is celebrating its 60th anniversary with an open house. There will be games for kids, refreshments, photos with Sparky and tours of the station.”
Councilman Denney – “Last month we received a report from the Youth Issues Consortiums, I don’t know if all of the Board members have had a chance to look at it, this is a group for the benefit of the community Village of Scotia, Town of Glenville, school district, Community Human Services, Burnt Hills-Ballston Lake Schools and they have a program that is coordinated by CHS and we received a report from Deanna Flanders, who works on the Schools Out Program. There is a final report that is out for 2003-2004 fiscal year that I just wanted to point out if people want to take a look at it or if people in the community have an interest in it they can take a look at it here at Town Hall.
It has various statistics about how the program worked out during the first year they are having some financial issues that they are trying to get addressed there are some grants and that sort of thing. I should also mention that I attended a workshop with this Youth Issues Consortiums this past summer that was held down at Riverstone Manor, which I think was very well attended. We broke into different groups and I haven’t seen the report that has come out of that yet, but I will make sure that I present that to the Board as soon as we get our hands on it. James
MacFarland has been active in that group as well as our DARE Officer, Mike Schermerhorn.”
Councilman Quinn – “As Liaison to the Traffic Safety Committee we met a few weeks ago and we listened to a very through presentation from Lynn Bansavage and Virginia Graney on some of the concerns over in the Bancker Avenue area, over the configuration of the curve and some related issues. We continue to work on those problems and I think we are starting to address some of those.
Also, as you know, most of us attended the recent Habel Lane, Base Road, closure meeting regarding several safety issues, traffic flow issues and we continue to make progress on those as well.”
Supervisor Mosher recognized the Participation in Government students in the audience.
Supervisor Mosher – “Item No. 6 is a public hearing to hear all persons interested in commenting on the proposed Water District No. 11, extension no. 30 at Wagner Road and Barhydt Road.”
Supervisor Mosher opened the public hearing at 7:38 PM.
Mark Kestner – “This proposed water district would consist of a twelve inch diameter water line, which would be constructed on Vley Road Ext. where we left the fitting as part of the transmission project just completed. The line would extend along Vley Road Ext. to Barhydt Road and then there would be an auger boring under the Amtrak Railroad continuing on Barhydt Road past Wagner Road. At the entrance to the old Town landfill we would install an eight inch diameter line which would go up to the maintenance building and along Wagner Road there would be an eight inch main installed up to the top of the hill and around the bend.
Since the last project was presented at the public hearing, working with the Town Highway Department and the Town Board, we have managed to reduce the over all cost of the project approximately twenty-one percent (21%). We all know that paving and asphalt oil is going up in price and in conjunction with the Town Highway Department they have elected to do the paving work that would be associated with this project. We put an allowance in the contract for that item. Mr. Hutchins went up and dug more holes so that we could better locate the depth and dig ability as far as the rock is concerned on the job and we found that we could reduce the quantity of rock excavation that we have.
So the project is now $579,000 and the portion, the twelve inch main would be paid for by District 11 and it’s extensions as well as the three towns, Charlton, Ballston and Rexford that we sell water to. That would be approximately $295,000 and it would amount to approximately $1.75 per home per year. It is anticipated that we finance the project with 4% bonds over a twenty year period.
The eight inch line up to the landfill property and also the eight inch line on Wagner Road would be financed Town Wide General since the landfill was used by the Town and the Village of Scotia and that would amount to for a typical home a $1.46 per year per house.
There are two ways we are handling the individual laterals into the homes. If your property borders the Town landfill we would run a service line to the property line at the highway right-a-way and then we would run a three quarter inch copper line into your home. We would install the meter and hook you up to the town water. We would also cap your existing well. So if your property, basically it would be the property on the right hand side of Wagner Road going up to where the road takes the sharp bend to the left, those properties receive that.
Other homes where your property does not border the landfill we would do a conventional lateral hookup which would be a vein to the edge of the highway right-a-way and the individual would be responsible for taking the water from the highway right-a-way into their home.
So there is two different ways that we are handling it depending on whether your land borders the landfill or not.
We have checked with the State of New York, they indicated that if we do do this then we will relieve the Town of the necessity of sampling for landfill pollutants which will result in a substantial savings and sampling which is an on going thing for the Town.”
Michael Shannon, 436 Wagner Road – “Where exactly is this going to stop or where is the bend in the road…
Mr. Kestner pointed out the area on the map, which was on display and explained that they were originally going to stop at a certain point (lands that border the landfill) but decided to continue down Wagner Road.
Mr. Shannon – “Is there going to be a cost, a minimal cost affiliated with…
Mr. Kestner – “Yes, the cost to a home owner here with 65,000 gallons of water use would be $154 a year.”
Mr. Shannon – “I mean associated with the hook-up.”
Mr. Kestner – “Not if your property borders the Town landfill, we do the hook-up.”
Catherine Richardson, 368 Wagner Road – “I would like to hear a little bit more about the concerns about the landfill leach. When was that noticed? What impact could that have on us and I would like to hear a little bit more about the environmental impact of what is going on.”
Mr. Kestner – “We have not, in our sampling of the wells on property adjoining the landfill, picked up any contaminants from the landfill what so ever. It is just felt that the sampling costs are so high and to eliminate any potential that that could occur that this would be a good project to do.”
Ms. Richardson – “But there must be some landfill leach, correct?”
Mr. Kestner – “No. We do monitor the landfill on all sides, the liquids and then we monitor any kind of gas…this is being done as a precautionary measure. A little later on we will have a public hearing to move this further down Barhydt Road and then we have envisions of Rector Road.”
Ms. Richardson – “So at this point there’s no belief that the water is unsafe?”
Mr. Kestner – “No”
Ms. Richardson – “Also we had heard that there is something being done to improve the municipal water and we are wondering if you could comment on that and how is that being improved?”
Mr. Kestner – “At the present time in a different project there is an expansion of the well water treatment plant under design, which will incorporate emergency generators (microphone did not pick up Mr. Kestner’s response)
Ms. Richardson – “So that is not really a change in the treatment of the water?”
Mr. Kestner – “No.”
Ms. Richardson – “When is this project happening?”
Mr. Kestner – “It is up to the Town Board. They are having the public hearing tonight. Usually the Town Board would wait until the next meeting to authorize the district, if they choose to, and following that when the project is put out to bid or sent to the State Comptrollers Office.”
Ms. Richardson – “Where does the water come from?”
Mr. Kestner – “The water comes from down here at the Mohawk River off of Van Buren Lane where the RV Park is, you cross the railroad tracks and take a hard right going towards the Mohawk River. It comes from four large diameter wells they are twenty-four inches in diameter and then there is a series of gravel that is placed up against a screen …..(microphone did not pick up Mr. Kestner’s response)
Karen Henly, 368 Wagner Road – “The wells, do they have adequate water to take on all of these people?”
Mr. Kestner – “Yes”
Ms. Richardson – “So the $154 that you mention is just the estimated water bill?”
Mr. Kestner – “That would be your water bill if you use 65,000 gallons of water per year.”
Councilman Denney – “Who’s the best person for people who have further questions after the meeting to contact?”
Supervisor Mosher – “Mark Kestner or Ron Hutchins, either one.”
Frank Ruota, 242 Wagner Road - “I have a couple of questions, you said that if you run the lateral and make a hookup to my house that you will cap my old well. I have a problem with this. My old well gives me good volume for my swimming pool. I have a very large in ground pool. It holds 72,000 gallons of water and I would like to still be able to use that water to fill my pool. I spent $5,000 on that well and I have lived there since 1976. I would hate to loose that well and I would rather not cap it off. I have a dug well also which I could care less about; it is a ground water well which wasn’t any good. I know my next door neighbor would like to keep their well too.
I would like to draw your attention to something that you probably don’t know about, but have lived there for almost thirty years, six people out of nine houses have passed away from having cancer or currently have cancer; I am one of them that currently has it.
My concern is I am not sure if my property is one of the ones in this district (Mr. Kestner pointed out Mr. Ruota’s property on the map)
Mr. Kestner – “So we would run it into your home.”
Mr. Ruota – “So we haven’t done a scientific study on it but it seems out eight or nine houses that six people is a pretty high number to have died from or currently have cancer.”
Councilman Quinn – “Do all of those six people border the landfill?”
Mr. Ruota – “Yes. I have a very deep well 265 feet all cased so I have very little chance of leachet from the sides but from the bottom who knows and I do know for a fact that the second house up Carolyn Brown (currently owned by Ms. Richardson) she told me that she turned on her caps of water and she got methane gas out of it. We feel that things are moving along from the landfill.”
Mr. Kestner – “You can get the methane from shale; some of the shale will give you a blast of methane. What we did in terms of the methane gas is there are a row of wells that are drilled every fifty feet down below the refuse and we burn any gas and we do monitor those.”
Supervisor Mosher – “Mark would you please address Mr. Ruotas question on capping his well?”
Mr. Kestner – “We would prefer that the well be capped. I don’t know if the board would entertain if there were a release of liability, we want to be sure that if we go to the extent on the cost of running the line and putting a meter in that you use the water for that purpose. Our position would be that we would like the well capped. We don’t really have control…
Mr. Ruota – “Well if a release was signed or something in that order asking that we or a waiver saying not to accuse the Town of any problems from leachette from the landfill in our water system.”
Attorney Mastro, Jr. – “The problem with that is and we considered that as an alternative that can’t run with the land. The release for example in your case would come from you so you would release the Town, but then when you sell the property to somebody else it wouldn’t bind that new owner. In a system like this where there is a landfill that has been capped, the Town has been following DEC procedures of having the wells tested on annual basis, there has never been a contaminate found this is a precautionary measure and in conjunction with the overall plan to hook up to town water the Town Board would recommend and require that there be a release and a capping of the wells.”
Mr. Ruota – “I know my next door neighbor was concerned if she didn’t want the water, she actually said she did not want the water. They can put the lateral in but she doesn’t want to be hooked up to it. Is that an option for some of us on the road that may not want the water?”
Attorney Mastro, Jr. – “It is one of the cases where majority rules.”
Mr. Ruota – “So you are saying that if everybody gets the water but me and my next door neighbor that we would still be put on the water districts bill.”
Attorney Mastro, Jr. – “Yes, your property is already going to be in the district you are going to be billed…
Mr. Ruota – “If we didn’t use any there would be no bill…
Attorney Mastro, Jr. – “We would have to address what would happen in that case.”
Mr. Ruota – “I am not trying to be difficult. I know this will increase the value of my property, but I have a functioning system that I have worked on for years and I just hate to be able to loose that ability. I have a generator which is pre-wired to run my pump.
There is so much invested in my twenty eight years I hate to see the loss of that, I would love the water but I personally feel as though I would be taking a loss.”
Attorney Mastro – “A lot of your neighbors have been seeking to have water for a long time. How would you feel if the well were capped going into the house for personal consumption but it were permitted for outside faucets to just fill your swimming pool and something like that.”
Mr. Ruota – “That would be a very reasonable option.”
Attorney Mastro, Jr. – “It is something that we would have to explore, the engineers and the water department.”
Supervisor Mosher – “We don’t want to give you any false hope. You have an investment.”
Ron Hutchins, Water Department – “Right to this day and I have been testing the water for the last three years and in all of your wells in all the samples taken there has not been anything harmful found in anybody’s water.”

Supervisor’s Comments:
Supervisor Mosher read the following “Tentative Budget Message”
The Tentative Town Budget for 2005 was presented to the Glenville Town Clerk on September 30, 2004.
The proposed tax rate included in that Tentative Town Budget for 2005 may be 4.6%.
The tax increase for an average Glenville home of $105,000 would amount to $22.15 a year ($6 Town-wide, $6 Town-Outside-Village and $10 for Highway). That’s a tax increase of approximately $.43 per week. The Town-Outside-Village tax rate would increase from $2.36 per $1,000 of taxable valuation to $2.42. The Town-wide and Highway combined tax rate would increase from $4.59 to $4.89 per $1,000 of taxable valuation.
The tax increase for an average Village of Scotia home of $77,000 would amount to $4.47 a year; a tax increase of slightly less than $.09 per week. The tax rate would increase from $1.13 per $1,000 of taxable valuation to $1.19.
Among the cost drivers that increased the 2005 budget included, Health Benefits rose for all employees approximately $130,000. Employees raises and staffing increases rose approximately $322,000 (a 3.5% increase for all CSEA, Highway and non-represented employees and a 2.5% increase for police) and utilities/fuel grossed up approximately $83,000.
Informal Budget Hearings have been held over the past several weeks by the Comptroller, Supervisor, Deputy Supervisor and where schedules permitted, the liaisons for each Department.
Formal Budget Hearings will be held at 7:30 a.m. on Saturday morning, October 9th for the Police and Public Works Departments (Highway, Sewer and Water).
Budget Hearings will be held at 7 p.m., on Wednesday, October 13, 2004 for the Assessor’s Office, the Receiver of Taxes and the Town Clerk’s Office.
Budget Hearings will be held for the Building Department, Planning, Human Services, Justice Court and Information Technology (IT) on either Monday, October 11th (Columbus Day) or Saturday morning October 16th depending upon availability of Staff and members of the Town Board.
A Preliminary Budget will be presented to the Town Board for their consideration on Wednesday, October 20th.
A public Budget Hearing will be held on Wednesday, October 27th and the Final Budget will be passed by the Town Board on Wednesday, November 3rd.

WHEREAS the Town of Glenville is interested in purchasing staff support for the purposes of providing increased tourism, economic development promotion and marketing from the Schenectady County Chamber of Commerce; and
WHEREAS the current service will include but not be limited to the Schenectady Military Affairs (SMAC) work to ensure that the 109th Auxiliary at Stratton National Air Force Base continues; and
WHEREAS the Town made a provision in the budget to adjust for the expense in account 01.00.6989.4000, Economic Assistance,
NOW, THEREFORE, BE IT RESOLVED that the Glenville Town Board hereby authorizes the Supervisor to contract for the services of providing increased tourism, economic development promotion and marketing with the Schenectady Chamber of Commerce for $395.00 in 2004.

WHEREAS the Town of Glenville and the Burnt Hills-Ballston Lake Junior Baseball Commission have agreed to cooperatively develop the baseball field complex at Indian Meadows Park; and
WHEREAS the next phase of development involves dugouts, a storage building and a pavilion; and
WHEREAS the town’s consultant, Environmental Design Partnership has prepared plans for these improvements to the town’s specifications; and
WHEREAS the Burnt Hills-Ballston Lake Junior Baseball Commission will reimburse the town for debt service of the bond that will pay for these improvements,
NOW, THEREFORE, BE IT RESOLVED that the Director of Human Services is hereby authorized to solicit competitive bids in accordance with the town’s Procurement Policy for improvements to the baseball field complex at Indian Meadows Park including dugouts, a storage building, a pavilion and additional ancillary electrical, grading and related work.

Councilman Denney – “This resolution, as the Supervisor mentioned, will continue the next phase as the resolution states. It involves dugouts, storage building and a pavilion. The Burnt Hills-Ballston Lake Junior Baseball Commission is going to be responsible for all of the costs associated with the debt service for that. This is a perfect example of what I call a public/private partnership where the Town does its part, we have provided some land and worked very closely with them. Jamie MacFarland does a great job interfacing with these groups and they have an opportunity to improve those facilities for the benefit of not only the youth that use it but in many cases for instance Maalywck Park people use them for other activities as well when the soccer league isn’t working and I am assuming the
same thing goes on here. This is just a really good example of the type of work that the Town does and I totally expect that we will support this.”

WHEREAS, Ron Hutchins, Senior Maintenance Worker has obtained three quotes for this Camera System; and
WHEREAS, ENVIROSIGHT, 111 Canfield Avenue, Unit A 14, Randolph, New Jersey was the lowest responsible bidder; and
WHEREAS, the ROVVER 600 Crawler Camera with Pan & Tilt Color Video, Remote Focus, All Wheel Drive, Auxiliary Lighting, Motorized Cable Reel & Rollers, and a 19” Monitor with VHS Recorder and a Portable Carrying Case,
NOW, THEREFORE, BE IT RESOLVED, that the Commissioner of Public Works, on behalf of the Town of Glenville be and hereby is authorized to accept the quote and purchase the Complete ROVVER 600 System at a cost not to exceed $45,376.00; and

WHEREAS, Andimo A. Coppola, Commissioner of Public Works, has recommended that the Town purchase an additional Trench Box to be attached to the 4’ x 8’ Trench Box, increasing the size to 8’ x 12’ which is to be used to repair water main breaks, install or repair water lines; and
WHEREAS, the Build-A-Box Trench Box is the compatible addition to the existing Trench Box to be purchased from A.J. VEL., LTD, 7 Hemlock Street, Latham, New York,
NOW, THEREFORE, BE IT RESOLVED, that the Commissioner of Public Works, on behalf of the Town of Glenville be and hereby is authorized to purchase one Build-A-Box Trench Box, Model # 612XLAP at a cost not to exceed $22,825.00; and
BE IT FURTHER RESOLVED, that this purchase shall be funded as follows: $22,825.00 from Water District No. 11 Equipment (50.11.8340.2000). This will leave a balance of $42,000.00 in that line item.

WHEREAS a vacancy exists in the Town of Glenville Building Department due to the promotion of Terri Petricca from Principal Account Clerk to Code Enforcement Officer; and
WHEREAS the position of Account Clerk Typist was established in the department to provide for entry level support staff; and
WHEREAS the Schenectady County Civil Service Commission has issued a certified list of the top three candidates who have taken the competitive test for Account Clerk Typist; and
WHEREAS the Building Department staff canvassed these three candidates for interest, subsequently interviewing two candidates who wished to be considered for the position; and
WHEREAS the interview team was unanimous in their support for the highest ranking candidate to be appointed; and
WHEREAS this position was provided for in the Building Department’s 2004 budget,
NOW, THEREFORE, BE IT RESOLVED that Jill Walsh, 4 Pine Street, Glenville, NY 12302 be and hereby is appointed to the vacant position of Account Clerk Typist in the Town of Glenville Building Department effective 10/25/04 at the rate set forth in the CSEA/Town of Glenville Agreement of $27,178.00.

WHEREAS the Town of Glenville, Water Department owns one 1994 Oldsmobile Cutlass Wagon, VIN 1G3AJ85MXR6424758; and
WHEREAS the Oldsmobile was in a vehicle accident on September 16, 2004; and
WHEREAS an estimate of repairs was obtained in the amount of $2,540.92; and
WHEREAS the blue book market value of the car is $3,345; and
WHEREAS the Town does not have collision insurance on said vehicle therefore liable for the entire cost of repair; and
WHEREAS the Commissioner of Public Works hereby recommends selling said vehicle as/is,
NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Glenville in accordance with Highway Law §142 hereby declares one 1994 Oldsmobile Cutlass Wagon, VIN 1G3AJ85MXR6424758 as surplus; and
BE IT FURTHER RESOLVED that the Commissioner of Public Works is hereby authorized to sell the vehicle for market value or best offer price.

NEW BUSINESS:
Councilman Denney – “I wanted to bring up the issue of signs since it was mentioned by Ms. Graney in her comments during Privilege of the Floor. She passed around those pictures and I actually drove through there. I wanted to go through there again because the ladies have been coming to talk to us quite a bit in recent months so I wanted to go through and see what we had done in that area and I saw the dirt piles. I wasn’t particularly please but on the other hand it solves the problems they brought up before but it really needs to be addressed in a way that is more appealing, but I think it does address some of the issues that they had brought up here before.
I saw the signs and I think one was a commercial location and a couple were political signs and I couldn’t believe that somebody would stoop to that level and use a dirt pile. You show no shame when you put signs in these locations. It is public property to my knowledge and there are signs throughout the Town and the County on public property. It is offensive and it is not right. It makes the community look worse and in this case it already does having a dirt pile there.
I would just ask that who ever is putting the signs up throughout the Town illegally on public property take them down. It is really rather simple and if it’s roads that the Town has authority over we ought to instruct our highway department personnel to take them down. It is not particularly complicated.
I appreciate your bringing it up and I have noticed it throughout the Town this year and it seems like it gets worse and worse and worse every year and you are talking about a specific instance and I am talking about the Town as a whole.”
