Minutes of Meeting

Public Hearing – Notice of Intent – 39 Blueberry Lane – Maple Sands – CE159-1098
Ms. Joyce Hastings, Engineer of GLM Engineering, appeared before the Commission for the construction of a single-family house.  Ms. Hastings gave the Commission a brief overview of the project plans.

There is a driveway wetland crossing which was put in 7 years ago.  The Orders of Conditions for this have expired and the applicant is now refiling in order to do this work.  The house and the septic system are located outside of the 100 ft. buffer zone; the driveway access is located inside the buffer zone.

Mr. Russell stated that the applicant has adequately addressed all of his comments.  The Order of Conditions for the subdivision itself has expired.

There was a motion made by Paul Harrington to close the public hearing for 39 Blueberry Lane.  The motion was seconded by Ravi Pendkar and accepted with a vote of 5-0-0.

There was a motion made by Paul Harrington to approve the NOI for 39 Blueberry Lane with the special conditions 20-35, 38, 40, 41, 43 & 44.  The motion was seconded by Ravi Pendkar and accepted with a vote of
5-0-0.

Public Hearing – Notice of Intent – 43 Blueberry Lane – Maple Sands - CE159-1097  
Ms. Joyce Hastings, Engineer of GLM Engineering, appeared before the Commission for the construction of a single-family house.  Ms. Hastings gave the Commission a brief overview of the plans for the project.  She stated that the house and driveway are outside of Conservation jurisdiction.  It is only a small piece of land that is inside the 100 ft. buffer zone.  The erosion control barrier is already in place.

There was a motion made by Scott McLean to close the public hearing for 43 Blueberry Lane NOI.  The motion was seconded by Ravi Pendkar and accepted with a vote of 5-0-0.

There was a motion made by Scott McLean to approve the NOI for 43 Blueberry Lane with the special conditions 20-35, 38, 40, 41, 43&44.  The motion was seconded by Ravi Pendkar and accepted with a vote of 5-0-0.

Public Hearing – Notice of Intent – 620 Pleasant Street – Oakes - CE159-1099
The Commission Chairman opened the public hearing and Mr. Russell, Conservation Agent, stated that a letter has been received from the applicant requesting a continuance of the public hearing until the next meeting on August 13th.  The Chairman read the letter into the Conservation record.

There was a motion made by Paul Harrington to continue the public hearing for 620 Pleasant Street until August 13th at 7:35 p.m.  The motion was seconded by Scott McLean and accepted with a vote
of 5-0-0.

Public Hearing – Amendment – Franklin Retirement – Midpoint Engineering – CE159-1001
Mr. Patrick Doherty, Engineer of Midpoint Engineering, appeared before the Commission for the deletion of a sidewalk along the access drive to Chestnut Ridge Condominiums and to realign the emergency  access  path.  Mr. Doherty gave the Commission members some background information for this project.

Mr. Doherty also explained in detail to the Commission members the details of the proposed construction work to take place at the site.

There will be decreasing of impervious area in conducting this work.

Mr. Peter Baglioni, an abutter of 5 Aspen Way, expressed concerns regarding the fact that the planting of trees has already taken place at the site without Conservation approval to eliminate the sidewalk.

Mr. Russell stated that the Planning Board already eliminated the need for the sidewalk.  The applicant planted the trees at their own risk and are appearing at tonight’s meeting requesting deletion of the requirement for the sidewalk from Conservation.

There was a motion made by Scott McLean to close the public hearing for the 485 East Central Street NOI Amendment.  The motion was seconded by Steve Younis and accepted with a vote of 5-0-0.

Continued - Public Hearing – Request for Determination –
5 Kenwood Circle – RCG Kenwood
Mr. Peter Bemis, Engineer of Engineering Design Consultants, appeared before the Commission for the installation of stormwater management structures.  Mr. Bemis gave the Commission members a detailed overview of the project plans with the wetlands flagged.

The major portion of the project is outside of the resource limits, the rear portion of the parking lot is in Conservation jurisdiction.  The site needs to be brought in compliance with stormwater management.  

Mr. Bemis gave the Commission a detailed explanation of how this will be performed in order to get it in compliance.

Mr. Russell stated that his comments have been addressed.  He did state that the drainage system on site is causing a lot of erosion and this project will be a large improvement.

There was a motion made by Ravi Pendkar to close the hearing for the
5 Kenwood Circle RDA.  The motion was seconded by Paul Harrington and accepted with a vote of 5-0-0.

There was a motion made by Ravi Pendkar to issue a Negative Determination for the RDA for 5 Kenwood Circle.  The motion was seconded by Paul Harrington and accepted with a vote of 5-0-0.

Continued - Public Hearing – Notice of Intent – Westoo Woods – Acme Jazz – CE159-1091
Mr. Phil Cordeiro, Engineer of Allen & Major Associates, appeared before the Commission for the construction of multi-family buildings at 1312-1342 West Central Street.  Mr. Cordeiro stated that the peer review was undergoing at the last Conservation meeting.  There was a letter submitted from Graves Engineering dated July 29th identifying each of their original concerns and hopefully they have been satisfactorily addressed at this time.  They recommended that there is one outstanding clerical error on the plans that needs to be corrected.  There is a revised plan submitted to Graves for their approval and the one comment has been addressed.

George Russell, Conservation Agent, stated that all of his concerns have been addressed in the peer review and there in one concern in their letter that can be addressed as a special condition.

There was a motion made by Steve Younis to close the public hearing for Weston Woods NOI.  The motion was seconded by Ravi Pendkar and accepted with a vote of 5-0-0.

There was a motion made by Scott McLean to approve the NOI for Weston Woods with the special condition 19-44, 46 and the condition that they comply with the soil testing addressed in the July 29th letter from Graves Engineering Item 6 under stormwater management and that the revised plan be the plan denoted on the Orders of Conditions.  The motion was seconded by Steve Younis and accepted with a vote
of 5-0-0.



GENERAL BUSINESS

Minor Buffer Zone Activity:  33 Miller Street
Mr. & Mrs. Peter Doyle, the applicants, both appeared before the Commission for the expansion of an existing deck.  The flooring will be replaced with a composite material.  The deck will be 12’x24’ in dimension.

There was a motion made by Scott McLean to approve the MBZA for
33 Miller Street.  The motion was seconded by Steve Younis and accepted with a vote of 5-0-0.

Minor Buffer Zone Activity:  11 Vine Street
Mr. Jim Danello, the contractor for the project, appeared before the Commission for the reconstruction a new deck, 14’x26’ in dimension.
The deck is proposed to be pressure-treated material.

The Chairman stated that the Commission does approve of pressure-treated material.  

There was a motion made by Paul Harrington to approve the Minor Buffer Zone Activity for 11 Vine Street with the stipulation that the decking cannot be pressure-treated.  The motion was seconded by Scott McLean and accepted with a vote of 5-0-0.

Discussion:  Herbicide Application  
George Russell, Conservation Agent, informed the Commission members that the Chairman is required to sign the herbicide application on behalf of the Commission.  It is a yearly operational plan performed by the DPW.

There was a motion made by Paul Harrington to accept the DPW’s herbicide application plan for the current year.  The motion was seconded by Ravi Pendkar and accepted with a vote of 5-0-0.
Certificate of Compliance:  10 Bent Street – CE159-1075
George Russell, Conservation Agent, informed the Commission that the
site is in compliance and recommended the issuance of a Certificate of Compliance.

There was a motion made by Paul Harrington to approve a Certificate of Compliance for 10 Bent Street.  The motion was seconded by Scott McLean and accepted with a vote of 5-0-0.

Certificate of Compliance:  236 Daniels Street – SE159-912
George Russell, Conservation Agent, informed the Commission that the
site is in compliance and recommended the issuance of a Certificate of Compliance.

There was a motion made by Scott McLean to approve a Certificate of Compliance for 236 Daniels Street.  The motion was seconded by Paul Harrington and accepted with a vote of 5-0-0.

Permit Modification:  438 West Central Street – SE159-862  
Mr. Russell stated that the applicant has requested that this discussion be continued until the next meeting.

Minutes
There was a motion made by Paul Harrington to approve the minutes of July 16th.  The motion was seconded by Ravi Pendkar and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

There was a motion made by Scott McLean to adjourn the meeting and seconded by Steve Younis and accepted with a vote of 5-0-0.
