Mr. George Russell’s Agent’s Report has been appended to the minutes.

Continued – Public Hearing - Notice of Intent – Villages at Cook’s Farm – Ron Roux - CE15 1061
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, and Mr. Ron Roux, the developer for the project, both appeared before the Commission for the construction of 55 single-family homes.

Mr. Nielsen gave the Commission members a detailed overview of the project for which the plans have gone through 2 changes.  The last change being made on June 5th, 2014.

There is no disturbance in the 0–25 ft. buffer zone; in the 25-50 ft. zone, there will be some disturbance for the pavement and a variance will be requested for the crossing.

Mr. Roux stated that DPW recommended that the line be pulled back near the pump station.   

Mr. Nielsen provided a copy of a letter from GZA, the engineering consultants for the project, along with his comments for Commission review addressing their issues.

Mr. Russell informed the Commission that they  must find a reasonable presumption of overcoming adverse impacts and the applicant has addressed all of those issues.

Mr. Russell stated that Town Engineer’s email with his issues have been addressed.

The Commission members stated that all of their concerns have been satisfied.

Mr. Russell stated that he recommends that the Commission should reference the issues recommended in the June 24th memo from the applicant.  Also, in terms of limited crossing that the road design must be acceptable in the terms of the Planning Board and the Planning Board has stated that it is acceptable.   

There was a motion made by Paul Harrington to close the hearing.  The motion was seconded by Marc DePoto and accepted with a vote of 5-0-0.

There was a motion made by Paul Harrington to approve the Cook’s Farm Notice of Intent with all of the special conditions attached.  The motion was seconded by Ravi Pendar and accepted with a vote of 5-0-0.

Certificate of Compliance:  1153 West Central Street - CE159-944
Mr. Russell stated that he has inspected the property and all is in order for a full release of the Orders of Conditions.  

There was a motion made by Dayna Gill to accept the Certificate of Compliance for 1153 West Central Street.  The motion was seconded by Marc DePoto and accepted with a vote of 5-0-0.

Certificate of Compliance:  67 Hancock Road (Partial) - SE159-490
Mr. Russell stated that he has inspected this site and all is in order for a full release of the Orders of Conditions.

There was a motion made by Marc DePoto to issue a Certificate of Compliance for 67 Hancock Road.  The motion was seconded by Dayna Gill and accepted with a vote of 5-0-0.

Certificate of Compliance:  656 King Street (Partial) - CE159-1029
Mr. Russell informed the Commission that the required report from the wetlands scientist has been recently received and the wetlands replication areas have failed.  The scientist has submitted a report recommending certain plantings and recommending that the areas be redone.

Mr. Russell recommended that the release is not in order and that the technical details still need to be worked out.  The as built plans do not depict rain gardens.

Mr. Donald Nielsen stated that the replication area was approved to be a meadow and not a shrub wetland.

Ms. Karon Skinner Catrone, wetland scientist for the project, stated that it has been planted correctly.  The Commission did approve the planting of a meadow there.

There was a motion made by Ravi Pendkar to continue the discussion for the certificate of compliance until July 17th so that the wetland scientist can verify that the plan she has proposed

regarding the plantings has been achieved.  The motion was seconded by Marc DePoto and accepted with a vote of 5-0-0.

Discussion:  Bench Policy
There was a discussion among the Commission regarding the bench policy.  Mr. Russell stated that policy can be amended at a later date without the need for a public hearing.  

There was a motion made by Paul Harrington that we accept the policy for donation of benches, tables, plaques and plantings dated 6/18/14 with the reservation that it can be amended in the future.  The motion was seconded by Dayna Gill and accepted with a vote of 5-0-0.
Discussion:  Annual Report
There was a discussion among the Commission members regarding the annual report.  There are 2 photos depicted in the report and some discussion ensued regarding these photographs along with some suggested captions.

Mr. Russell will finalize the comments and bring back the final copy for approval and vote at the next meeting.

Discussion:  Commission Webpage
There was a discussion among the Commission members regarding the Commission webpage which will be revised in the near future.  The topic was do the Commissioners want their names on the depicted on the website.

The consensus of the Commission was that they would like to have their names on the website but no email addresses.
 
Minutes:  
There was a motion made by Ravi Pendar to accept the minutes of the June 12th meeting.  The motion was seconded by Dayna Gill and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

There was a motion made by Ravi Pendkar to adjourn the meeting.  The motion was seconded by Dayna Gill and accepted with a vote of 5-0-0.
